Tuesday, January 21, 2020
6:30 P.M.
1. CALL TO ORDER
Mayor Carlson called the meeting to order at 6:47 p.m.
2. ROLL CALL
City Council: Councilmembers Caron, Dierking, Kurschner, Miller and Mayor
Carlson
Absent: None
Also Present: City Manager Luger, City Attorney Staunton, Public Works
Superintendent Amundsen, Finance Director Horn and City Clerk

3. APPROVAL OF MINUTES
(a) January 6, 2020 Work Session Minutes
Caron moved, Dierking seconded, to approve the January 6, 2020 Work Session
Minutes deleting the reference to a moratorium and instead adding zoning changes
in the Council goal pertaining to the residential design code. Motion carried 5/0.
(b) January 6, 2020 City Council Minutes
Caron moved, Dierking seconded, to approve the January 6, 2020 City Council
Minutes. Motion carried 5/0.
4. RECOGNITION and OPEN FORUM
None.
5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS
(a) Project Advisory Committee Update (Bandshell)
Councilmember Caron gave an update on the bandshell project on behalf of the
Project Advisory Committee.

(b) Service Day in May Update
Council Member Kurschner and Mayor Carlson gave an update on the Service Day in
May.
(c) South Lake Minnetonka Police Department Update
Mayor Carlson gave an update on the South Lake Minnetonka Police Department.
(d) Volunteer Recognition Event
Mayor Carlson reported on the organization of a potential volunteer recognition
event.
6. MEET EXCELSIOR
Gary and Kellie Ringate, Gary’s First Class Car Care, 301 Water Street, addressed the City
Council.
7. AGENDA APPROVAL
(a) Meeting Agenda
Caron moved, Dierking seconded, to approve the January 21, 2020 Meeting Agenda
with item 9(a) Minnehaha being rescheduled to a future agenda. Motion carried
5/0.
(b) Consent Agenda
Dierking moved, Kurschner seconded, to approve the Consent Agenda for January
21, 2020 with the removal of item 5 Resolution 2020-01 Approving Design Standards
Review for 770 Excelsior Boulevard. Motion carried 5/0.
1. Approve Verified Claims – Approve for Payment Manual Checks 086045 –
086112
Action - Approved for payment manual checks 086045 - 086112.
2. Second Reading of Residential Design Standards Ordinance Amendments

Action – Waived the second reading of and adopted Ordinance No. 597, an
Ordinance Amending Articles 14 and 41 of the City’s Zoning Code and Adopted
Resolution 2020-05, a Summary Resolution of Ordinance No. 597.
3. Acknowledge 10% Gambling Donations
Action – Acknowledged Charitable Gambling Donations for the fourth quarter
of 2019.

4. Temporary Liquor License St. John’s Parish
Action – Approved the issuance of a Temporary Liquor License to St. John the
Baptist Catholic Church for the Parish Gala on February 8, 2020 from 6:00 p.m. to
11:00 p.m., with the conditions outlined in the Temporary Liquor License
Application.
6. 2020 CIP Authorization
Action – Authorized staff to start the process of purchasing items listed in the
2020 Capital Improvement Plan – Equipment/Minor Projects Listing.
7. 2020 Pay Equity Report
Action – Approved the Pay Equity report and directed staff to submit the report
to the Minnesota Management and Budget Department.
8. Resolution 2020-15 Establishing an Absentee Ballot Board
Action – Adopted Resolution 2020-15 Establishing an Absentee Ballot Board for
the Presidential Nomination Primary of March 3, 2020, State Primary Election of
August 11, 2020 and General Election of November 3, 2020.
5. Resolution 2020-01 Approving Design Standards Review for 770 Excelsior
Boulevard
Kurschner moved, Caron seconded, to adopt Resolution 2020-01 as presented at
the January 6, 2020 City Council Meeting requesting staff encourage the
applicant to enhance the landscaping from what was presented on the original
plan. Motion carried 5/0.

8. PUBLIC HEARINGS
(a) None.
9. PETITIONS, REQUEST and COMMUNICATIONS
(a) Minnehaha
Mayor Carlson gave an update on the Minnehaha with the Minnehaha Board asking
to postpone this topic to the March 2, 2020 meeting for report and discussion.
10. ORDINANCES AND RESOLUTIONS
(a) Second Reading of Amendments to Special Events Permit Ordinance
Kurschner moved, Caron seconded, to continue the Second Reading of
Amendments to the Special Events Permit Ordinance to the February 3 meeting
directing staff to work with Public Safety and the Chamber to solidify a
recommendation for the number of allowed events for Levels 1, 2 and 3 in the
ordinance. Motion carried 5/0.
11. REPORTS OF OFFICERS, BOARDS, and COMMITTEES
(a) None.
12. UNFINISHED BUSINESS
(a) Discussion of City/Chamber Memorandum of Understanding
Kurschner moved, Caron seconded, to approve the draft Memorandum of
Understanding and authorize execution by the Mayor and City Manager. Motion
carried 5/0.
(b) East Side Subarea Plan Comprehensive Plan Amendment
Kurschner moved, Dierking seconded, to adopt Resolution 2020-03 amending the
Comprehensive Plan by adding the Subarea Plans Chapter with the addition of
maximum 35 feet in parenthesis and changing acres to acre on the placemat.
Motion carried 5/0.
Beth Maloney, Maynards Restaurant, 685 Excelsior Boulevard, addressed the Council
regarding the East Side Subarea Plan.

(c) Review City Council Bylaws
Dierking moved, Kurschner seconded, to adopt Resolution 2020-08 Approving
Amendments to the City Council Bylaws and adjusting the agenda template moving
Meet Excelsior before Agenda Approval. Motion carried 5/0.
(d) 2020 City of Excelsior Objectives
Kurschner moved, Caron seconded, to continue the 2020 City of Excelsior
Objectives to the Council Off-Site Planning Session. Councilmembers should email
their rankings to Luger once completed. Motion carried 5/0.
13. NEW BUSINESS
(a) Schedule Council Off-Site Planning Session
The Council scheduled an Off-Site Planning Session on Saturday, February 29, 2020
from 9:00 a.m. to 1:00 p.m. with Luger bringing location options to the next meeting.
This meeting will not be recorded but will be open to the public.
(b) Accept Resignation and Declare Vacancy on the Parks and Recreation Commission
Dierking moved, Caron seconded, to accept Karen Schott’s resignation and declare
a vacancy on the Parks and Recreation Commission, direct staff to advertise for
Citizen Inquiry Forms to be submitted no later than Thursday, February 6, 2020, and
appoint Councilmember Dierking to conduct interviews with the Park Commission
Chair and bring a recommendation to the Council at a future meeting. Motion
carried 5/0.
14. ADJOURNMENT
Kurschner moved, Dierking seconded, to adjourn the meeting at 8:35 p.m. Motion carried
5/0.
