City of Excelsior Regular Council Meeting MINUTES Monday, September 20, 2021 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:33 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Kurschner Absent: None Also Present: City Manager Luger, City Attorney Staunton, Public Works Superintendent Amundsen, City Engineer Dawley, Finance Director Palmer, and City Clerk Williams 3. APPROVAL OF MINUTES (a) September 7, 2021 City Council Work Session Minutes (b) September 7, 2021 City Council Minutes (c) September 13, 2021 Special Work Session Minutes Kurschner moved, Dierking seconded, to approve the September 7, 2021 Work Session Minutes, September 7, 2021 City Council Minutes, and September 13, 2021 City Council Minute Special Work Session Minutes. Motion carried 5/0. 4. OPEN FORUM Peter Hartwich, 186 George Street, addressed the Council about dock fees, 106 Center Street, and ARPA funding. Minutes City Council Meeting September 20, 2021 Page 2 Pete Studer, 604 Glencoe Road, addressed the Council about the flagpole and seating at the Pavilion. Bruce Noll, 242 First Street, addressed the Council about seating at the Pavilion. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior-Lake Minnetonka Chamber of Commerce Update Jen Weiss, Excelsior-Lake Minnetonka Chamber of Commerce, gave an update of the recent Art & Apple Days event, current job vacancies of local businesses, and SBA loans. (b) Construction and Drought Updates Tim Amundsen, Public Works Superintendent, gave an update on the current drought situation and construction projects. Morgan Dawley, City Engineer, gave an update on the current construction projects. Councilmember Caron gave an update on the Water Street Trail Stop project. (c) Mayor Updates Mayor Carlson expressed gratitude towards the Excelsior Morning Rotary Club for the 2021 Concerts in The Commons, and Commissioner LaTondresse and Policy Director Olson for the crosswalk at Mill Street and Highway 7 and the resident request of lights at County Road 19. Mayor Carlson gave an update on the Minnoco gas station and Fall Clean-Up. 6. MEET EXCELSIOR (a) None Minutes City Council Meeting September 20, 2021 Page 3 7. AGENDA APPROVAL (a) Meeting Agenda Dierking moved, Hersman seconded, to approve the September 20, 2021 Meeting Agenda. Motion carried 5/0. (b) Consent Agenda Kurschner moved, Caron seconded, to approve Items 1,2,4,5,6, and to pull Item 3 for a separate discussion. Motion carried 5/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approve Verified Claims over $20,000. 2. Continue Commercial District Ordinance Action – Continued Commercial District Ordinance Amendment to the October 18, 2021 City Council Meeting. 3. Approve Resolution 2021-62 Declare Costs and Set Assessment Hearing 2020 Street & Utility Improvements Project Kurschner moved, Hersman seconded, to approve Resolution 2021-62 Declare Costs and Set Assessment Hearing 2020 Street & Utility Improvements Project. Motion carried 5/0. 4. Approve Pay Voucher No. 2 2021 Street & Utility Improvements Project Action – Approved Pay Voucher No. 2 2021 Street & Utility Improvements Project. Approve Change Order No. 1 2021 Street & Utility Improvements Project Action – Approved Change Order No. 1 2021 Street & Utility Improvements Project. 6. Continue VJAA Proposal for Concession Building/Plaza Project Action – Continued VJAA Proposal for Concession Building/Plaza Project to the October 4, 2021 City Council Meeting. 8. PUBLIC HEARINGS (a) None 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) Paradise Charter Cruises Winter Storage Lease Dierking moved, Caron seconded, to approve the Commercial Pier Lease with Paradise Charter Cruises. Motion carried 4/1. Councilmember Hersman voted no. (b) 2022 Preliminary Budget Kurschner moved, Hersman seconded, to adopt Resolution 2021-63 Resolution Certifying the 2021 Proposed Property Tax Levy Collected in 2022, Proposed General Fund Budget and Public Meeting Date, Time, and Location. Motion carried 5/0. (c) American Rescue Plan Act (ARPA) Funding No action. Council will continue discussion at a future work session. 10. ORDINANCES and RESOLUTIONS (a) None Minutes City Council Meeting September 20, 2021 Page 5 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) 106 Center Street Mayor Carlson invited members of the public to provide feedback on this topic. Jodi Knoll, 242 First Street, addressed the Council about the stormwater issue in the neighborhood and would like further analysis from the Community Development Director. Melinda Kohlmeyer, 201 First Street, addressed the Council about traffic concerns at this property. Karen Tyler, 217 First Street, addressed the Council about the zoning code and traffic concerns. Peter Hartwich, 186 George Street, addressed the Council about traffic concerns and stormwater issue. Bruce Knoll, 242 First Street, addressed the Council about the use of City Codes. Eric Snyder, 25 Center Street, addressed the Council about the use of the property. Hersman moved, Dierking seconded, to continue this item to the November 1, 2021 City Council Meeting, and establish a work group with Councilmember Caron and Councilmember Dierking as a backup with the direction provided from the Council. Motion carried 4/1. Councilmember Kurschner voted no. 13. NEW BUSINESS (a) None Minutes City Council Meeting September 20, 2021 Page 6 14.
