City of Excelsior Regular Council Meeting MINUTES Monday, December 20, 2021 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:30 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Dierking, Hersman, Kurschner Absent: Councilmember Caron Also Present: City Manager Luger, Public Works Superintendent Amundsen, City Engineer Dawley, Community Development Director Mullin, Finance Director Palmer and City Attorney Staunton. 3. APPROVAL OF MINUTES (a) December 6, 2021 City Council Work Session Minutes (b) December 6, 2021 City Council Minutes Hersman moved, Kurschner seconded, to approve the December 6, 2021 City Council Work Session Minutes and December 6, 2021 City Council Minutes. Motion carried 4/0. 4. OPEN FORUM None. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior-Lake Minnetonka Chamber of Commerce Update No Update. Minutes City Council Meeting Monday, December 20, 2021 Page 2 (b) South Lake Minnetonka Police Department Update Mayor Carlson provided an update for the South Lake Minnetonka Police Department. Brian Tholen was appointed the new Chief of Police for South Lake Minnetonka Police Department and will start January 1, 2022. Mayor Carlson also thanked Lieutenant, Justin Ballsrud, for his service in the interim. 6. MEET EXCELSIOR (a) Mark Kroll, Lake Minnetonka Conservation District Representative, addressed the City Council. 7. AGENDA APPROVAL (a) Meeting Agenda City Manager Luger, notified the council of changes to the agenda. Public Hearing Items 8(b) and 8(c) will be continued to the January 3, 2022 Council Meeting. Petition Item 9(a) was pulled from the agenda. Dierking moved, Hersman seconded, to approve the agenda with the changes. Motion carried 4/0. (b) Consent Agenda Kuschner moved, Hersman seconded, to approve Items 1,2,3,4 and 6. Motion carried 4/0. 1. Resolution 2021-79 Certifying 2021 Property Tax Levy Collectible in 2022 Action – Adopted Resolution 2021-79 Certifying The 2021 Property Tax Levy Collectible in 2022. 3. Adopt the 2022 Budget Action – Adopted Resolution 2021-80 Setting the 2022 Budget. 4. Approve Pay Voucher No. 5 2021 Street & Utility Improvements Project Action – Approved the Construction Pay Voucher No. 5 for the 2021 Street & Utility Improvements Project and authorized payment to Northdale Construction Co. Inc. 5. Continued 2nd Reading of Commercial Districts Ordinance Action – Continue 2nd Reading of Commercial District Ordinance to the January 17, 2022 City Council Meeting. Dierking moved and Hersman seconded to approve Item 5. Motion carried 4/0. 6. Approve Pay Voucher No. 2 Water Street Overlay Improvements Project Action – Approved Construction Pay Voucher No. 2 for the Water Street Overlay Improvements Project and authorized payment to Bituminous Roadways, Inc. 8. PUBLIC HEARINGS (a) 2022-2023 Street & Utility Improvements Project Action – Adopt Resolution 2021-81 ordering the public improvements for the 2022- 2023 Street and Utilities Project (MCES L20). Minutes City Council Meeting Monday, December 20, 2021 Page 4 Kurschner moved, Hersman seconded to adopt Resolution 2021-81 ordering the public improvements for the 2022-2023 Street and Utilities Project (MCES L20). Motion carried 4/0. (b) 435 Water Street Huntington Bank Conditional Use Permit Application Continued public hearing to the January 3, 2022 meeting. (c) 481 Second Street Lakeshore Market Sign Variance Application Continued public hearing to the January 3, 2022 meeting. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) 287 Water Street Sketch Plan Item was pulled by the applicant. (b) Long-Term Financial Plan for The Commons Jenny Palmer, Finance Director, and Doug Green, Baker Tilley, gave a presentation on the Long-Term Financial Plan for the Commons. Kurschner moved and Hersman seconded, to move forward with selling a sales tax bond for projects in The Commons park area based on a future analysis by staff. Motion carried 4/0. 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None . Minutes City Council Meeting Monday, December 20, 2021 Page 5 12. UNFINISHED BUSINESS (a) Mooring Policy Changes Dierking moved, Hersman seconded, to accept the Mooring Policy Changes and direction offered to staff from the items brought to attention by the Parks & Recreation Commission with the removal of any reference to power boats on buoys. Motion carried 4/0. Kurschner moved, Hersman seconded to reconsider the previous motion. Motion carried 3/1. Kurschner moved, Dierking seconded, to adopt the Mooring Policy with direction to staff to hold the fee structure for 2022 with a change in 2023 to a flat fee rate regardless of the size of the boat, direction for no portable restrooms in the Port and to remove any references to power boats on buoys in the Mooring Policy. Motion carried 4/0. (b) Remote Meeting Attendance at City Council and Commission Meetings Council directed staff to work with commissions to come up with some language for a future policy. 13. NEW BUSINESS (a) 106 Center Street Roof Repair Council provided direction to staff to monitor the building and look more into the repair and bring it back for discussion at the February 7, 2022 Council meeting. (b) Opioid Settlement Participation Hersman moved, Dierking seconded, to approve Resolution 2021-82 Authorizing Participation in the National Opioid Settlement.
