City of Excelsior Regular Council Meeting MINUTES Monday, October 17, 2022 6:30 P.M. 1. CALL TO ORDER Acting Mayor Caron called the meeting to order at 6:35 P.M. 2. ROLL CALL City Council: Acting Mayor Caron and Councilmembers Dierking, Hersman, and Tyler Absent: Mayor Carlson Also Present: City Manager Luger, Public Works Amundsen, City Engineer Dawley, Finance Director Palmer, Assistant City Manager/City Attorney Staunton, and City Clerk Williams (a) Resolution 2022-43 Declaration of Council Vacancy and Appointment of Replacement Dierking moved, Hersman seconded, to adopt Resolution 2022-43 Declaration of Council Vacancy and Appointment of Replacement. Motion carried 3/0. (b) Oath of Office – Rob Tyler Acting Mayor Caron administered the Oath of Office to Rob Tyler. 3. APPROVAL OF MINUTES (a) October 3, 2022 City Council Work Session Minutes Dierking moved, Hersman seconded, to approve the October 3, 2022 City Council Work Session Minutes. Motion carried 3/0. Motion carried 3/0. Councilmember Tyler abstained. 4. OPEN FORUM Karen Kohnen and Ashley Wyley, Lakeshore Market & More, 481 Second Street, addressed the Council about the THC license. Peter Hartwich, 186 George Street, addressed the Council about the recent software purchase. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) 339 Third Street Update Councilmember Hersman gave an update on the proposed 339 Third Street redevelopment project. (b) Excelsior Fire District Update No Update. (c) South Lake Minnetonka Police Department Update Update has been continued to the November 7, 2022 City Council Meeting. (d) Parks and Recreation Commission Update Tim Amundsen, Public Works Superintendent, gave an update on the Parks and Recreation Commission. (g) St. Alban’s Bay Bridge Update Acting Mayor Caron and City Engineer Dawley gave an update on the federal grant that was awarded to the City of Excelsior and Greenwood. (h) Fall Clean-Up October 29th Fall Clean-Up is scheduled for Saturday, October 29th. (i) Organics Recycling Rebate Program Nalisha Williams, Administrative Services Director, gave an update on the Organics Recycling Rebate Program. 6. MEET EXCELSIOR (a) Hennepin Healthcare EMS Presentation Martin Scheerer and Nick Simpson, Hennepin Healthcare EMS Presentation, addressed the Council. 7. AGENDA APPROVAL (a) Meeting Agenda Dierking moved, Hersman seconded, to approve the October 17, 2022 Meeting Agenda with the change to remove Item 13(a). Motion carried 4/0. Approve Pay Voucher No. 12 2021 Streets & Utility Improvements Project Action – Approved Pay Voucher No. 12 2021 Street & Utility Improvements Project 8. PUBLIC HEARINGS (a) None 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) Oak Street Water Street Gateway Dierking moved, Tyler seconded, to accept the proposed renovation plan. Motion carried 3/1. Councilmember Hersman voted no. Minutes City Council Meeting Monday, October 17, 2022 Page 5 (b) Utility and Special Revenue Budget Review The Council discussed the utility budgets and provided direction to staff. (c) Approve Changer Order 1 and Pay Application 3 Pavilion Concession Building Plaza Dierking moved, Hersman seconded, to Approve Change Order 1 and Pay Application 3 Pavilion Concession Building Plaza. Motion carried 4/0. (d) Website Redesign Hersman moved, Dierking seconded, to direct staff to work on the website redesign. Motion carried 4/0. 10. ORDINANCES and RESOLUTIONS (a) None 11. UNFINISHED BUSINESS (a) Remote Meeting Update The Council provided staff with direction to bring this item back to a future Council meeting. 13.
