City of Excelsior Regular Council Meeting MINUTES Monday, November 7, 2022 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:30 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Tyler Absent: None Also Present: City Manager Luger, Public Works Superintendent Amundsen, City Engineer Dawley, Community Development Director Mullin, Finance Director Palmer, and City Attorney/Assistant City Manager Staunton 3. APPROVAL OF MINUTES (a) October 17, 2022 City Council Work Session Minutes (b) October 17, 2022 City Council Minutes Caron moved, Tyler seconded, to approve the October 17, 2022 City Council Work Session Minutes and October 17, 2022 City Council Minutes. Motion carried 4/0. Mayor Carlson abstained. 4. OPEN FORUM Bruce Kelly, 165 Maple Street, addressed the Council about parking. Kurt Wehrmann, 444 West Lake Street, addressed the Council about the siren and addition of an environmental page to the website. Bob Bolles, 229 George Street, welcomed the Mayor back. Grant Smith, 220 Bell Street, addressed the Council about the ERASE group and vacant properties. Mark Knapp, 678 Pleasant Street, addressed the Council about the ERASE group and vacant properties. Peter Hartwich, 186 George Street, addressed the Council about expenditures and grants. Jane Bauman, 31 Third Street, addressed the Council about the proposed 339 Third Street/West Lot redevelopment. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) 339 Third Street Update Item removed from agenda. (b) South Lake Minnetonka Police Department Update Item removed from agenda. (c) Planning Commission Update Item removed from agenda. (d) Concession/Plaza Project Update Tim Amundsen, Public Works Superintendent, gave an update on the Concession/Plaza Project. (e) Last Day of Yard Waste Collection for 2022 – Monday, November 21st The last day of yard waste collection is November 21, 2022. MEET EXCELSIOR (a) Excelsior Morning Rotary Thomas Nicol and Pam Langseth, Excelsior Morning Rotary, addressed the Council. 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Dierking seconded to approve the November 7, 2022 Meeting agenda with the change to continue Item 8(b), move Item 12(b) to 12(a), move Item 12(a) to 12(b), and addition of Item 13(b). Motion carried 5/0. (b) Consent Agenda Dierking moved, Hersman seconded, to approve the November 7, 2022 Consent Agenda. Motion carried 5/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Rotary Concert Series Agreement Action – Approved the Program Agreement with the Lake Minnetonka Excelsior Rotary Club for The Commons Concert Series. 3. Approve Certificate for Payment No. 4 Concession/Plaza Action – Approved Certificate for Payment No. 4 Concession/Plaza. 5. September Financials Action – Approved September Financials. 6. Small Business Saturday Proclamation Action – Approved the Small Business Saturday Proclamation. 7. 2022 Goal Report – Third Quarter Action – No Action. Information Only. 8. Resolution 2022-44 St. Alban’s Bay Improvement District 2023 Annual Levy and Assessments Action – Adopted Resolution 2022-44 Resolution Approving the St. Alban’s Bay Lake Improvement District 2023 Annual Levy and Assessments. 9. Acknowledge 10% Gambling Donations for Third Quarter 2022 Action – Acknowledged 10% Gambling Donations for Third Quarter 2022. 8. PUBLIC HEARINGS (a) Miyabi - Addition of Corporate Officer Public Hearing 400 Water Street Suite #100 Tyler moved, Caron seconded, to approve the additional corporate officer to the Miyabi liquor license. Motion carried 5/0. (b) Saphire Holdings LLC - On-Sale Liquor and Sunday Liquor Public Hearing 304 Water Street Action – Continued to the November 21, 2022 City Council Meeting. Minutes City Council Meeting Monday, November 7, 2022 Page 5 (c) 339 Third Street/West Lot PUD Preliminary Plan Application Bruce Kelly, 165 Maple Street, addressed the Council with concerns about the 339 Third Street/West Lot proposed redevelopment. Diane Bolles, 229 George Street, addressed the Council with concerns about the proposed 339 Third Street/West Lot proposed redevelopment. Peter Hartwich, 186 George Street, addressed the Council with concerns about the proposed 339 Third Street/West Lot redevelopment. Sheila McMillan, 1 Third Street, addressed the Council in favor of the proposed 339 Third Street/West Lot redevelopment. Bob Bolles, 229 George Street, addressed the Council with concerns about the proposed 339 Third Street/West Lot redevelopment. Dierking moved, Caron seconded, to continue this item to the November 21, 2022 City Council Meeting. Motion carried 5/0. Mayor Carlson left the meeting. (d) 339 Third Street TIF Public Hearing Bruce Kelly, 165 Maple Street, addressed the Council with concerns about the proposed TIF. Peter Hartwich, 186 George Street, addressed the Council with concerns about the proposed TIF. Dierking moved, Hersman seconded, to continue this item to the November 21, 2022 City Council Meeting. Motion carried 4/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) None Minutes City Council Meeting Monday, November 7, 2022 Page 6 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) 339 Third Street Parking (Amended) Mikaela Huot, Baker Tilly, addressed the Council. Dierking moved, Tyler seconded, to continue this item to the November 21, 2022 City Council Meeting. Motion carried 4/0. (b) West Drive Discussion Related to the 339 PUD Proposal (Amended) Acting Mayor Caron recused herself. Tyler moved, Hersman seconded, to continue this Item to the November 21, 2022 City Council Meeting. Motion caried 3/0. Acting Mayor Caron rejoined the meeting. 13. NEW BUSINESS (a) Lease for Excelsior Office Building Dierking moved, Hersman seconded, to continue this item to the November 21, 2022 City Council Meeting. Motion carried 4/0. (b) Canvassing Meeting Dierking moved, Tyler seconded, to schedule the Canvassing Meeting on Tuesday, November 16, 2022 at 9:00 A.M. Minutes City Council Meeting Monday, November 7, 2022 Page 7 14.
