City of Excelsior Regular Council Meeting MINUTES Monday, November 21, 2022 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:35 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Tyler Absent: None Also Present: City Manager Luger, City Engineer Dawley, Community Development Director Mullin, City Attorney/Assistant City Manager Staunton, and Administrative Services Director Williams 3. APPROVAL OF MINUTES (a) November 7, 2022 City Council Work Session Minutes (b) November 7, 2022 City Council Minutes (c) November 12, 2022 Strategy Session Minutes (d) November 15, 2022 City Council Canvassing Minutes Dierking moved, Tyler seconded, to approve the November 7, 2022 City Council Work Session Minutes, November 7, 2022 City Council Minutes, November 12, 2022 Strategy Session Minutes, and November 15, 2022 City Council Canvassing Minutes. Motion carried 5/0. 4. OPEN FORUM None Minutes City Council Meeting Monday, November 21, 2022 Page 2 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior-Lake Minnetonka Chamber of Commerce Update Mayor Carlson gave an update on upcoming events. (b) Concession/Plaza Project Update Morgan Dawley, City Engineer, gave an update on the Concession/Plaza Project Update. (c) Excelsior United Methodist Church Playground Update (Amended) Councilmember Caron gave an update on the Excelsior United Methodist Church Playground grant. (d) Mayor Updates (Amended) Mayor Carlson gave an update on the November 12, 2022 City Council Strategy Session. 6. MEET EXCELSIOR (a) None 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Caron seconded, to approve the November 21, 2022 Meeting Agenda. Motion carried 5/0. (b) Consent Agenda Caron moved, Hersman seconded, to approve the November 21, 2022 Consent Agenda. Motion carried 5/0. Minutes City Council Meeting Monday, November 21, 2022 Page 3 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Approve Pay Voucher No. 13 & Final 2020 Street & Utility Improvements Project Action – Approved Pay Voucher No. 13 & Final 2020 Street & Utility Improvements Project. 3. Closing of City Hall on December 6-8 for Clean-Up Days Action – Authorized staff to close City Hall on December 6-8 for Clean-Up Days. 4. Resolution 2022-48 Imposing Temporary Parking Restrictions on Chriskindlsmarkt Parade Action – Adopted Resolution 2022-48 Imposing Temporary Parking Restrictions on Chriskindlsmarkt Parade. 5. Tree Ordinance Workgroup Appointment Action – Appointed Mayor Carlson and Councilmember Tyler to the Tree Ordinance Workgroup. 6. Resolution 2022-50 Support of Water Street Pedestrian Enhancements Active Transportation Grant Action – Adopted Resolution 2022-50 Support of Water Street Pedestrian Enhancements Active Transportation Grant. Mower with Snow Removal Attachments Purchase Action – Approved the purchase of a John Deere 1585 TerrainCut with the applicable snow removal attachments from Minnesota Equipment Inc. for the cost of $58,316.03 to be funded from the Equipment/Minor Projects Capital Improvement Fund. 8. PUBLIC HEARINGS (a) Saphire Holdings LLC - On-Sale Liquor and Sunday Liquor Public Hearing 304 Water Street Hersman moved, Dierking seconded, to adopt Resolution 2022-49 Resolution Granting an On Sale and Sunday Liquor License to Saphire Holdings LLC, dba The Suburban. Motion carried 5/0. (b) 339 Third Street/West Lot PUD Preliminary Plan Application Bruce Kelly, 165 Maple Street, addressed the Council with concerns about the proposed 339 Third Street/West Lot PUD Preliminary Plan Application. Joan Maher, 905 Excelsior Boulevard, addressed the Council in favor of the proposed 339 Third Street/West Lot PUD Preliminary Plan Application. Peter Hartwich, 186 George Street, addressed the Council with concerns about the proposed 339 Third Street/West Lot PUD Preliminary Plan Application. Bill Damberg, 256 Water Street, addressed the Council in favor of the proposed 339 Third Street/West Lot PUD Preliminary Plan Application. Dierking moved, Tyler seconded, to adopt Resolution 2022-46 Resolution Approving the Preliminary Plan for a Planned Unit Development (PUD) for 339 Third Street as amended. Motion carried 5/0. Minutes City Council Meeting Monday, November 21, 2022 Page 5 (c) 339 Third Street TIF Public Hearing Caron moved, Dierking seconded, to adopt Resolution 2022-45 Resolution Approving the Enlargement of Municipal Development District No. 1. Motion carried 5/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) 339 Third Street Parking Caron moved, Dierking seconded, to direct staff to construct a 3-level parking structure with city-financed TIF option. Motion carried 5/0. Caron moved, Hersman seconded, to direct staff to request a proposal from Walker to create a maintenance plan for the parking structure to ensure the City is setting aside enough funding to cover significant capital improvements and to direct staff to draft a Request for Proposals to have a consultant complete a comprehensive review of how the City should allocate and charge for parking. Motion carried 5/0. (b) West Drive Discussion Related to the 339 PUD Proposal Councilmember Caron recused herself. The Council provided staff with direction. Councilmember Caron rejoined the meeting. (c) Lease for Excelsior Office Building Hersman moved, Dierking seconded, to Approve the Office Lease Agreement. Motion carried 5/0. 10. ORDINANCES and RESOLUTIONS Minutes City Council Meeting Monday, November 21, 2022 Page 6 (a) First Reading of Special Events Ordinance Dierking moved, Caron seconded, to Waive the First Readding and Schedule the Second Reading and Adoption with the changes as discussed for the December 5, 2022 City Council Meeting. Motion carried 5/0. 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) Mooring Policy The Council provided staff with direction. 13. NEW BUSINESS (a) City Council Meeting Dates The Council provided staff with direction to amend the following 2023 City Council meeting dates: • Monday, January 2nd moved to Monday, January 9th • Monday, January 16th moved to Tuesday, January 17th • Monday, February 20th moved to Tuesday, February 21st • Monday, July 3rd – Cancelled • Monday, September 4th moved to Tuesday, September 5th 14.
