1. CALL TO ORDER
Mayor Carlson called the meeting to order at 6:35 P.M.

Mayor Carlson gave an update on upcoming events.

Morgan Dawley, City Engineer, gave an update on the Concession/Plaza Project
Update.
(c) Excelsior United Methodist Church Playground Update (Amended)
Councilmember Caron gave an update on the Excelsior United Methodist Church
Playground grant.

7. Mower with Snow Removal Attachments Purchase
Action – Approved the purchase of a John Deere 1585 TerrainCut with the
applicable snow removal attachments from Minnesota Equipment Inc. for
the cost of $58,316.03 to be funded from the Equipment/Minor Projects
Capital Improvement Fund.
8. PUBLIC HEARINGS
(a) Saphire Holdings LLC - On-Sale Liquor and Sunday Liquor Public Hearing
304 Water Street
Hersman moved, Dierking seconded, to adopt Resolution 2022-49 Resolution
Granting an On Sale and Sunday Liquor License to Saphire Holdings LLC, dba The
Suburban. Motion carried 5/0.
(b) 339 Third Street/West Lot PUD Preliminary Plan Application
Bruce Kelly, 165 Maple Street, addressed the Council with concerns about the
proposed 339 Third Street/West Lot PUD Preliminary Plan Application.
Joan Maher, 905 Excelsior Boulevard, addressed the Council in favor of the
proposed 339 Third Street/West Lot PUD Preliminary Plan Application.
Peter Hartwich, 186 George Street, addressed the Council with concerns about the
proposed 339 Third Street/West Lot PUD Preliminary Plan Application.
Bill Damberg, 256 Water Street, addressed the Council in favor of the proposed 339
Third Street/West Lot PUD Preliminary Plan Application.
Dierking moved, Tyler seconded, to adopt Resolution 2022-46 Resolution Approving
the Preliminary Plan for a Planned Unit Development (PUD) for 339 Third Street as
amended. Motion carried 5/0.

(c) 339 Third Street TIF Public Hearing
Caron moved, Dierking seconded, to adopt Resolution 2022-45 Resolution
Approving the Enlargement of Municipal Development District No. 1. Motion carried
5/0.
9. PETITIONS, REQUESTS and COMMUNICATIONS
(a) 339 Third Street Parking
Caron moved, Dierking seconded, to direct staff to construct a 3-level parking
structure with city-financed TIF option. Motion carried 5/0.
Caron moved, Hersman seconded, to direct staff to request a proposal from Walker
to create a maintenance plan for the parking structure to ensure the City is setting
aside enough funding to cover significant capital improvements and to direct staff
to draft a Request for Proposals to have a consultant complete a comprehensive
review of how the City should allocate and charge for parking. Motion carried 5/0.
(b) West Drive Discussion Related to the 339 PUD Proposal
Councilmember Caron recused herself.
The Council provided staff with direction.
Councilmember Caron rejoined the meeting.
(c) Lease for Excelsior Office Building
Hersman moved, Dierking seconded, to Approve the Office Lease Agreement.
Motion carried 5/0.

(a) First Reading of Special Events Ordinance
Dierking moved, Caron seconded, to Waive the First Readding and Schedule the
Second Reading and Adoption with the changes as discussed for the December 5,
2022 City Council Meeting. Motion carried 5/0.

(a) None

(a) Mooring Policy
The Council provided staff with direction.
13. NEW BUSINESS
(a) City Council Meeting Dates
The Council provided staff with direction to amend the following 2023 City Council
meeting dates:
• Monday, January 2nd moved to Monday, January 9th
• Monday, January 16th moved to Tuesday, January 17th
• Monday, February 20th moved to Tuesday, February 21st
• Monday, July 3rd – Cancelled
• Monday, September 4th moved to Tuesday, September 5th
14. ADJOURNMENT
