City of Excelsior Regular Council Meeting MINUTES Tuesday, February 21, 2023 6:30 P.M. OATH – RICK DAHLSTROM Mayor Carlson administered the Oath of Office to Rick Dahlstrom. OATH – TIM GEPHART Mayor Carlson administered the Oath of Office to Tim Gephart. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:33 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Tyler Absent: None Also Present: City Manager Luger, City Engineer Dawley, Community Development Director Mullin, City Attorney/Assistant City Manager Staunton, and Administrative Services Director Williams 3. APPROVAL OF MINUTES (a) February 2, 2023 Special City Council Meeting Minutes Dierking moved, Caron seconded, to approve the February 2, 2023 Special City Council Meeting Minutes. Motion carried 4/0. Councilmember Hersman abstained. 4. OPEN FORUM Bob Bolles, 229 George Street, addressed the Council about the 339 Third Street project. Minutes City Council Meeting Tuesday, February 21, 2023 Page 2 Peter Hartwich, 186 George Street, addressed the Council about 106 Center Street and the South of Highway 7 park. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) New City Hall Location – 350 Highway 7, Suite 230 Administrative Services Director, Nalisha Williams, gave an update on the new City Hall location. (b) Cemetery Committee Update Mayor Carlson gave an update on the Cemetery Committee. (c) Legislative Update (Amended) Councilmember Caron gave an update on the objectives for the current legislative session. 6. MEET EXCELSIOR (a) Northern Drift Lisa Jane, Northern Drift, addressed the Council. 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Dierking seconded, to approve the February 21, 2023 Meeting Agenda with the change to move Item 10(a) to Item 13(c). Motion carried 5/0. (b) Consent Agenda Dierking moved, Tyler seconded, to approve the February 21, 2023 Consent Agenda Items 1,2,3,4,5,7,8, and 9 and to pull Item 7(b)6 for a separate vote. Motion carried 5/0. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Approve 2023 Business License Renewals Action – Approved 2023 Business License Renewals. 3. Ordinance No. 649 Waive Second Reading and Adopt Liquor Ordinance Amendment Action – Waived the second reading and adopted Ordinance No. 649 Adopting Liquor Ordinance Amendment. 4. Agreement with City of Greenwood 2023 Action – Approved Agreement with City of Greenwood 2023. 5. Resolution 2023-13 Rotary Club of Excelsior Off-Site Gambling License Permit Action – Adopted Resolution 2023-13 Rotary Club of Excelsior Off-Site Gambling License. 6. Ordinance No. 645 Waive Second Reading and Adopt 339 Third Street PUD Councilmember Caron recused herself. Tyler moved, Hersman seconded, to waive the second reading and adopt Ordinance No. 645 Approving 339 Third Street PUD. Motion carried 3/1. Mayor Carlson voted no. Continue Z&H 301 Water Street LLC – On Sale & Sunday Liquor License Public Hearing Action – Continued Z&H 301 Water Street LLC – On Sale & Sunday Liquor License Public Hearing to the March 6, 2023 City Council meeting. 8. Continue Second Reading of Ordinance No. 647 Food Truck Regulations Action – Continued Second Reading of Ordinance No. 647 Food Truck Regulations. 9. Grove Street Parking Request Action – Tabled the Grove Street parking request until the parking study has been completed. 8. PUBLIC HEARINGS (a) 690 Excelsior Blvd, Excelsior Flats, PUD Final Plan and Zoning Amendment Ordinance Bob Sarna, Kraemer Family Real Estate Holdings, Applicant, addressed the Council. Jen MacFarlan, 801 Pleasant Street, addressed the Council with concerns about the proposed project. Joan Maher, 905 Excelsior Boulevard, addressed the Council with concerns about the proposed project. Peter Hartwich, 186 George Street, addressed the Council about Excelsior’s identity. Craig Rossebo, 662 Pleasant Street, addressed the Council with concerns about the proposed project. Bob Bolles, 229 George Street, addressed the Council with concerns about the proposed project. Minutes City Council Meeting Tuesday, February 21, 2023 Page 5 Bruce Noll, 242 First Street, addressed the Council with concerns about the proposed project. Caron moved, Dierking seconded, to adopt Resolution 2023-12 Resolution Approving the Final Plan for a Planned Unit Development (PUD) for Excelsior Flats, located at 690 Excelsior Boulevard with the conditions as outlined in the resolution. Motion carried 3/2. Councilmember Hersman and Tyler voted no. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) Commercial Pier Lease with MN Electric Boat Company and Uff Da Adventures Dierking moved, Hersman seconded, to approve the Commercial Pier Lease with MN Electric Boat Company LLC and authorize the Mayor and City Manager to sign the lease with the changes as discussed. Motion carried 5/0. 10. ORDINANCES and RESOLUTIONS (a) West Drive Condemnation (Amended) Moved to Item 13(c). 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) Annual Advisory Appointments Tyler moved, Caron seconded, to reappoint Nathan Schmidt and Leigh Smith to the Parks and Recreation Commission. Motion carried 5/0. Hersman moved, Dierking seconded, to appoint Tim Bildsoe and Bill Muenzberg to the Planning Commission. Motion carried 5/0. 12. UNFINISHED BUSINESS Minutes City Council Meeting Tuesday, February 21, 2023 Page 6 (a) Change Order #2 The Commons Concessions Hersman moved, Tyler seconded, to approve Change Order No. 2 for the Excelsior Commons Concessions Project in the amount of $93,828.14 as recommended by the project architect VJAA, Inc. Motion carried 4/1. Mayor Carlson voted no. 13. NEW BUSINESS (a) City Council Chambers Options and Furniture The Council provided staff with direction to move forward with the temporary meeting space (Public Safety building) for the remainder of February meetings, explore all options for future City Council Chamber use, and the storage of the Council Chamber furniture. (b) 2023 City of Excelsior Objectives Dierking moved, Caron seconded, to continue this item to a future City Council meeting. Motion carried 5/0. (c) West Drive Condemnation (Amended) Councilmember Caron left the meeting. Hersman moved, Tyler seconded, to adopt Resolution 2023-14 Resolution Authorizing Voluntary Acquisition of Certain Real Property Interests and Setting Public Hearing on Eminent Domain.
