City of Excelsior Regular Council Meeting MINUTES Monday, April 3, 2023 6:30 P.M. CERTIFICATE OF APPRECIATION – DALE KURSCHNER Mayor Carlson presented a Certificate of Appreciation to Dale Kurschner. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:30 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, and Hersman Absent: Councilmember Tyler Also Present: City Manager Luger, Assistant City Manager Staunton, and Administrative Services Director Williams 3. APPROVAL OF MINUTES (a) March 20, 2023 City Council Closed Session Minutes (b) March 20, 2023 City Council Work Session Minutes (c) March 20, 2023 City Council Minutes (d) March 27, 2023 City Council Special Work Session Minutes Dierking moved, Hersman seconded, to approve the March 20, 2023 City Council Closed Session Minutes, March 20, 2023 City Council Work Session Minutes, March 20, 2023 City Council Minutes, and March 27, 2023 City Council Special Work Session Minutes. Motion carried 4/0. Minutes City Council Meeting Monday, April 3, 2023 Page 2 4. OPEN FORUM Bob Bolles, 229 George Street, addressed the Council about the volume level of meetings. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) 339 Third Street Construction Update Mark Madero, Ironmark, gave an update on the 339 Third Street Construction. John Bradford, WSB, gave an update on the 339 Third Street project funds. (b) Yard Waste Collection Begins Monday, April 3rd Nalisha Williams, Administrative Services Director, gave an update on yard waste collection. (c) Legislative Priorities Councilmember Caron gave an update on Legislative Priorities. 6. MEET EXCELSIOR (a) None 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Caron seconded, to approve the April 3, 2023 Meeting Agenda with the continuation of Item 8(a) to the April 17, 2023 City Council Meeting. Motion carried 4/0. (b) Consent Agenda Caron moved, Hersman seconded, to approve the April 3, 2023 Consent Agenda. Motion carried 4/0. Minutes City Council Meeting Monday, April 3, 2023 Page 3 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. March Building Permit Report Action – Approved March Building Permit Report. 3. Resolution 2023-23 Updated 2023 Fee Schedule Action – Adopted Resolution 2023-23 Updated 2023 Fee Schedule. 4. Resolution 2023-24 Imposing Temporary Parking Restrictions Memorial Day Action – Adopted Resolution 2023-24 Imposing Temporary Parking Restrictions Memorial Day. 5. Resolution 2023-25 Imposing Temporary Parking Restrictions 4th of July Action – Adopted Resolution 2023-25 Imposing Temporary Parking Restrictions 4th of July. 6. Resolution 2023-26 Imposing Temporary Parking Restrictions Art on the Lake Action – Adopted Resolution 2023-26 Imposing Temporary Parking Restrictions Art on the Lake. 7. Waive First Reading and Schedule Second Reading and Adoption of Ordinance No. 651 Amendment of Chapter 26, Section 26-7 Action – Waived First Reading and Scheduled Second Reading and Adoption of Ordinance No. 651 Amendment of Chapter 26, Section 26-7. 8. PUBLIC HEARINGS (a) 44 Center Street - Application for Variance from Building Coverage Standard Action – Item continued to the April 17, 2023 City Council Meeting. (b) 300 Water Street Interim Use Permit Bruce Kelly, 165 Maple Street, addressed the Council with concerns about the wrapped fencing. Action – Dierking moved, Caron seconded, to adopt Resolution 2023-22 Approving the Interim Use Permit at 300 Water Street with the conditions as discussed. Motion carried 4/0. (c) West Drive Condemnation Councilmember Caron recused herself. Bob Bolles, 229 George Street, addressed the Council with concerns about the acquisition of the two parcels. Dierking moved, Hersman seconded, to waive the first reading and schedule the second reading and adoption of Ordinance No. 652 at the April 17, 2023 City Council Meeting. Motion carried 3/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) None Minutes City Council Meeting Monday, April 3, 2023 Page 5 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) Accept Resignation & Declare Vacancy on City Commission Councilmember Caron rejoined the meeting. Dierking moved, Caron seconded, to accept Dan Wallace’s resignation, declare a vacancy on the Planning Commission, direct staff to advertise for Citizen Inquiry Forms, and appoint Councilmember Hersman and Mayor Carlson to conduct interviews of the applicants. Motion carried 4/0. 12. UNFINISHED BUSINESS (a) None 13. NEW BUSINESS (a) Emergency Ordinance No. 650 Hersman moved, Dierking seconded, to waive the first reading and adopt Ordinance No. 650 An Emergency Ordinance Amending Article 42 of the Zoning Code and adopt Summary Resolution 2023-27. Motion carried 4/0. (b) Approach to Matching Requirements The Council provided staff with direction. 14. ADJOURNMENT Dierking moved, Caron seconded, to adjourn the meeting at 7:50 P.M.
