CALL TO ORDER Mayor Carlson called the meeting to order at 6:44 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Tyler Absent: None Also Present: City Manager Luger, Assistant City Manager/City Attorney Staunton, Community Development Director Mullin, Public Works Superintendent Amundsen, and Administrative Services Director Williams 3. APPROVAL OF MINUTES (a) September 5, 2023 Work Session Minutes (b) September 5, 2023 City Council Minutes (c) September 11, 2023 Special Work Session Minutes Dierking moved, Tyler seconded, to approve the September 5, 2023 Work Session Minutes, September 5, 2023 City Council Minutes, and the September 11, 2023 Special Work Session Minutes. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Parks and Recreation Commission Update Public Works Superintendent Amundsen gave an update on the Parks and Recreation Commission. (b) Tree Planting Event Public Works Superintendent Amundsen gave an update on the Tree Planting Event scheduled at the Commons for October 7, 2023 from 10:00 A.M. – 1:00 P.M. (c) Oak Savanna Public Works Superintendent Amundsen and Parks Manager Ward gave an update on the Oak Savanna project. (d) Fall Clean Up Administrative Services Director Williams gave an update on Fall Clean-Up scheduled for Saturday, October 28, 2023. (e) Ballfield Scheduling Mayor Carlson gave an update on Ballfield Scheduling. (f) Ballfield Project Advisory Committee (Amended) Councilmember Hersman gave an update on the Ballfield Improvement PAC Meeting. MEET EXCELSIOR (a) Representative Andrew Myers Representative Myers gave an update on the past legislative session. 7. AGENDA APPROVAL (a) Meeting Agenda Dierking moved, Hersman seconded, approve the September 18, 2023 Meeting Agenda with the continuation of item 9(a) at a date to be determined and a continuation of item 9(b) to the October 16, 2023 City Council Meeting. Motion carried 5/0. (b) Consent Agenda Hersman moved, Dierking seconded, to approve September 18, 2023 Consent Agenda. Motion carried 5/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Second Reading and Adoption of Ordinance No. 656 Designation of City Owned Resources. Action – Waived second reading and adopted Ordinance No. 656 Designation of City Owned Resources. 3. Resolution 2023-67 Imposing Temporary Parking Restrictions Minnetonka Homecoming Parade. Approve Pay Voucher No 1 – 2023 Crack Sealing Project Action – Approved Pay Voucher 1 for 2023 Crack Sealing Project. 5. Waive Second Reading and Adopt Ordinance 657 and Summary Resolution 2023-65. Action – Waived Second Reading and Adopted Ordinance 657 and Summary Resolution 2023-65 6. August Building Permits Report Action – Approved August Building Permit Report. 7. Appoint Councilmember Tyler to Short-Term Rental Ordinance Workgroup Action – Appointed Councilmember Tyler to Short-Term Rental Ordinance Workgroup. 8. Approve Change Order No. 1 Excelsior Boulevard Lift Station Action – Approved Change Order No. 1 for Excelsior Boulevard Lift Station. 9. Resolution 2023-68 Accept Donation from the Excelsior Lion’s Club Action – Accepted Donation from the Excelsior Lion’s Club. 8. PUBLIC HEARINGS (a) None 9. UNFINISHED BUSINESS (a) Continue Review of Residential Review Ordinance Recommendations Action – Council provided staff with direction to make amendments to the sections as discussed. 13. NEW BUSINESS (a) Ordinance No. 658 West Lake Street Weight Restrictions Caron moved, Tyler seconded, to waive the first reading of Ordinance No. 658 and schedule a second reading. Motion carried 5/0. (b) October 2, 2023 City Council Meeting Tyler moved, Caron seconded to continue with the October 2, 2023 City Council Meeting and appoint Councilmember Dierking as Acting Mayor. Motion carried 5/0. (c) Schedule Special Work Session Caron moved, Dierking seconded to schedule a Special Work Session on Monday, October 9, 2023.
