Regular Council Meeting MINUTES Monday, October 16, 2023 Trinity Episcopal Church - 322 Second Street, Excelsior, MN 55331 6:30 P.M. 1. CALL TO ORDER Acting Mayor Caron called the meeting to order at 6:30 P.M. 2. ROLL CALL City Council: Acting Mayor Caron and Councilmembers Dierking, Hersman and Tyler Absent: Mayor Carlson Also Present: City Manager Luger, City Attorney/Assistant City Manager Staunton, Community Development Director Mullin, Public Works Superintendent Amundsen and Administrative Services Director Williams and Park Manager Ward. 3. APPROVAL OF MINUTES (a) October 3, 2023 Work Session Minutes Hersman moved, Dierking seconded, to approve the October 3, 2023 Work Session Minutes. Motion carried 4/0. (b) October 2, 2023 City Council Minutes Dierking moved, Tyler seconded, to approve the October 3, 2023 City Council Minutes. Motion carried 4/0. 4. OPEN FORUM None Minutes City Council Meeting Monday, October 16, 2023 Page 2 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Fall Clean-Up – October 28, 2023 Administrative Services Director, Williams, gave an update on the Fall Clean-Up scheduled for October 28. (b) Heritage Preservation Commission Update City Attorney/Assistant City Manager, Staunton, gave an update on the Heritage Preservation Commission. (c) Parking Survey Open House – October 17, 2023 Community Development Director, Mullin, gave an update on the parking survey, the Open House for residents scheduled for October 17 and listening session for businesses on October 26. (d) Ballfield PAC Update Councilmember Hersman gave an update on the Ballfield PAC. (e) Cemetery Committee Update Administrative Services Director, Williams, gave an update on the cemetery committee. (f) South Lake Minnetonka Police Department Update City Manager, Luger, gave an update on the South Lake Minnetonka Police Department. (g) Oak Savanna Project Update Park Manager, Ward, gave an update on the Oak Savanna Project. Minutes City Council Meeting Monday, October 16, 2023 Page 3 (h) Volunteer Tree Planting Update Park Manager, Ward, gave an update on the Volunteer Tree Planting. 6. MEET EXCELSIOR (a) None 7. AGENDA APPROVAL (a) Meeting Agenda Dierking moved, Hersman seconded, to approve the October 16, 2023 Meeting Agenda. Motion carried 4/0. (b) Consent Agenda Dierking moved, Hersman seconded, to approve the Consent Agenda with the updated addendum to item 7(b)2. Motion carried 4/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Master Subscriber Agreement – Minnesota Court Data Services Action – Adopted Resolution No. 2023-72 3. Continue Second Reading and Adoption of Ordinance No. 658 Road Restrictions. Action – Continued Second Reading and Adoption of Ordinance No. 658 Amending Chapter 31, Article 1 of the Excelsior Code to the November 6, 2023, Council Meeting. Minutes City Council Meeting Monday, October 16, 2023 Page 4 4. Resolution 2023-71 Temporary Road Restrictions Excelsior Halloween Parade. Action – Adopted Resolution 2023-71 Temporary Road Restrictions for October 31st Halloween Parade. 5. Highway 7 Lift Station Pumps. Action – Approved purchase of lift station pumps for the Highway 7 Lift Station. 8. PUBLIC HEARINGS (a) None 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) Ice Rinks at the Commons Ballfield Dierking moved, Tyler seconded, to approve the Park & Recreation Commission’s decision to discontinue the ice rinks at the Commons Ballfield for the 2023-24 season. Motion carried 4/0. (b) Salt Storage Shed Dierking moved, Tyler seconded, to approve the purchase and installation of the salt storage shed by the Public Works staff for the not-to-exceed amount of $13,000 to be funded out of the capital improvement fund. Motion carried 4/0. (c) 2024 Polling Location Tyler moved, Hersman seconded, to designate Mount Calvary Church as the polling location for 2024 elections. Motion carried 4/0. (d) Temporary Parking at 10 Water Street Matt Mithun, Owner, 26-30 Water Street addressed the Council. Minutes City Council Meeting Monday, October 16, 2023 Page 5 Action - The Council was not interested in permitting parking at 10 Water Street. (e) So-Hi Playground Request Sarah Nelson, 712 Third Avenue, addressed the Council. Bill Lester, 28265 Boulder Circle, addressed the Council. Action - The Council will continue discussion at the November 6, 2023 Council Meeting. 10. ORDINANCES and RESOLUTIONS (a) Short Term Rental Ordinance – First Reading Action – The Council directed provided staff with direction and scheduled Second Reading and Approval for the November 6, 2023 Meeting. 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) None 13. NEW BUSINESS (a) Schedule a Special Work Session Dierking moved, Tyler seconded, to schedule a Special Work Session for November 13, 2023. Motion carried 4/0.
