Regular Council Meeting MINUTES Monday, November 6, 2023 Trinity Episcopal Church - 322 Second Street, Excelsior, MN 55331 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:38 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Hersman and Tyler Absent: Councilmember Dierking Also Present: City Manager Luger, City Attorney/Assistant City Manager Staunton, Community Development Director Mullin, and Administrative Services Director Williams 3. APPROVAL OF MINUTES (a) October 9, 2023 Special Work Session Minutes Hersman moved, Tyler seconded, to approve the October 16, 2023 Special Work Session Minutes. Motion carried 4/0. (b) October 16, 2023 Work Session Minutes Caron moved, Tyler seconded, to approve the October 16, 2023 Work Session Minutes. Mayor Carlson abstained from the vote. Motion carried 3/0. (c) October 16, City Council Minutes Caron moved, Tyler seconded, to approve the October 16, 2023 City Council Minutes. Mayor Carlson abstained from the vote. Motion carried 3/0. Minutes City Council Meeting Monday, November 6, 2023 Page 2 4. OPEN FORUM Bruce Kelly, 165 Maple Street addressed the council regarding the 339 Third Street project. Sheila Holleran, 321 3rd Street, addressed the council about noise concerns at Montego Blu. Junius Gunaratne, 859 Excelsior Boulevard, addressed the council regarding short-term rentals. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) 339 Third Street Construction Update Mark Madero, Project Manager, gave an update on the 339 Third Street project. John Bradford, WSB, gave an update on the 339 Third Street project. (b) Planning Commission Update Community Development Director Mullin gave an update on the Planning Commission. (c) Parking Survey Open House Update Community Development Director, Mullin, gave an update on the Parking Survey Open House held for residents on October 17 and listening session for Excelsior businesses held on October 26. (d) 106 Center Street City Manager Luger gave an update on 106 Center Street. Administrative Services Director Williams gave an update on 106 Center Street. (e) Last Day for Yard Waste Pick-Up – November 20th Minutes City Council Meeting Monday, November 6, 2023 Page 3 Administrative Services Director, Williams, stated that the last day for yard waste pick-up is on November 20. 6. MEET EXCELSIOR (a) None 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Tyler seconded, to approve the November 6, 2023 Meeting Agenda. Motion carried 4/0. (b) Consent Agenda Caron moved, Tyler seconded, to approve Consent Agenda Items 7(b) 1, 2,4,5,6,7,8, 9 and 10. Motion carried 4/0. Tyler moved, Hersman seconded, to approve Consent Agenda Item 7(b)3. Motion carried 4/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Resolution 2023-75 Designating Mount Calvary as 2024 Polling Location Action – Adopted Resolution No. 2023-75 Designating Mount Calvary as the 2024 Polling Location. 3. Waive the First Readings and Schedule Second Readings and Adoptions of Ordinance No. 661 and 662. Minutes City Council Meeting Monday, November 6, 2023 Page 4 Action – Waived the first reading and scheduled the second reading and adoption of Ordinance No. 661 and 662 for the November 20th City Council Meeting. 4. Second Reading Ordinance No. 658 Prohibiting Truck Traffic on Residential Streets Action – Waived second reading and adopted Ordinance No. 658 Prohibiting Truck Traffic on Residential Streets. 5. September Financials Action – Accepted September Financial Report. 6. Third Quarter Gambling Report Action – Acknowledged Third Quarter charitable gambling donations. 7. THC License Approval Action – Approved the issuance of THC Licenses. 8. October Building Report Action – Accepted October Building Permits Report. 9. Concept Design Project Proposal for Public Works and City Hall Action – Approved the proposal from HCM Architects at a cost not-to- exceed $22,900. 10. 2023 Goal Report – Fourth Quarter No action required – information only. 8. PUBLIC HEARINGS Minutes City Council Meeting Monday, November 6, 2023 Page 5 (a) 500 Third Street Variance Request Community Development Director Mullin gave a staff report. Caron moved, Tyler seconded to adopt Resolution 2023-74 Approving the Variance for the Rear Yard Setback for the Construction of a Garage at 500 Third Street. Motion carried 4/0. (b) 352 Morse Avenue Conditional Use Permit Request Community Development Director Mullin gave a staff report. Caron moved, Tyler seconded to adopt Resolution 2023-73 Approving the Conditional Use permit for Construction of a Fence at 352 Morse Avenue with changes that were discussed. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) So-Hi Playground Request Caron moved, Tyler seconded, to approve the So-Hi Playground request to contribute $25,000 to be funded by the Park Capitol Fund with conditions. Motion carried 4/0. (b) Flock Camera System Chief Tholen, SLMPD, addressed the council. Detective Protivinsky, SLMPD, gave a presentation on the Flock Camera System. Hersman moved, Tyler seconded to approve the installation of Flock camera in Excelsior and authorize the expenditure of $800 from the City’s Public Safety Aid allocation. Motion carried 4/0. (c) Demolition Ordinance Minutes City Council Meeting Monday, November 6, 2023 Page 6 The council provided feedback and direction to staff for drafting a Demolition Ordinance. 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) None 13. NEW BUSINESS (a) None 14.
