Regular Council Meeting MINUTES Monday, December 4, 2023 Trinity Episcopal Church - 322 Second Street, Excelsior, MN 55331 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:30 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Hersman and Tyler Absent: Councilmember Dierking Also Present: City Manager Luger, City Attorney/Assistant City Manager Staunton, Finance Director Palmer, Community Development Director Mullin, Administrative Services Director Williams, and City Engineer Dawley. 3. APPROVAL OF MINUTES (a) November 20, 2023 Special Work Session Minutes Hersman moved, Tyler seconded, to approve the November 20, 2023 Special Work Session Minutes. Motion carried 4/0. OPEN FORUM Bruce Kelly, 165 Maple Street, addressed the Council about assessment values. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Planning Commission Update Julia Mullin, Community Development Director, gave an update on the Planning Commission. (b) 339 Third Street Construction Update Mark Madero, Project Manager, gave an update on the 339 Third Street Construction. John Bradford, WSB, gave an update on the 339 Third Street Construction. (c) Council Updates Councilmember Caron gave an update on the Tree Lighting event on December 2. Mayor Carlson gave an update on the State of the Cities held on November 21. Mayor Carlson gave an update on the annual Christkindlesmarkt event held November 24-26. 6. MEET EXCELSIOR (a) None Minutes City Council Meeting Monday, December 4, 2023 Page 3 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Tyler seconded, to approve the December 4, 2023 Meeting Agenda. Motion carried 4/0. (b) Consent Agenda Tyler moved, Caron seconded, to approve Consent Agenda Items 7(b) 1, 3, 4, 5, 6, 7 and Item 7(b) 2 with the changes as discussed. Motion carried 4/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. 2024 Greenwood Contract Action – Approved Agreement with Greenwood and authorize the Mayor and City Manager to execute the agreement with changes as discussed. 3. Sanitary Sewer and Stomwater Resiliency Study Action – Approved Sanitary Sewer and Stormwater Resiliency Study proposal. 4. Arbor Day Proclamation Action – Approved the proclamation recognizing October 7, 2023 as Arbor Day in Excelsior. 5. Authorize Application for MCES 2023 Private Property I&I Grant Resolution 2023-79. Lobbyist Contract Action – Approved the agreement and authorized the City Manager to sign the agreement on behalf of the City. 7. October Financials Action – Approved October Financials. 8. PUBLIC HEARINGS (a) 2023 Levy Payable 2024 and 2024 Budget Presentation Jenny Palmer, Finance Director, gave a presentation on the 2024 Levy Payable and Budget. No action taken. (b) Short Term Rental Ordinance Julia Mullin, Community Development Director, gave a staff report on the Short Term Rental Ordinance. Kelly Olson, 371 Water Street, addressed the Council. Junius Gunaratne, 859 Excelsior Boulevard, addressed the Council. Joan Maher, 905 Excelsior Boulevard, addressed the Council. Hassan Alvi, 401 Highway 7, addressed the Council. Bruce Kelly, 165 Maple Street, addressed the Council. Andrew Punch, 561 Third Street, addressed the Council. Ben Stedman, 10 George Street, addressed the Council. Hersman moved, Tyler seconded, to continue the Public Hearing for additional discussion at the January 8, 2024 City Council Work Session.
