Regular Council Meeting MINUTES Monday, March 18, 2024 Trinity Episcopal Church - 322 Second Street, Excelsior, MN 55331 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:45 P.M. 2. ROLL CALL City Council: Mayor Carlson, Councilmembers Caron, Dierking, Hersman and Tyler Also Present: City Manager, Luger, City Attorney/Assistant City Manager Staunton, Public Works Director Amundsen, Community Development Director, Mullin, and Administrative Services Director Wiliams 3. APPROVAL OF MINUTES (a) None 4. OPEN FORUM Bruce Kelly, 165 Maple Street, addressed the Council and was not in favor of the proposed changes to Siren Park. Judy Swanson, 454 Lake Street, addressed the Council with concerns about the pest management plan and the possible use of pesticides at The Commons. Mary Malsam, 120 Lake Street, addressed the Council with concerns about the use of pesticides at The Commons. Colleen Lockovitch, 145 Brentwood, addressed the Council in favor of keeping the Commons area Pesticide free. Minutes City Council Meeting Monday, March 18, 2024 Page 2 Shelly McGinnis, 655 Glencoe Street, addressed the Council about landscape and pest management at The Commons, concerns about food trucks causing damage to The Commons and Short Term Rentals. Denise Devictoria, 540 Division Street, addressed the Council about Pest Management at The Commons. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Hennepin County Planning Grant – South Water Street Small Area Plan Julia Mullin, Community Development Director, gave a staff report on the South Water Street Small Area Plan and the Hennepin County Planning Grant. Andrew Dresner, Consultant, Bolton & Menck addressed the Council. (b) Planning Commission Update Julia Mullin, Community Development Director, gave an update on the Planning Commission. (c) Met Council Update Tim Amundsen, Public Works Director, gave an update on the Met Council. (d) Spring Cleanup Day Spring Cleanup Day is scheduled for Saturday, May 18. (e) Lake Minnetonka Ice Out Ice out was declared on March 13. Staff advised against putting in boats in the water with the pending weather. 6. MEET EXCELSIOR (a) None Minutes City Council Meeting Monday, March 18, 2024 Page 3 7. AGENDA APPROVAL (a) Meeting Agenda Caron moved, Tyler seconded, to approve the March 18, 2024 Meeting Agenda with the additions of item 12(b), 12(c) and 13(b). Motion carried 5/0. (b) Consent Agenda Dierking moved, Tyler seconded, to approve items 7(b) 1, 3, 4, 5, 7 on the March 18, 2024 Consent Agenda. Motion carried 5/0. Dierking move, Caron seconded, to approve items 7(b)2 on the March 18, 2024 Consent Agenda. Motion carried 5/0. Dierking moved, Tyler seconded, to bring item 7(b)6 back to a future Council meeting. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Ballfield Design Contract Action – Council authorized the PAC to expend $61,800 on professional assistance for the design of the ballfield and authorized the Mayor and City Manager to sign any final contracts contingent on City Attorney review. 3. Approve Off-Sale THC Beverage Licenses Action – approved Off-Sale THC Beverage Licenses. 4. Approve Tree Trimmer Licenses Action – Approved Tree Trimmer Licenses. Minutes City Council Meeting Monday, March 18, 2024 Page 4 5. January Financials Action – Council accepted the January Financials report for filing. 6. Excursion Boat Fees for 2024 Action – Pulled from consent for discussion. Dierking moved, Tyler seconded to continue the item on consent at the April 1, 2024 City Council Meeting. Motion carried 5/0. 7. Resolution 2024-15 Opposing Zoning Preemption Legislation Action – Adopted Resolution 2024-15 Opposing Zoning Preemption Legislation. 8. PUBLIC HEARINGS (a) 163 Second Street Residential Review Permit and Variance Application Julia Mullin, Community Development Director, gave a staff report. Adam Price, Price Custom Homes, addressed the Council. Mike Rude, 176 Linwood Avenue, addressed the Council. The applicant withdrew the application. Herman moved, Tyler seconded to approve the withdrawal of the application and direct staff to work with applicant. Motion carried 5/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) 339 Third Street/One West Drive John Bradford, WSB, addressed the Council. Minutes City Council Meeting Monday, March 18, 2024 Page 5 Mark Madero, Project Manager, addressed the Council. Carl Runck, Red Leaf Partners, addressed the Council. Dan Johnson, Red Leaf Partners, addressed the Council. Caron moved, Tyler seconded, to approve to fund the cost overruns by utilizing the full contingency budget and borrowing $333,105 from the sewer fund which would be repaid by dedicating at least $30,000 annually in parking meter revenue. Motion carried 5/0. Hersman moved, Dierking seconded, to approve value engineering as recommended by staff. Motion carried 4/1. Dierking moved; Caron seconded, to approve the revised plan for Siren Park. Motion carried 4/1. (b) Excelsior Flats PUD Extension Request Dierking moved to extension for six months. Motion failed. Caron moved, Tyler seconded, to grant extension to the August 5, 2024 City Council Meeting. Motion carried 4/1. 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) Work Sessions Minutes City Council Meeting Monday, March 18, 2024 Page 6 Dierking moved, Tyler seconded, to schedule Special City Council Work Sessions on Tuesday, March 26 and Monday, May 13, 2024. Motion carried 5/0. (b) Commission Appointments Caron moved, Hersman seconded to appoint Heather Johnson the Planning Commission. (c) Short Term Rental Ordinance Dierking moved, Hersman seconded, to continue item 12(c) to a future Work Session as determined by staff. Motion carried 3/2. 13. NEW BUSINESS (a) Council Chambers Discussion 14. ADJOURNMENT Dierking moved, Tyler seconded to adjourn the meeting at 9:37 P.M. Motion carried 5/0.
