Regular Council Meeting MINUTES Monday, April 1, 2024 Trinity Episcopal Church - 322 Second Street, Excelsior, MN 55331 6:30 P.M. 1. CALL TO ORDER Acting Mayor Caron called the meeting to order at 6:36 P.M. 2. ROLL CALL City Council: Acting Mayor Caron, Councilmembers Dierking, Hersman and Tyler Absent: Mayor Carlson Also Present: City Manager Luger and Community Development Director Mullin 3. APPROVAL OF MINUTES (a) March 4, 2024 City Council Work Session Minutes (b) March 4, 2024 City Council Meeting Minutes (c) March 18, 2024 City Council Work Session Minutes (d) March 18, 2024 City Council Meeting Minutes (e) March 26, 2024 City Council Special Work Session Minutes Hersman moved, Tyler seconded to approve the March 4, 2024 Work Session Minutes, March 4, 2024 City Council Meeting Minutes, March 18, 2024 Work Session Minutes, March 18 City Council Meeting Minutes and the March 26, 2024 City Council Special Work Session Minutes. Motion carried 4/0. 4. OPEN FORUM Minutes City Council Meeting Monday, April 1, 2024 Page 2 Junius Gunaratne, 859 Excelsior Boulevard, addressed the Council and requested that the City Council grandfather in properties on the Short-Term Rental Ordinance and provided feedback. Bob Bolles, 229 George Street, addressed the Council complimenting the acoustics of the City Council Chambers and provided comments on City Hall. Bruce Kelly, 165 Maple Street, addressed the Council with concerns about the cost of the parking structure and the lack of parking near The Commons. Peter Hartwich, 186 George Street, addressed the Council with comments on the City Council Chambers, zoning setbacks, The Excelsior Flats project, Christkindlsmarkt, and the city’s website. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) 339 Third Street Construction Update Mark Madero, Ironmark Project Manager, gave an update on the construction at 339 Third Street. John Bradford, WSB, gave a financial update on the project at 339 Third Street. (b) Met Council Project Update John Bradford, WSB, gave an update on the Met Council Project. (c) Excelsior Fire District Update Councilmember Dierking gave an update on the Excelsior Fire District. (d) Urban Farming City Manager Luger introduced a request and asked the Council if they had interest in Urban Farming. (e) Tree City USA Minutes City Council Meeting Monday, April 1, 2024 Page 3 City Manager Luger, announced that the City of Excelsior was awarded Tree City USA designation by the Arbor Day Foundation. (f) Spring Cleanup Day Acting Mayor Caron announced that Spring Clean-up day is May 18, 2024 and yard waste pick-up has started. 6. MEET EXCELSIOR (a) None 7. AGENDA APPROVAL (a) Meeting Agenda Dierking moved, Tyler seconded, to approve the April 1, 2024 Meeting Agenda. Motion carried 4/0. (b) Consent Agenda Tyler moved, Dierking seconded, to approve 7(b) 1, 2, 4, 5 and 6 on the April 1, 2024 Consent Agenda. Motion carried 4/0. Dierking moved, Tyler seconded, to approve items consent item 7(b)3 with language adjusted to reflect the full scope of the project and the City’s $5,000 share of the cost. Motion carried 4/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Resolution 2024-16 Rotary Club of Excelsior Off-Site Gambling License Permit. Minutes City Council Meeting Monday, April 1, 2024 Page 4 Action – Adopted Resolution 2024-16 Approving Issuance of Off-Site Permit by State of Minnesota Gambling Authority. 3. Bolton and Menk Letter of Agreement and contract for South Water Street Small Area Plan Action – Approved agreement with language adjusted to reflect the full scope of the project and the City’s $5,000 share of the cost. 4. February Financials Action –Accepted February Financials for filing. 5. 2024 Insurance Monetary Limits on Municipal Tort Limit Action – Elected to not waive the monetary limits on municipal tort liability. 6. 2024 Goal Report – First Quarter No action required. Information only. 8. PUBLIC HEARINGS (a) None 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) None 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) Accept Resignation and Declare Vacancy on Planning Commission Minutes City Council Meeting Monday, April 1, 2024 Page 5 Dierking moved, Tyler seconded to accept the resignation from Bruce Noll and declared the vacancy on the Planning Commission. Motion carried 4/0. 12. UNFINISHED BUSINESS (a) City Council Chamber Options Hersman moved, Tyler seconded, to schedule the next City Council Meeting at 106 Center Street and designate it as the official City Council Chambers until December 31, 2024, with prior communication to the neighborhood and the developer. Motion carried 3/1. 13. NEW BUSINESS (a) None 14. ADJOURNMENT Hersman moved, Dierking seconded to adjourn the meeting at 7:34 P.M. Motion carried 4/0.
