Regular Council Meeting MINUTES Monday, April 15, 2024 106 Center Street, Excelsior, MN 55331, 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:33 P.M. 2. ROLL CALL City Council: Mayor Carlson, Councilmembers Caron, Dierking, Hersman and Tyler Also Present: City Manager Luger, Assistant City Manager/City Attorney Staunton, Community Development Director Mullin and Public Works Director, Amundsen. 3. APPROVAL OF MINUTES (a) April 1, 2024 City Council Work Session Minutes (b) April 1, 2024 City Council Meeting Minutes Dierking moved, Tyler seconded to approve the April 1, 2024 Work Session Minutes and the April 1, 2024 City Council Meeting Minutes. Mayor Carlson abstained from the vote. Motion carried 4/0. 4. OPEN FORUM Bob Bolles, 229 George Street, addressed the Council complimenting the move to the 106 Center Street location as temporary City Council Chambers and addressed concerns with short term rentals. Bruce Kelly, 165 Maple Street, addressed the Council with concerns about the design and cost of the parking structure and provided feedback on the Short-Term Rental Ordinance. Minutes City Council Meeting Monday, April 15, 2024 Page 2 Ben James, Proprietor, Montego Blu, addressed the Council with concerns about the construction at 339 Third Street and how it is affecting business. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Heritage Preservation Commission Update Kevin Staunton, Assistant City Manager/City Attorney, gave an update on the Heritage Preservation Commission. (b) Update on Consulting Services Kevin Staunton, Assistant City Manager/City Attorney, gave an update on Amy Lucas’s Services. (c) Ballfield Seating Update Tim Amundsen, Public Works Director, gave an update on the ballfield seating project. (d) Arbor Day Celebration Tim Amundsen, Public Works Director, announced that the Arbor Day Celebration will take place on May 18, 2024. (e) South Lake Minnetonka Police Department Update Mayor Carlson gave an update on the South Lake Minnetonka Police Department Coordinating Committee. (f) Spring Cleanup Day Mayor Carlson announced that Spring Clean-up Day is May 18, 2024. (g) Hennepin County 2024 Open Book Meetings Kristi Luger, City Manager, provided a schedule for the 2024 Open Book Meetings. Minutes City Council Meeting Monday, April 15, 2024 Page 3 (h) Hennepin County Primary for Special Election Kristi Luger, City Manager, announced the upcoming Hennepin County Primary for District 6 Commissioner on April 30, 2024 at Mount Calvary Lutheran Church. 6. MEET EXCELSIOR (a) Excelsior-Lake Minnetonka Chamber of Commerce Tiffany King, Excelsior-Lake Minnetonka Chamber of Commerce, provided an update and information on upcoming special events. 7. AGENDA APPROVAL (a) Meeting Agenda Tyler moved, Caron seconded, to approve the April 15, 2024 Meeting Agenda with the changes to remove 12(a) and 12(b). Motion carried 5/0. (b) Consent Agenda Dierking moved, Tyler seconded, to approve 7(b) 1, 2, 3, 5, 7 and 8 on the April 15, 2024 Consent Agenda. Motion carried 5/0. Caron moved, Tyler seconded to continue item 7(b)4 to the May 6, 2024 City Council Meeting. Motion carried 5/0. Dierking moved, Tyler seconded to adopt item 7(b)6 Resolution No. 2024-20 Ratifying and Updating the Final Plat for 329 and 339 Third Street. Caron recused herself from the vote. Motion carried 4/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Minutes City Council Meeting Monday, April 15, 2024 Page 4 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Excursion Boat Fee Increase Action – Adopted a 5% increase for Excursion Boat Permits for 2024. 3. Resolution 2024-18 No Mow May Initiative Action – Adopted Resolution 2024-18, No Mow May initiative allowing participating residents to refrain from mowing their lawns from May 1 until May 31, 2024. 4. Second Reading and Adoption of Ordinance No. 660 Short-Term Rental Action – Continued item to May 6, 2024 City Council Meeting. 5. March Building Permits Report Action – Approved March Building Permits Report. 6. Adopt Resolution 2024-20 Ratifying and Updating the Final Plat for 329 and 339 Third Street Action – Adopted Resolution 2024-20 Ratifying and Updating the Final Plat for 329 and 339 Third Street. 7. Continue Plaza Signage to the May 6, 2024 City Council Meeting Action – Continued Plaza Signage to the May 6, 2024 City Council Meeting. 8. Purchase of Equipment Out of Park Capital Fund Updated Request Action – Authorized purchase out of the Park Capital Fund. Minutes City Council Meeting Monday, April 15, 2024 Page 5 8. PUBLIC HEARINGS (a) 224 Third Street Residential Review Permit and Variance Applications Julia Mullin, Community Development Director, gave a staff report. Christina and Peter Spencer, 224 Third Street, addressed the Council. Hersman moved, Dierking Seconded, to adopt 2024-17 Approving a Residential Review Permit and Variance Applications for 224 Third Street. Motion carried 5/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) 10 Water Street Sketch Plan Matt Mithun, Mitun Enterprises, addressed the Council. Mark Mclane, Marco Malane Development, addressed the Council. Daniel Yudchitz and Leif Eikevik, Leo A Daly, addressed the Council. Colin Oglesbay, D/O Architects, addressed the Council. No action required. Discussion only. 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) 254 Lake Street Potential Motion to Rescind Resolution No. 2023-38 Denying a Residential Review Permit for 254 Lake Stret Minutes City Council Meeting Monday, April 15, 2024 Page 6 Removed from Agenda and continued a future City Council Meeting. (b) 254 Lake Street Approval of Revised Plans Resolution 2024-19 Removed from Agenda and continued to a future City Council Meeting. 13. NEW BUSINESS (a) None 14.
