Regular Council Meeting MINUTES Monday, May 6, 2024 106 Center Street, Excelsior, MN 55331, 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:35 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, and Tyler Absent: Councilmember Hersman Also Present: City Manager Luger, Assistant City Manager/City Attorney Staunton, Administrative Services Director Williams, and Public Works Director Amundsen 3. APPROVAL OF MINUTES (a) April 15, 2024 City Council Closed Session Minutes (b) April 15, 2024 City Council Work Session Minutes (c) April 15, 2024 City Council Meeting Minutes Dierking moved, Caron seconded to approve the April 15, 2024 Closed Session Minutes, April 15, 2024 Work Session Minutes, and the April 15, 2024 City Council Meeting Minutes. Motion carried 4/0. 4. OPEN FORUM Sheila Holleran, 321 Third Street, addressed the Council with concerns about the Short-Term Rental Ordinance and Landmark properties. Bob Bolles, 229 George Street, addressed the Council regarding issues viewing of the screen and the need for shades in the Council Chambers. Minutes City Council Meeting Monday, May 6, 2024 Page 2 Bruce Kelly, 165 Maple Street, addressed the Council about the 339 Third Street Construction project and his concerns about the Short-Term Rental Ordinance. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) 339 Third Street Construction Update Mark Madero, Project Manager, gave an update on the 339 Third Street Construction project. John Bradford, WSB, gave a financial update on the 339 Thid Street Construction project. (b) Excelsior Fire District Update Councilmember Tyler gave an update on the Excelsior Fire District. (c) Spring Cleanup Nalisha Williams, Administrative Services Director, announced that Spring Cleanup is scheduled for Saturday, May 18, 2024. (d) May Commission Meeting Dates Nalisha Williams, Administrative Services Director, provided meeting updates for May – The Parks and Recreation Commission Meeting is scheduled for Tuesday, May 7, 2024, at 6:15 P.M. due to the Special Election being held on May 14th. The Planning Commission Meeting is scheduled for Tuesday, May 21, 2024, at 6:30 P.M. due to the Memorial Day holiday. Both meetings will be held at Council Chambers, 106 Center Street. (e) Special Election – May 14th Nalisha Willams, Administrative Services Director, announced that the upcoming Special Election for Hennepin County District 6 Commissioner is scheduled for Tuesday, May 14, 2024 at Mount Calvary Lutheran Church, 301 County Road 19. Minutes City Council Meeting Monday, May 6, 2024 Page 3 (f) No Mow May Tim Amundsen, Public Works Director, provided information on how to participate in No Mow May. (g) Arbor Day Celebration Tim Amundsen, Public Works Director, announced that the Arbor Day Celebration is scheduled for Saturday, May 18, 2024. (h) Heritage Preservation Commission Update Kevin Staunton, Assistant City Manager/City Attorney, gave an update on the Heritage Preservation Commission. 6. MEET EXCELSIOR (a) None 7. AGENDA APPROVAL (a) Meeting Agenda Caron moved, Tyler seconded, to approve the May 6, 2024 Meeting Agenda. Motion carried 4/0. (b) Consent Agenda Dierking moved, Tyler seconded, to approve the May 6, 2024 Consent Agenda. Motion carried 4/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. Continue Plaza Signage to the May 20, 2024 City Council Meeting Action – Continued Plaza Signage to the May 20, 2024 City Council Meeting. 4. The Commons Shoreline Restoration Feasibility Study Action – Authorized the Excelsior Commons Shoreline Restoration Feasibility Study. 5. March Financials Action – Approved March Financials 6. Acknowledge 10% Gambling Donations for First Quarter 2024 Action – Acknowledged Charitable Gambling Donations. 7. The Commons Irrigation Mainline Extension Action – Authorized expenditure of $19,306.92, utilizing remaining sales tax funds, to provide for a mainline irrigation extension to the new planting areas for the Oak Knoll and West Knoll areas by Minnesota Irrigation. 8. PUBLIC HEARINGS (a) None 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) Tonka Boat Rental Proposal Council directed staff to prepare a one-year lease to bring back to Council for approval. Minutes City Council Meeting Monday, May 6, 2024 Page 5 (b) 106 Center Street Sketch Plan Review Tim Alt, Altus Architecture and Design, presented a sketch plan for the property at 106 Center Street. The Council provided feedback to staff and Altus. No action taken. (c) 101 West Lake Street Sketch Plan Review The Council considered the issues identified and provided direction to staff and the property owners. No action taken. 10. ORDINANCES and RESOLUTIONS (a) Second Reading and Adoption of Ordinance No. 660 Short Term Rental Tyler moved, Dierking seconded, to adopt Ordinance No. 660 with the change to Sect 3, Sub 2 to read “Nothing herein, however, shall prohibit the owner of a Landmark site from renting out two units as a short term rental in addition to the unit that this is their primary residence.” Dierking withdrew her second. Motion failed. Caron moved, Dierking seconded, to adopt Ordinance No. 660 with the change to Sect 3, Sub 2 to read “Nothing herein, however, shall prohibit the owner of a Landmark site from renting up to three units as a short term rental in addition to the unit that this is their primary residence.” Motion carried. 3/1. 11.
