Regular Council Meeting MINUTES Tuesday, September 3, 2024 106 Center Street, Excelsior, MN 55331 – Entrance located on Center Street 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:35 P.M. 2. ROLL CALL Present: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Tyler Also Present: City Manager Luger, Assistant City Manager/City Attorney Staunton, Public Works Director Amundsen, and Finance Director Palmer 3. APPROVAL OF MINUTES (a) August 19, 2024 City Council Work Session Minutes (b) August 19, 2024 City Council Meeting Minutes Dierking moved, Tyler seconded to approve the August 19, 2024 City Council Work Session minutes and the August 19, 2024 City Council meeting minutes. Mayor Carlson abstained from the vote. Motion carried 4/0. 4. OPEN FORUM Bruce Wayne Kelly, 165 Maple Street, addressed the Council regarding consent agenda item five (5) July Financials, specifically capital expenditures and sales tax collections. Additionally addressed Council on parking study and opportunities at Commons Park. Mark Meldahl, 701 Pleasant Street, addressed the Council regarding siren and monthly first Wednesday testing which is loud for The Waters residents located nearby. The council requested Director Amundsen to follow up with the County on siren location and any possibilities to relocate. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS Minutes City Council Meeting Tuesday, September 3, 2024 Page 2 (a) 339 Third Street Update Consultants not in attendance to provide update. Mayor Carlson provided update that development scheduled for completion in November. (b) Met Council Project Update Public Works Director Amundsen provided the council with an update on street projects and utility installations. (c) Heritage Preservation Commission Update No update. (d) 2050 Regional Development Guide Comment Period Mayor Carlson mentioned the draft of Development Guide from Hennepin County is available and encouraged public and councilors to submit public comments. 6. MEET EXCELSIOR (a) Mark Kroll, Lake Minnetonka Conservation District Update Kroll provided the council with updates on Lake Minnetonka Conservation District, including online boat rentals, aquatic invasive species, and wake surfing. 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Dierking seconded, to approve the September 3, 2024 City Council meeting agenda. Motion carried 5/0. (b) Consent Agenda Caron moved, Dierking seconded, to approve the September 3, 2024 consent agenda with the change to pull item 6 Emergency Ordinance for separate vote and item 3 Home Tour Special Event Ordinance Amendment for discussion. Motion carried 5/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Minutes City Council Meeting Tuesday, September 3, 2024 Page 3 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Resolution 2024-28 Approving Residential Review Permit and Variance Applications for 719 Second Avenue Action – Approved Resolution 2024-28 Approving Residential Review Permit and Variance Application for 719 Second Avenue. 3. Home Tour Special Event Ordinance Amendment Tyler raised question whether Section 10 should be amended to read that City Manager may impose additional conditions instead of City Council. Assistant City Manager/City Attorney Staunton will make the recommended correction. Action – Approved Home Tour Special Event Ordinance Amendment with correction to Section 10 to replace City Council with City Manager to impose additional conditions. 4. 2025 Lake Minnetonka Communications Commission (LMCC) Budget Action – Approved 2025 Lake Minnetonka Communications Commission (LMCC) Budget. 5. July Financials Finance Director Palmer addressed questions about overspending on capital budget and stated majority was because of expense overage for parking structure. Confirmed city was over budget on revenue collections. Action – Reviewed and approved July Financials. 6. Emergency Ordinance 670 Amending Chapter 32 to Add Permit Parking to Morse Avenue Minutes City Council Meeting Tuesday, September 3, 2024 Page 4 Tyler moved, Caron seconded, to approve the Emergency Ordinance 670 Amending Chapter 32 to Add Permit Parking to Morse Avenue. Motion carried 3/2. Hersman and Dierking voted against. 8. PUBLIC HEARINGS (a) 106 Center Street – Zoning Text Amendment to add Conditional Use Permit for Community Center/Arts and Culture Center Mayor Carlson opened public hearing. Assistant City Manager/City Attorney Staunton presented staff report. Bob Bolles, 229 George Street – addressed the Council and expressed concerns about the presentations given to the Council and that some voices are not detectable and hard to hear. Peter Hartwich, 186 George Street – addressed the Council and expressed support of the zoning amendment and future project. Andrew Punch, 561 Third Street- addressed the Council and mentioned the Planning Commissions work on this. Tim Alt, 420 Second Street – addressed the Council and provided update on progress addressing the buildings integrity and working with other organizations to use the space. Mayor Carlson closed public hearing. Hersman moved, Dierking seconded, to waive the first reading of Emergency Ordinance 670 and schedule second reading for the August 16, 2024 Council meeting. Motion carried 5/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) None 10. ORDINANCES and RESOLUTIONS Minutes City Council Meeting Tuesday, September 3, 2024 Page 5 (a) None 11.
