1. CALL TO ORDER
Mayor Carlson called the meeting to order at 6:35 P.M.
2. ROLL CALL
Present: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Tyler
Also Present: City Manager Luger, Assistant City Manager/City Attorney Staunton, Public
Works Director Amundsen, and Finance Director Palmer
3. APPROVAL OF MINUTES
(a) August 19, 2024 City Council Meeting Minutes
(b) September 3, 2024, City Council Closed Session Meeting Minutes
Hersman moved, Dierking seconded to approve the August 19, 2024 City Council and
September 3, 2024 City Council Closed Session meeting minutes. Motion carried 5/0.
4. OPEN FORUM
Bruce Wayne Kelly, 165 Maple Street, addressed the Council regarding the siren not yet
working at the new project site and that construction workers are parking on Center and
Third street.
Public Works Director Amundsen, addressed the Council and provided update that the
MPCA contacted the city regarding illegal dumping in the storm sewer after which the staff
followed up with Layline and any dumping.
5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS
(a) 339 Third Street Update
Project manager for construction site (Mark) addressed the Council and provided project
update and stated contractor parking will be monitored.

(b) Opening of Parking Structure - November
City Manager Luger updated Council that parking structure scheduled to open second
week of November.
(c) Met Council Project Update
Public Works Director Amundsen provided the council with an update on Met project.
(d) Heritage Preservation Commission Update
Assistant City Manager/City Attorney Staunton provided update on Heritage Preservation
Commission meetings.

(a) None
7. AGENDA APPROVAL
(a) Meeting Agenda
Dierking moved, Tyler seconded, to approve the September 16, 2024, City Council meeting
agenda. Motion carried 5/0.
(b) Consent Agenda
Hersman moved, Tyler seconded, to approve the September 16, 2024, consent agenda with
the change to pull item 4 Resolution Reducing 2025 Debt Levy. Motion carried 5/0.
1. Review Verified Claims under $20,000 and Approve Verified Claims over
$20,000
Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims
over $20,000.
2. Second reading of Home Tour Special Event Ordinance Amendment (Ord 672)
Action – Approved Second Reading of Home Tour Special Event Ordinance

3. Second Reading of 106 Center Street – Zoning Text Amendment to add

4. Resolution Reducing 2025 Debt Levy
Finance Director Palmer provided a staff report on debt levy.
Dierking moved, Tyler seconded, to approve Resolution Reducing 2025 Debt
Levy. Motion carried 5/0.
5. Certify 2024 Preliminary Property Tax Levy Collectible 2025
Action – Approved certification of 2024 Preliminary Property Tax Levy Collectible
2025.
6. Approve Pay Voucher No. 4 Excelsior Blvd Lift Station Rehabilitation
Action – Approved Pay Voucher No. 4 Excelsior Blvd Lift Station Rehabilitation.
8. PUBLIC HEARINGS
(a) Assessment Hearing for Unpaid Utilities and Other Charges
Mayor Carlson opened public hearing. Caron recused herself from discussion and vote.
Finance Director Palmer provided staff report on assessment hearing.
Bruce Wayne Kelly, 165 Maple Street, addressed the Council and requested clarification on
dates noted in the report.
Mayor Carlson closed the public hearing.
Dierking moved, Tyler seconded, to approve Resolution for property tax collection for
assessments. Motion carried 4/0. Caron abstained.

(b) Liquor License – 200 Water Street
Mayor Carlson opened public hearing.
Assistant City Manager/City Attorney Staunton presented staff report.
Brent Frederick, 229 George Street, Edina, MN – addressed the Council and clarified their
project at 200 Water Street and clarified the space will have three separate spaces serving
customers; two restaurants and a cocktail bar.
Mayor Carlson closed public hearing.
Caron moved, Tyler seconded, to approve resolution and issuance of liquor license
for 200 Water Street. Motion carried 5/0.
9. PETITIONS, REQUESTS and COMMUNICATIONS
(a) Organics Recycling
City Manager Luger provided update to Council on organics recycling program and
effective date of 2022 for compliance changes from Hennepin County.
Matt Herman from Republic Services provided update on organics recycling program and
change at County level requiring municipalities to provide organic recycling.
Council directed staff do additional research on city drop off site for organics and grant
opportunities to come into compliance with Hennepin County. Motion carried 5/0.
