April 19, 2016 The Adjourned Meeting of the City Council of the City of Fairmont was held at 4:30 p.m. on the 19th day of April, 2016, at the Public Safety Building located at 500 Quincy Street, Fairmont, West Virginia. Mayor Straight called the meeting to order. Roll call was taken by the Clerk. Councilmembers present were: First District Marianne Moran Second District Frank G. Yann Third District Robert (Rob) Linger Fifth District Fran Warner Sixth District Daniel K. (Dan) Weber Seventh District Philip R. (Phil) Mason Eighth District Thomas (Tom) Mainella Ninth District Ronald J. (Ron) Straight, Sr. Absent: Fourth District William H. (Bill) Burdick Also present were: City Manager Robin I. Gomez City Clerk Janet L. Keller Finance Director Eileen Layman IN RE: EXCUSE COUNCILMEMBER BURDICK The Mayor entertained a motion to excuse Councilmember Burdick from this meeting. Motion: Councilmember Linger moved to excuse Councilmember Burdick. The motion was seconded by Councilmember Mason. 1 The Mayor declared Councilmember Burdick excused by voice vote of Council. PUBLIC HEARING IN RE: A RESOLUTION APPROVING RATES OF LEVY LAID BY THE CITY OF FAIRMONT, MARION COUNTY, AND APPROVED BY THE STATE TAX COMMISSIONER FOR MUNICIPAL PURPOSES FOR THE FISCAL YEAR BEGINNING JULY 1, 2016 IN ACCORDANCE WITH CHAPTER 11, ARTICLE 8 OF THE WEST VIRGINIA CODE, AS AMENDED Pursuant to a notice duly published in the Times-West Virginian, on March 18, 2016 and March 25, 2016, Mayor Straight convened a public hearing to obtain citizen input on a resolution to approve the levy rates for July 1, 2016. Mayor Straight asked if anyone present wished to speak in favor of or in opposition to the proposed resolution. There being no one to speak to the proposed Levy, the public hearing was called to a close at 4:31 p.m. CONSIDERATION OF COUNCIL BUSINESS IN RE: ADOPTION, A RESOLUTION APPROVING RATES OF LEVY LAID BY THE CITY OF FAIRMONT, MARION COUNTY, AND APPROVED BY THE STATE TAX COMMISSIONER FOR MUNICIPAL PURPOSES FOR THE FISCAL YEAR BEGINNING JULY 1, 2016 IN ACCORDANCE WITH CHAPTER 11, ARTICLE 8 OF THE WEST VIRGINIA CODE, AS AMENDED Mayor Straight entertained a motion for the adoption of the proposed Resolution. Motion: Councilmember Weber moved for the adoption of the resolution and Councilmember Yann seconded the motion. The Clerk read the proposed resolution by synopsis for the first time. 2 Roll call was taken by the Clerk. Mayor Straight declared the resolution adopted by unanimous vote of those Councilmembers present. ADJOURNMENT Mayor Straight entertained a motion for adjournment. Motion: Councilmember Mason moved to adjourn the meeting. Councilmember Linger seconded the motion. Mayor Straight declared the meeting adjourned by voice vote of Council at 4:35 p.m. 3

Public Hearing on Proposed Levy Rates. 2. Adoption, A Resolution Approving Rates Of Levy Laid By The City Of Fairmont, Marion County, And Approved By The State Tax Commissioner For Municipal Purposes For The Fiscal Year Beginning July 1, 2016 In Accordance With Chapter 11, Article 8 Of The West Virginia Code, As Amended.
