April 26, 2016 The regular meeting of the City Council of the City of Fairmont was held at 7:00 p.m. on the 26th day of April, 2016, at the Public Safety Building located at 500 Quincy Street in Fairmont, West Virginia. APPROVAL OF MINUTES Mayor Straight noted that each member of Council had received a copy of the minutes from the Regular Meeting held on April 12, 2016 and from the Levy Meeting held on April 19, 2016. Councilmember Warner moved to approve the minutes as submitted. The motion was seconded by Councilmember Yann. The Mayor declared the minutes approved as submitted by voice vote of 1 Council. The Mayor asked if anyone present desired to speak to the proposed ordinance. There being no one to speak, the public hearing was called to a close at 7:09 p.m. IN RE: AN ORDINANCE OF THE COUNCIL OF THE CITY OF FAIRMONT REPEALING CITY ORDINANCE NOS. 1545, 1573, 1579, AND 1599, PERSONNEL RULES WHICH PROVIDE FOR THE CITY’S EXISTING PAY PLAN AND LIST OF OCCUPATIONAL CLASSES FOR ALL CLASS TITLES AND EMPLOYEES, AND REENACTING A PAY PLAN AND LIST OF OCCUPATIONAL CLASSES FOR ALL CLASS TITLES AND EMPLOYEES TO PROVIDE FOR A 3% INCREASE IN THE BASE RATE OF PAY FOR ALL CLASS TITLES EFFECTIVE JULY 4, 2016, MODIFYING LONGEVITY PAY; AND PROVIDING FOR CERTAIN STYLISTIC CHANGES Pursuant to a notice duly published in the Times-West Virginian on April 18, 2016, a public hearing was convened to obtain citizen input on a proposed ordinance to provide for a 3% pay increase for all class titles effective July 4, 2016. The Mayor asked if anyone present desired to speak to the proposed ordinance. Mr. Gomez thanked Council for their consideration for hopefully adopting this ordinance. He said on behalf of all of the employees, we would like to thank Council for approving this item and this goes a huge way for thanking and showing gratitude to all of our City employees for all of the work that they have done and will continue to do. There being no one else to speak, the public hearing was called to a close at 7:10 p.m. 3  ANNOUNCEMENTS IN RE: FAIRMONT FIRE DEPARTMENT COMMENDED Councilmember Mainella thanked the members of the Fire Department for fighting the fire on Monroe Street on April 17th. Councilmember Weber said he appreciates all of the work of the Fire Department and Police Department. Councilmember Warner noted that we have a great force here in town and he appreciates them as well. Councilmember Burdick stated that those that live right outside the city, they may want to consider coming to joining us because of the Fire Department response time. Councilmember Linger also commended the Fire Department and the other fire departments that provided mutual assistance. He mentioned that they did a great job containing the fire and we are all very proud and thankful for the services that they provide. Councilmember Yann also thanked all of the firefighters. Councilmember Moran said job well done and she was very thankful that there were no injuries. The Mayor stated that they did one heck of a job in fighting that fire. He thanked them for their service and said that we have one of the best Fire Departments in the State. IN RE: CARS PASSING SCHOOL BUSES Councilmember Burdick stated that he had a concern about cars passing the school buses while the lights are flashing red. CITIZENS PETITIONS IN RE: EAGLE SCOUT PROJECT – WINDMILL PARK 4 LEVI HELMICK, stated that his is an Eagle Scout with Troop 14 from the Bellview area. He made a presentation to Council on the Eagle Scout project that he has been working on at the playground at Windmill Park. IN RE: BRIAN SHUCK – CANDIDATE FOR MAGISTRATE BRIAN SHUCK, a candidate for the Office of Magistrate introduced himself to Council and asked for their support on Election Day. IN RE: MARK TRACH – CANDIDATE FOR ASSESSOR MARK TRACH, a candidate for the Office of Marion County Assessor introduced himself to Council and asked for their support on Election Day. CITY MANAGER’S REPORT IN RE: PLANNING AND DEVELOPMENT DIRECTOR Mr. Gomez introduced Sandra Scaffidi, the new Planning and Development Director. He noted that she started with the City of Fairmont yesterday. A hearty welcome was given to Sandra. IN RE: EARLY VOTING The City Manager reminded everyone that early voting starts on Wednesday, April 27 and end on Saturday, May 7. IN RE: ARBOR DAY Mr. Gomez said that Friday is the inaugural day for Arbor Day and the City will be planting several trees along Adams Street. IN RE: DRUG TAKE BACK PROJECT The City Manager reported that Saturday, April 30, is the Drug Take Back Day that will occur at the Police Department. He said this is where people can bring in expired pills or pills that you are no longer using and drop them off at the department to be properly disposed of with no questions asked. IN RE: TWO NEW POLICE OFFICERS 5 Mr. Gomez welcomed two new police officer that began their field training this week. He reported that Officers Streyle and Babbich graduated the WV Police Academy on Friday, April 22. IN RE: BEVERLY ESTATES The City Manager reported that he, Sandra Scaffidi, and Public Works Director Ron Miller met with the gentleman representing the ownership group with Beverly Estates. He stated that they are beginning and continuing the work to repair the drainage in that neighborhood and work on adding and cleaning up streets and adding the next layer of surface. He mentioned that they are also adding water lines and repairing some of the sewer lines and eventually replace the sewer lift station that had been originally planned. IN RE: ARBOR DAY PROCLAMATION PRESENTED Mayor Straight presented an Arbor Day proclamation to Hanna Weaver and Martha Richards, representing the City of Fairmont. IN RE: INTRODUCTION, FIRST READING, SET PBULIC HEARING, AN ORDINANCE AMENDING AND SUPPLEMENTING THE PROVISIONS OF PART ONE-ADMINISTRATIVE CODE, CHAPTER SEVEN-BOARDS, COMMISSIONS AND AUTHORITIES, ARTICLE 171 PARKING AUTHORITY, SECTION .08 RATES, THEREOF, TO INCREASE CERTAIN RATES FOR PARKING: AND TO PROVIDE FOR AN EXPANSION OF THE PRE-PAID PARKING PASS PROGRAM FOR ELIGIBLE RESIDENTS Mayor Straight entertained a motion and a second for the introduction of an ordinance providing for an increase in parking rates and to provide for an expansions of the pre-paid parking pass program for eligible residents. Motion: Councilmember Linger moved for the introduction of the proposed ordinance and the reading of a synopsis in lieu of the entire ordinance. Councilmember Moran seconded the motion. 8 The Clerk read the proposed ordinance by synopsis for the first time. Discussion: Councilmember Weber asked if Council was going to have more discussions and/or meetings about the parking situations in Fairmont or just the one we had a couple weeks ago. Mr. Gomez replied that we certainly can. He explained that these were the main issues discussed regarding the parking rates and the ability to allow for residential on-street parking as well as extending the time that someone can park on the streets. He said that the other items were not a requiring ordinance changes, they were more procedural or administrative in nature that don’t necessarily require to amend our ordinances. He said that in the discussion with the Parking Authority meeting last Wednesday, these were the proposed changes that came up and do require our ordinances to be changed if the Council so chooses to go forward with these proposed changes. Councilmember Weber said that what the Parking Authority had online was extensive and we only covered the first two issues. He asked again if Council was going to have more discussions about parking. The Mayor said that with the other items requested, they were a matter of enforcement and not the one we have downtown for parking meters. He said we are trying to get the downtown issue resolved and then we will move out into the residential areas. Councilmember Weber said that with the length of time that we spent on those two issues, we did not get to the other issues having to do with parking. He noted that we concentrated on those in an hour and half and we did not go any further that the first two issues that were brought up and there are a lot of other issues about parking. Mayor Straight said he agreed but we cannot solve all of those problems in one meeting and he would hope that we would have more meetings. Mr. Gomez said that we certainly can hold more meetings but the majority of the discussion focused on these items that we are bringing forward tonight versus discussing about residential issues and other area, which we did bring 9 up. He stated that the discussion focused primarily on these issues that are in front of Council that do require changes in the existing ordinances. Councilmember Weber went on to say those issues were brought up by the citizens and not by the Parking Authority and there are a lot of other issues that need to be addressed. He said that we certainly fast-walked this through and wondered if the other issues will be discussed. Mayor Straight said that the other issues will be addressed and Council will have more meetings. Councilmember Weber asked if we are going to be considered with the neighborhoods or just pass over them. Mr. Gomez said that Council did discuss that briefly at that meeting and it wasn’t a very overwhelming discussion or that many people speaking out. He said that the issue around Fairmont Senior High School, he had six individuals express a concern about the parking but we don’t have a resolution to that. He added that the direction is to discuss that with the Board of Education and that is where that really needs to be addressed. He said this really needs to be addressed with the Board of Education on how they can look for a solution to accommodate their students. He went on to say that the other issues around the city were primarily issues that he has observed and that he has brought up and has been discussed over many, many years. He added that we are addressing concerns as they come to our attention. The Mayor said that Mr. Gomez will get with the Board of Education to discuss the possibility of opening up some spaces that are either not being used or they are going by the wayside. The Mayor said again that it is enforcement and is not something that we, as Council, can do. Councilmember Mainella asked if the Parking Authority recommended it or did Council discuss increasing the rates for the parking garage so drastically. Mr. Gomez said that it was discussed at the meeting and that is what the consensus was toward the end of the meeting that we go from the $2.00 per day to $5.00 per day. He added that it will go a long way to help with the maintenance of the garage and to help pay the debt a little bit faster and keep the garage cleaner. He said the impact is minimal because the 10 majority of the users of the garage are the state employees and their rate is already fixed for the whole year. Councilmember Mainella noted that the price is still a good deal compared to the parking rates in Morgantown even though the proposed rate is more than doubled. The Mayor said that the parking garage is packed each day with wall to wall cars. The City Manager said that these rates have really been under rated for a very long time and it is time that they do approach rates that we really need to help fund the Parking Fund and to help to maintain the infrastructure and to maintain the garage and really to take the city in the direction where we are able to maintain our infrastructure. With no further discussion, the Mayor declared the public hearing set for May 24, 2016 by voice vote of Council. IN RE: INTRODUCTION, FIRST READING, SET PUBLIC HEARING, AN ORDINANCE OF THE COUNCIL FOR THE CITY OF FAIRMONT AMENDING AND SUPPLEMENTING SECTION 2 OF ORDINANCE NO. 567, AS AMENDED BY ORDINANCE NOS. 1155 AND 1410, AND ORDINANCE NO. 1536, WHICH HAS BEEN CODIFIED AS PART 3 TRAFFIC CODE, CHAPTER 7 PARKING, ARTICLE 363 PARKING METERS, SECTION 363.07 “NOTICE OF PARKING VIOLATION; DUTY TO REPORT AND PAY FINE; PENALTY,” OF THE FAIRMONT CITY CODE, TO PROVIDE FOR AN INCREASE IN THE FINES ASSESSED THEREUNDER Mayor Straight entertained a motion and a second for the introduction of an ordinance providing for an increase in the fines assessed with parking. Motion: Councilmember Mainella moved for the introduction of the proposed ordinance and the reading of a synopsis in lieu of the entire ordinance. Councilmember Warner seconded the motion. The Clerk read the proposed ordinance by synopsis for the first time. Discussion: 11 Councilmember Burdick asked the Police Chief if the officers write the tickets in military time or regular time. The Chief replied however they feel comfortable. Councilmember Burdick said that it would be advantageous to write the tickets in military time because if someone disputes a ticket, they are going to say that they got a ticket at 1:30 and . . . The Chief replied that the Police Department does not write tickets any other time. Mr. Gomez told Councilmember Burdick that our enforcement is from 8:00 a.m. to 5:00 p.m. or 8:00 a.m. to 17:00. Councilmember Linger stated that both parking ordinances caught him by surprise because this is not what he took away from that meeting. He said that he knew there were a few people there that said it doesn’t cost hardly anything to park and maybe two or three people that said that. He said that he did not take it as a consensus of the group; he thought the main concern was just the parking situation overall and there were a wide variety of opinions on it. He said that his concern is that we take from this meeting that people are concerned about parking and the main concern being the length of time that you are able to park in certain areas and then we go and raise the fees and we raise the penalties when the underlying issues still remain enforcement. He went on to say that in his opinion it seems backwards the way we are doing it. He said again that if enforcement is the issue, then we need to fix the enforcement and not increase the penalties and the costs. Mr. Gomez replied that we are increasing the second fine and the third fine. He said that we have way too many people who are not abiding by it and we felt this would really curb them to pay for the parking as they should and abide by the rules that are on there. He noted that we are expanding the amount of time on Adams Streets to two hours. He stated that it will be two hours at all meters at all locations. He said that if we stay at the same rates that we have or even increase up to 75 cents an hour, we would continue to struggle and the Parking Fund would continue to rely on the General Fund to pay for its entire costs. He said it was just not sustainable over a period of time. 12 Councilmember Weber said this is another reason why Fairmont has the unfortunate distinction of being anti-business and not very business friendly and now we are not friendly to people who want to come and spend time in Fairmont. He noted that these are the things that concern him and he wants people to come to the downtown but then we turn around and raise the parking rates like we don’t want them to come downtown. Mr. Gomez said these are valid concerns but that was not the consensus that we took from that meeting and certainly not the consensus of the Parking Authority. Councilmember Weber said again that the Parking Authority never brought up any issues; they were all brought up by the citizens. He said that the Parking Authority did not express any point of view. Mr. Gomez said that the agenda for that meeting primarily came from the meetings that have been held with the Parking Authority. Councilmember Weber said that perhaps Councilmember Linger’s point of view is that it is enforcement, not rules, that may be the problem. He said that this still brings up more issues that Council needs to discuss. The Mayor declared the public hearing set for May 24, 2016 by voice vote of Council. IN RE: ADOPTION A RESOLUTION OF THE COUNCIL FOR THE CITY OF FAIRMONT COMMENDING ALL FIRST RESPONDERS, EMERGENCY PERSONNEL AND PUBLIC EMPLOYEES WHO RESPONDED AND/OR PROVIDED ASSISTANCE WITH REGARD TO THE FIRE EMERGENCY WHICH OCCURRED ON MONROE STREET IN THE CITY OF FAIRMONT’S HISTORIC DISTRICT ON APRIL 17, 2016 Mayor Straight entertained a motion for the adoption of a resolution commending all first responders and other emergency personnel who responded to the Monroe Street fire on April 17, 2016. Motion: Councilmember Mainella moved for the adoption of the proposed resolution and the reading of a synopsis in lieu of the entire resolution. The motion was seconded by Councilmember Mason. The Clerk read the proposed resolution by synopsis for the first time. 13 Roll call was taken by the Clerk. The Mayor declared the resolution adopted by unanimous vote of Council. IN RE: ADOPTION, A RESOLUTION BY THE COUNCIL OF THE CITY OF FAIRMONT, WEST VIRGINIA, AFFIRMING THE FINDINGS AND RECOMMENDATIONS OF THE CITY OF FAIRMONT’S PLANNING COMMISSION AND DENYING A REQUEST TO REZONE PROPERTY DESCRIBED AS PARCELS 79, THROUGH AND INCLUDING PARCEL 91 OF MARION COUNTY TAX MAP 03-35, SITUATE IN THE CITY OF FAIRMONT, FAIRMONT DISTRICT, MARION COUNTY, WEST VIRGINIA FROM GENERAL RESIDENTIAL (GR) TO NEIGHBORHOOD MIXED USE (NMU) Mayor Straight entertained a motion for the adoption of a resolution affirming the findings and recommendations of the Planning Commission to deny a request to rezone property near Windmill Park. Motion: Councilmember Linger moved for the adoption of the proposed resolution and the reading of a synopsis in lieu of the entire resolution. The motion was seconded by Councilmember Burdick. The Clerk read the proposed resolution by synopsis for the first time. Discussion: Councilmember Weber asked the City Manager to explain this resolution to the public. Councilmember Linger said that he attended that Planning Commission meeting and if you ever want to see an example of citizens coming out and speaking out for what they believe in and what they want, that would be the meeting that you should have attended. He explained that the turnout was impressive and their message was clear and the citizens did a great job representing their community and their neighbors and bringing their opinions forward. He said that he did not know there was the resistance that existed towards the building project that was proposed. He said he spoke at that meeting and said his peace as a board member of the Partnership and he was very quickly educated directly afterwards. He said that he appreciates it when people come out and speak for what they believe in and let us know how they feel about these issues. He then thanked everyone that came out on April 5th and spoke at the public hearing. 14 Mr. Gomez then explained the issues of the housing units that was proposed. Roll call was taken by the Clerk. The Mayor declared the resolution adopted by unanimous vote of Council. IN RE: ONE APPOINTMENT, MARION COUNTY PARKS AND RECREATION COMMISSION, UNEXPIRED THREE-YEAR TERM TO END DECEMBER 31, 2018 Mayor Straight entertained a motion for one person to be nominated to the Marion County Commission for an appointment to the MCPARC Board. Councilmember Weber stated that we have talked about . . . The Mayor interrupted to say that we had numerous applications for this board, however, only the application submitted by Jennifer Trippett met the requirement of being a resident of the City of Fairmont and a property owner. He said that we had several applications from Fairview, Pleasant Valley and other areas being outside of the city limits. Councilmember Weber said that if we only have one applicant for a position and we have no idea who that applicant is . . . Mr. Gomez said the applicant is Jennifer Trippett and read her background from her application. Councilmember Weber said that he is just asking and stating that we do not have a process for applications except for a short form that is done online. He said that when we have people appointed to boards, we ought to know a little bit about them and why they want to be on this board. Councilmember Linger stated that from the application, we know why she was interested in serving on this board. Councilmember Burdick moved to nominate Jennifer Trippett for the unexpired term to end December 31, 2018. The motion was seconded by Councilmember Mainella. Councilmember Mason suggested that we ought to go back out and recruit additional applicants when we only have one application submitted. He said that we should have three or something, however, he was not proposing any parameters but he thought it was a good point to have more than just one candidate and when we have only one candidate perhaps we should go back out and seek some more. The Mayor said that Council should have a little bit more faith in our staff in doing these appointments. He said that we have had numerous appointments to different boards and commissions and, as a Council person, we need to read these appointments and get involved in some of this. He then said that if you do not understand how these board appointments come about and what is entailed and just putting it out on Facebook that we have board appointments, you need to know the criteria of these boards before posting it on Facebook. He said with this board, we have numerous people but they have to live in the City and be a property owner. Councilmember Moran said that we do not advertise it in enough different medias and not far enough out. She said that she has said that all along. Mr. Gomez said that we have advertised it in addition to the City’s internet site and Facebook site and Twitter and with Fairmont 101 and at various meetings and different activities that we go to. He said that we continue to share that with folks and saying that these are some of the openings that we have for the boards. He said that we will outreach more. Councilmember Yann noted that he had two people interested but by the time they found out, it was too late and was passed the time limit. Mr. Gomez said that we have to have a beginning and an end date. Councilmember Yann said that to get information out to the citizens, a lot of people don’t look at Facebook and Twitter. The Mayor said a lot of people don’t read the newspaper. 16 Mr. Gomez then said that they can apply anytime and the applications are kept on file for a certain number of years. IN RE: DAVID TORK DAY City Attorney Kevin Sansalone reminded everyone that Thursday, April 28 was proclaimed as David Tork Day. He said that a proclamation was issued back in October proclaiming April 28th as David Tork Day in the City of Fairmont. ADJOURNMENT The Mayor entertained a motion for adjournment.
