STUDY SESSION Mayor Glancy called the Study Session Meeting to order at 4:00 p.m. Absent: 1 - Council Member Harold Froehlich Presiding: 1 - Mayor William P. G.5 - Council Member Reyes asked if the outdated computers were going to be donated? Mark Samuels, Information Services Director, reported they are going to be recycled. A.2 Discuss citizen concern regarding congested parking on neighborhood streets. Jim Olk, Community Services Director, and Police Chief Sid Fuller made presentations regarding on street parking. After some discussion, several City Council members requested City Administration prepare an ordinance allowing for street by street options. A.3 Discuss a Cultural Arts Committee for Farmers Branch. City Council Members discussed advancement of the arts in the City. The general consensus of the City Council was to form a committee for the advancement of the arts. City Council Members will submit names of persons interested in serving on the committee to the City Manager. A.4 Discuss items for a potential bond election for the May, 2014 City of Farmers Branch Page 1 City Council Meeting Minutes - Final October 15, 2013 general election. Mayor Glancy stated there might be a need for a bond election next year and this is the time to discuss potential bond election items. Input will also be sought from the public at the November 14, 2013 Town Hall meeting. Mayor Glancy read the agenda for Executive Session. The Study Session Meeting ended at 5:32 p.m. The City Council may convene into closed Executive Session for any of the Executive Session items listed below at anytime during the City Council Study Session or the City Council Regular Meeting. J. EXECUTIVE SESSION The City Council convened into Executive Session at 5:32 p.m. J.1 Discuss pending and contemplated litigation - Texas Government Code Section 551.071: Discuss pending litigation styled City of Lewisville v. City of Farmers Branch, et. al., Civil Action No. 4:12-cv-00782 in the U.S. District Court (E.D. Texas - Sherman Division). J.2 Discuss economic development incentives - Texas Government Code Section 551.087: Consider incentives for a high tech manufacturing company. The City Council concluded Executive Session at 6:00 p.m. and took a recess. K. THE CITY COUNCIL RECONVENES INTO OPEN SESSION Consider necessary action on items discussed in the Executive Session. The City Council reconvened into Open Session at 6:30 p.m. No action was taken relating to Agenda Item J.1. The following motion was made relating to Agenda Item J.2: Motion by Mayor Pro Tem Fuller, seconded by Council Member Robinson, authorizing the City Manager to negotiate and execute an economic development incentive agreement with an international company for location of its U.S. headquarters within the City of Farmers Branch providing for a rebate of 50% of the company's business personal property taxes paid to the City for five years subject to: (1) the company locating its U.S. headquarters in the City of Farmers Branch for the entire term of the agreement, (2) the taxable value of the Company's new business personal property located within the City being not less than $7 million for the term of the agreement, (3) acquisition of 13800 Diplomat Drive, and (4) such additional terms and conditions the City Manager determines to be responsible, necessary, and in the best interest of the City. The motion passed unanimously. B. INVOCATION & PLEDGE OF ALLEGIANCE Deputy Mayor Pro Tem Connally gave the Invocation and Mayor Pro Tem Fuller led City of Farmers Branch Page 2 City Council Meeting Minutes - Final October 15, 2013 the Pledge of Allegiance. C. CEREMONIAL ITEMS C.1 Consider accepting a $1,500 donation from the Farmers Branch Rotary Club for the City’s Youth Scholarship Program and take appropriate action. Mr. Richard Fleming, President of the Farmers Branch Rotary Club presented a donation to Mayor Glancy for the City's Youth Scholarship Program. A motion was made by Mayor Pro Tem Fuller, seconded by Council Member Robinson, that this Donation be accepted. The motion carried by the following vote: Aye: 4- Mayor Pro Tem Fuller, Deputy Mayor Pro Tem Connally, Council Member Robinson and Council Member Reyes C.2 Consider Board and Commission appointments and take appropriate action. A motion was made by Council Member Robinson, seconded by Council Member Reyes, appointing Sergio De Los Santos to the Planning and Zoning Commission. The motion carried by the following vote: Aye: 4- Mayor Pro Tem Fuller, Deputy Mayor Pro Tem Connally, Council Member Robinson and Council Member Reyes D. REPORT ON STUDY SESSION ITEMS Council Member Robinson reported on the following items: City Administration made presentations regarding parking on neighborhood streets . ITEMS OF COMMUNITY INTEREST Topics presented for the City Manager's Report included: Bloomin' Bluegrass Free Music Festival & Chili Cook Off - to be held October 18 & 19 at the Historical Park featuring world class bluegrass entertainment, chili tasting at the chili cook-off on Saturday, arts and crafts, and a free KidZone Craft Fair - to be held on October 19 at the Senior Center from 9:00 a.m. to 4:00 p.m. Celebration of Roses - a gathering of amateur & professional rosarians for tours, educational sessions and the Dallas Rose Society's Fall Show, will be based at City Hall with free admission on Saturday, October 19 City of Farmers Branch Page 3 City Council Meeting Minutes - Final October 15, 2013 Halloween in the Park - to be held on October 26 at the Historical Park from 5:00 until 10:00 p.m.; admission is free with canned food donations featuring the haunted hedge, trick or treat row, petting zoo, face painting, carnival games, and concessions Veterans Day - to be held on November 11 beginning at 10:30 a.m. at the Senior Center; the Victory Belles will perform Town Hall Meeting - to be held on November 14 a 7:00 p.m. at City Hall to discuss ideas for a potential bond package in May 2014 Staff Notes - congratulations to Fire Chief Steve Park for being elected third vice president of the Texas Fire Chief's Association F. CITIZEN COMMENTS No one wished to speak. G. CONSENT AGENDA Council Member Robinson requested Agenda Items G.4, G.6, and G.7 be moved to the Regular Agenda. Approval of the Consent Agenda A motion was made by Mayor Pro Tem Fuller , seconded by Deputy Mayor Pro Tem Connally, to approve the Consent Agenda. The motion carried by the following vote: Aye: 4- Mayor Pro Tem Fuller, Deputy Mayor Pro Tem Connally, Council Member Robinson and Council Member Reyes G.1 Consider approval of minutes of the City Council meeting held on October 2, 2013 and take appropriate action. The Minutes were approved. G.2 Consider adopting Ordinance No. 3248 abandoning a portion of Bee Street and Pepperwood Street right-of-way for use in conjunction with Mustang Station and take appropriate action. This Ordinance was adopted. G.3 Consider approving Resolution No. 2013-064 authorizing an interlocal agreement for coordinated public health services with Dallas County in the amount of $6,856 and take appropriate action. This Resolution was approved. G.5 Consider approving Resolution No. 2013-066 authorizing the City Manager to purchase replacement desktop and laptop computer systems and associated accessories in an amount not to exceed City of Farmers Branch Page 4 City Council Meeting Minutes - Final October 15, 2013 $112,500 from Dell Computer Corporation utilizing the State of Texas Department of Information Resources contract pricing for automated information systems and take appropriate action. This Resolution was approved. H. PUBLIC HEARINGS There are no Public Hearing items on the agenda. I. REGULAR AGENDA ITEMS I.1 Receive an update on street improvements made on Golfing Green Drive between Webb Chapel and Brookhaven Club Drive. Gary Spoerl, Street Superintendent, made a presentation on the improvements on Golfing Green Drive. G.4 Consider approving Resolution No. 2013-065 authorizing the purchase of a fire engine through the Houston-Galveston Area Council of Government Cooperative Purchasing Agreement and take appropriate action. Fire Chief Steve Parker presented background information on the currently owned fire engine and on the replacement engine. A motion was made by Council Member Reyes, seconded by Council Member Robinson, that this Resolution be approved. The motion carried by the following vote: Aye: 4- Mayor Pro Tem Fuller, Deputy Mayor Pro Tem Connally, Council Member Robinson and Council Member Reyes G.6 Consider approving Resolution No. 2013-067 authorizing a contract with Boyd Construction Services, LLC in the amount of $55,713 for the construction of the Campion Trail Connection and take appropriate action. Randy Walhood, Public Works Director, reported the project required the coordination of the City of Farmers Branch, City of Irving, Lincoln Properties, Dallas County Utility and Reclamation District (DCURD) and a private development in Irving. The City of Irving will be responsible for the maintenance of the trail connection. A motion was made by Council Member Robinson, seconded by Deputy Mayor Pro Tem Connally, that this Resolution be approved. The motion carried by the following vote: Aye: 4- Mayor Pro Tem Fuller, Deputy Mayor Pro Tem Connally, Council Member Robinson and Council Member Reyes G.7 Consider approving Resolution No. 2013-068 approving an agreement with Birkhoff, Hendricks and Carter, LLP for professional engineering services associated with the plans and specifications for Belt-Marsh Pump Station Improvements and City of Farmers Branch Page 5 City Council Meeting Minutes - Final October 15, 2013 take appropriate action. Randy Walhood, Public Works Director, reported on the improvements to the Belt-Marsh Pump Station. A motion was made by Deputy Mayor Pro Tem Connally, seconded by Mayor Pro Tem Fuller, that this Resolution be approved. The motion carried by the following vote: Aye: 4- Mayor Pro Tem Fuller, Deputy Mayor Pro Tem Connally, Council Member Robinson and Council Member Reyes L.
