p.m. in the City Council Chambers, 800 Municipal Drive, Farmington, New Mexico.

Call to Order
Chair Joyce Cardon called the meeting to order at 3:00 p.m. There being a quorum present the
following proceedings were duly had and taken.
Presentation of the Agenda
There were no changes to the agenda.
Approval of the Minutes
A motion was made by Commissioner Thompson and seconded by Commissioner Ragsdale to
approve the minutes of the September 14, 2017 P&Z Meeting. This motion was approved
unanimously by a 7‐0 vote.
Swearing in of Witnesses
All parties that wished to speak on behalf of any agenda items were sworn in by Karen Walker.

SUP 17‐67
Special Use Permit for an attached Family Care Unit
4900 Evergreen Drive
Planning & Zoning Commission Discussion of Petition SUP 17‐67 on September 28, 2017
Associate Planner Helen Landaverde presented the staff report for SUP 17‐67, a request from
Eleanor Barry‐Prather for a Special Use Permit for a Family Care Unit in the SF‐10, Single Family
Residential District for property on 0.615 acres located at 4900 Evergreen Drive.
The petitioner is requesting a Special Use Permit to allow for an attached Family Care Unit with
the installation of a second stove. San Juan County Tax Assessor’s records show that there is a
two‐story residential structure and a garage on the property; a covered walkway connects the
residential structure to the garage. The footprint of the two‐story home is 4,106 square feet
and the garage is 784 square feet. The petitioner is proposing to convert the garage into a
family care unit of 700 square feet for her aging parents and the remaining 84 square feet will
be utilized for storage.
Ms. Landaverde said the petition is consistent with Section 8.9.4 of the UDC, Unified
Development Code and the Comprehensive Plan.
Ms. Landaverde stated that Section 2.5.7(F) of the UDC requires one additional off‐street
parking space be provided. The petitioner’s property has sufficient space in the existing
driveway area to provide the required parking. Also, Section 2.5.7(G) of the UDC states that the
approval period for a Family Care Unit is five years.
Staff concludes that approval of SUP 17‐67 is appropriate and the Community Development
Department recommends approval.
Eleanore Barry‐Prather of 4900 Evergreen Drive said she has spoken with her neighbors and
they did not have any concerns. She said the family care unit was necessary to take care of her
parents who have health problems.
Terry Page, Farmington Fire Chief and a neighbor of Ms. Barry‐Prather said he was in support of
the SUP.

Commissioner Thompson asked if the petitioner would be able to renew the SUP without
another hearing after the 5‐year term. Cindy Lopez said renewal would not need another
hearing as long as there were no issues. Mr. Thompson asked if approval can be for a longer
length of time. Ms. Lopez said the Commissioners can make a condition of approval for the life‐
time of the parents.
Commissioner Davis asked why there was a 5‐year term and if there was an issue with the
Family Care Unit having a stove. Ms. Lopez said there is a 5‐year term to prevent the Family
Care Unit from becoming an apartment after it was no longer needed for that purpose. She
said the stove would also need to be removed once it was no longer needed as a Family Care
Unit.
Planning & Zoning Commission Discussion of Petition SUP 17‐67 on September 28, 2017
A motion was made by Commissioner Davis and seconded by Commissioner Waldroup to
approve Petition SUP 17‐67, a request from Eleanor Barry‐Prather for a Special Use Permit for a
Family Care Unit in the SF‐10, Single Family Residential District, for property on 0.615 acres
located at 4900 Evergreen Drive. The SUP will be for a 5‐year term and will be renewed for
another 5‐year term if there are no issues and the SUP continues to be needed.
AYE: Chair Cardon, Commissioners Brown, Davis, Freeman, Ragsdale, Thompson, and
Waldroup.
NAY: None
Abstained: None
Absent: Commissioners Langenfeld and Washburn.

Business from Staff: Ms. Lopez stated that Petition ZC 17‐59, a request from Charles
Hoisington for a zone change from GC General Commercial to IND Industrial for property
located at 403 E. Animas stayed on consent at the September 26, 2017 City Council meeting.
Also, at the September 26, 2017 City Council meeting, the Council approved refinancing bonds
to pay for several projects in the City as well as the Complete Streets project. Ms. Lopez said
the City is working with Occam Construction to finalize 100% of the plans.

Adjournment: With no further business and a motion by Commissioner Ragsdale and seconded
by Commissioner Brown, the Planning and Zoning Commission meeting of September 28, 2017
was adjourned at 3:15 p.m.
