ADJOURNMENT NEXT REGULAR COUNCIL MEETING ON MONDAY, FEBRUARY 20, 2023 AT 6:00PM Page 3 of 27  ORDINANCE NO. 2023 -01 AN AMENDMENT OF ORDINANCE 52, FOR THE VILLAGE OF FARWELL ORDAINS The following provisions are added to the Village of Farwell Water System Ordinance, being Ordinance #52: Section 26 Right of Entry. The Village, or any of its agents and employees, shall have the power and authority, at all reasonable hours, to enter upon any premises where water is furnished from the Village waterworks system, for the purpose of reading meters or the inspection of all pipes and fixtures connected with such waterworks system, and they shall have power and authority to require any defective pipes or fixtures to be repaired, removed or replaced where they are not in compliance with the provisions of the rules and regulations pertaining to the waterworks system, and any person refusing or neglecting to make such repairs when so ordered shall be deemed guilty of a violation of this Code and liable to prosecution for such violation. Section 27 Damage to meters. Water meters may be installed upon any premises supplied with water and any damage to such meter without regard to whether it is resulting from the carelessness of the owner, agent or tenant through neglect to properly protect the meter, or intentional acts of any person, shall be assessed to such owner or tenant. Water consumers shall not tamper with or remove a meter from the service, or interfere with the reading thereof. The owner shall be responsible for any damage caused by a tenant. Section 28 Penalty. Any person, firm or corporation violating the provisions of this ordinance shall be deemed guilty of a misdemeanor, and subject to a fine of up to $500.00 and/or ninety (90) days in jail, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. Section 29 Conflict and Severability. All ordinances, resolutions and orders or parts thereof in conflict with the provisions of this ordinance is to the extent of such conflict hereby repealed, and each section of this 1 Page 4 of 27 ordinance and each subdivision of any section hereof is hereby declared to be independent, and the finding or holding of any section or subdivision thereof to be invalid or void shall not be deemed or held to affect the validity of any other section or subdivision of this ordinance. Trustee Gina Hamilton made a motion to adopt Resolution 2023-01, "A resolution to enter into and accept a contract between the Michigan Department of Transportation and the Village of Farwell." Trustee Amanda Pfruender seconded the motion. Roll Call. The Treasurer's Report dated 01.10.2023 was presented to Council. b. The Bank & Fund Report dated 12.31.2022 was presented to Council. IX. ZONING REPORT a. Zoning Administrator/Enforcement Officer Julie Albright provided Council with some updates. X. COMMITTEE REPORT a. Finance b. Parks & Rec Committee Chair Gina Hamilton reviewed the Parks & Recreation Meeting from 01.05.2023 with the Council. c. Amanda Pfruender and Adrian Krawczynski reviewed the DPW Meeting from 01.11.2023 with the Council. There was discussion on the temporary hours that are being utilized for the DPW. Trustee Linda Williams made a motion to reduce down the hours of the temporary part-time DPW position to 24 hours per week until Jason Walters returns to work full-time Trustee Victoria Williams seconded the motion. APPROVAL OF THE AGENDA a. Trustee Gina Hamilton made a motion to approve the agenda Trustee Amanda Pfruender seconded the motion. Motion Carried II. PUBLIC COMMENT a. No public comment received. III. UNFINISHED BUSINESS a. The Draft 2023/2024 Budget was reviewed by Council. The Council was in agreement with selling the bank mower and chipper with those revenues to be included in the General Fund. There was also consensus on budgeting for the a car, a pickup truck, and a garbage truck, with ordering garbage cans placed on hold for upcoming budget years. Adrian will make some adjustments to the Water Fund budget. It was also the consensus to offer health insurance starting in the new fiscal year at a 60/40 cost share with the Village paying 60% of the costs and the employee(s) 40%. The Council also reviewed the paid time to allow for 96 hours of PTO and 16 hours of personal time, to be credited on March 1st, with part time employees with a minimum of 24 hours a week to receive half of those amounts. IV. NEW BUSINESS a. There was discussion on the seasonal/temporary employment. Page Page91ofof27 2  Trustee Amanda Pfruender made a motion to allow the temporary DPW employee, Jarin Burger, to work up to 40 hours per week through February 28th, at which time the temporary employment will end Trustee Gina Hamilton seconded the motion. Work Schedule The anticipated letting date is April 1, 2023 and the expected completion date is September 1, 2022. Insurance and Liability The contractor shall at all times exercise extreme care and shall assume all liability for any damages resulting from their operation and shall hold the Village of Farwell harmless from any such claims or damages. The successful bidder must also furnish certificates for policies giving satisfactory evidence of insurance coverage to the minimum extent of $500,000.000 property damage and $1,000,000.00 personal liability to insure adequate payment for any damage caused by their operations. In addition to the above requirements, the Village of Farwell must be listed as additional insured.
