MINUTES TOWN OF FORT MILL PLANNING COMMISSION MEETING November 20, 2018 112 Confederate Street 6:30 PM Present: James Traynor, Tom Petty, Chris Wolfe, Zhengzheng Wiley, Matthew Lucarelli, Planning Director Chris Pettit, Assistant Planner Nick Cauthen Absent: Hynek Lettang, Ben Hudgins Guests: See Attached Sign-In Sheet Chairman Traynor called the meeting to order at 6:30 pm. Mr. Wolfe made a motion to approve the minutes from the October 16, 2018 meeting as submitted. Mr. Petty seconded the motion. The minutes were approved by a vote of 5-0. NEW BUSINESS ITEMS 1. Annexation Request – 1822 North Dobys Bridge Road (Blanton Property): Planning Director Pettit provided a brief overview of the request, the purpose of which was to review and provide a recommendation regarding the annexation of a portion of 1822 North Dobys Bridge Road. Planning Director Pettit went through the staff report and draft ordinance, which included a sunset provision so that the annexation would be null and void in the event that the property was not transferred to the proposed developer. Staff Recommended in favor of approval. Commissioner Wolfe questioned what the zoning classifications for the surrounding properties were, additionally referencing those comments and concerns discussed for a previous annexation request along Kimbrell Road related to residential contexts and traffic impacts. Planning Director Pettit provided information on the surrounding zonings, additionally noting that a traffic study for the project had commenced that will ultimately determine what off-site road improvements, if any, would be required as a part of the development. Commissioner Lucarelli asked about the Comprehensive Plan designation, specifically Node 8, as far as the geographical limits of the various recommendations of the plan. Planning Director Pettit noted that the interpretation of the Comprehensive Plan is based upon the future land use map, the text, and the existing conditions of the area. Chairman Traynor questioned whether there was an advantage in designating the property as HC Highway Commercial versus another zoning designation that would also allow for the use. Planning Director Pettit noted that the HC zoning classification did have additional 1 requirements, particularly relating to buffers, that other zoning classifications did not have. Discussions occurred related to the property’s current zoning and the applicant’s ability to develop the proposed use by right in the existing zoning. Commissioner Petty questioned whether the TIA would address Haire road’s ability to handle a commercial use given its current design standard, to which Planning Director Pettit noted that the TIA would contemplate the road design and provide the reviewing entities with the ability to determine if the road design would need to be enhanced to accommodate the proposed use. Chairman Traynor questioned whether the property owner was in attendance to answer questions, to which it was determined that the property owner was not present. Having requested comment from the property owner, Chairman Traynor provided others in attendance with the same opportunity to speak to the request. Those in attendance, particularly property owners in the area, discussed concerns related to the notification policy for the annexation request, inserting a commercial use and zoning in a residential context, the traffic impact of the proposed use, the existing traffic congestion within the area, and the parking requirements for the proposed daycare. Bill and Amy Strickland, proposed developers of the property, spoke to the concerns of the neighbors using other Goddard Schools as examples of how the use has fit into residential areas and how concerns have been addressed. Commissioner Wolfe noted that his preference would be to have the project accessed from Fort Mill Parkway versus Haire Road. Commissioner Lucarelli noted that the site is zoned to allow a daycare by right in York County, with the annexation request only changing the jurisdiction and providing the site with the ability to connect to municipal utilities. Questions arose related to the future use of the portion of the property fronting North Dobys Bridge Road, to which the proposed developers of the property noted that the current property owner required that piece be sold in conjunction with the larger portion of the site and that the only planned use for the property would be for signage. Commissioner Wiley questioned how the TIA would play a role in the annexation request, to which Planning Director Pettit noted that the TIA would be required prior to the issuance of a building permit and not necessarily as a part of the annexation process. There being no further questions, Chairman Traynor requested a motion on the request. Commissioner Wolfe made the motion to recommend in favor of denial due to access and traffic issues. The motion was seconded by Chairman Traynor for discussion. 2 Commissioner Lucarelli acknowledged the concerns of the residents, but additionally spoke to the request being consistent with other properties in the vicinity, the proposed developer having a good intent with the project, the proposed developer showing good effort to make the project fit, and the current York County zoning’s allowable uses. Commissioner Petty noted that the request generally follows the Comprehensive Plan’s recommendations and that his primary concern was related to the future uses of the small portion of the property that is on the southwest side of Haire Road. Commissioner Petty additionally spoke to the concerns of traffic, noting that the assumption would have to be that the Traffic Impact Analysis (TIA) would do its job. Commissioner Wiley addressed the County’s zoning and the by-right uses already allowed, which had some that were more intensive than the proposed Goddard School. Commissioner Wiley noted that her preference would be to have the results of the TIA prior to having the project move forward. Commissioner Wolfe spoke to the proposed location and the lack of access from a primary road. Chairman Traynor acknowledged the quality of the proposed use, but additionally spoke to the concern of the impact on the residential of the area. Following the discussion, Chairman Traynor called for a vote. The motion failed by a vote of 2-3, with Commissioners Lucarelli, Petty, and Wiley opposed. A subsequent motion was made by Commissioner Lucarelli to recommend in favor of approval, which was seconded by Commissioner Wiley. The motion was approved by a vote of 3-2, with Chairman Traynor and Commissioner Wolfe opposed. 2. Appearance Review – 1822 N. Dobys Bridge Road (Blanton Property): Assistant Planner Cauthen provided a brief overview of the request, the purpose of which was to review and grant commercial appearance review approval for a proposed preschool (Goddard School) located near the intersection of Haire Road and North Dobys Bridge Road. Assistant Planner Cauthen stated that the proposal included a 10,000 sq. ft. building with 57 parking spaces. The Planning Department recommended approval of the request with the condition for staff to be able to approve minor adjustments, and for a sidewalk to be installed at the property frontage along Haire Road. Mr. Wolfe asked if metal or fiber cement siding would be used? The applicant stated that it depends on costs and the goal is for a home type feeling for the children. Mr. Traynor stated that a metal roof is acceptable, but cement siding is greatly preferred over metal. The applicant stated that the Rock Hill Goddard School branch has cement siding and cement siding at this site would not be an issue. Mr. Lucarelli commented that it is very important for the building elevations to fit in with 3 the residential nature of the area. The applicant stated that the building is the same theme as a Kingsley/mill type building. Mr. Lucarelli asked about the side elevations and the applicant said the building elevations would be consistent on all four sides minus the sign and drive thru area. Mr. Traynor noted that the dumpster screening material was brick veneer. Mr. Wolfe asked about the use of the roll up door on the north elevation. The applicant stated that this would be used as a multi-purpose room for good weather days. Mr. Petty made a motion to grant commercial appearance review with conditions that annexation is approved by Town Council, fiber cement siding is used instead of metal, staff has the ability to approve minor modifications to the site plan and elevations if needed, and a sidewalk must be provided along the Haire Road frontage of the property. Mr. Wolfe seconded the motion. The motioned was approved by a vote of 5-0. 3. Commercial Appearance Review – 1560 N. Dobys Bridge Road: Assistant Planner Cauthen provided a brief overview of the request, the purpose of which was to review and grant commercial appearance review approval for a proposed daycare located at 1560 N. Dobys Bridge Road. Assistant Planner Cauthen stated that the proposal included 2 buildings with 81 total parking spaces. The Planning Department recommended approval of the request with the condition for staff to be able to approve minor adjustments and for the applicant to provide sidewalks along both street frontages. Mr. Wolfe asked the applicant to describe the offices being proposed in what is denoted as building 2 on the site plan. The applicant responded that the building would be used for after school care with supporting offices. The applicant brought and explained the material samples for the building which included brick, concrete, and stucco. The applicant stated that the original plan for this property was to have an entrance from Williams Road, but the latest proposal would just have an entrance from Dobys Bridge Road. The Commission agreed that was a positive. Mr. Traynor asked about the fence proposal. Staff stated that it met zoning requirements but would need to get a building permit if over 6 feet and must not impede on any line of sight guidelines. The applicant stated the fence would be decorative vinyl with wood grain panels which makes it much more durable than solely wood. Mr. Wolfe asked if the building and parking met setback requirements. Staff confirmed that it does. Mr. Wolfe also added that he did not want for the dumpster opening to face the parking lot. Staff stated that it would be masonry on 3 sides. Mr. Traynor asked if 3-inch caliper trees are required? Staff noted that the minimum in the 4 current UDO was 2 inches. The applicant stated that they would be extending sewer from Fairway Drive to the property for this project. Mr. Lucarelli made a motion to grant commercial appearance review with conditions to allow for staff to be able to approve minor modifications to the site plan and elevations if needed, the dumpster enclosure masonry must match the principal structure materials, and sidewalks must be provided along both street frontages. Mr. Petty seconded the motion. The motioned was approved by a vote of 5-0. INFORMATION / DISCUSSION 1. Preliminary Appearance Review – 114 Springs Street: Planning Director Pettit gave a brief description of the preliminary appearance review. The project included a 1 story office/retail building located at the corner of Springs Street and Elliott Street. Mr. Traynor asked about the zoning classification of the property? Staff responded that the property is zoned Local Commercial. Mr. Wolfe asked if the project had enough parking spaces to meet the zoning requirement? Staff responded that a complete review of this project has not yet been completed. The applicant stated the current plan proposes to bring the building close to the street and to keep the current retaining wall that is in front of the building. Nineteen parking spaces have been provided and depending on compact spaces that number could increase slightly according to the applicant. The Commission asked if the building would contain a restaurant and the applicant responded that it would not due to parking restraints. Staff added that on-street parking does not count towards parking requirements. Mr. Wolfe asked how many tenants would occupy the building? The applicant stated that it depends on tenant interest and could be a single tenant or up to 4 tenants. Mr. Petty asked the applicant if they were just developing or planning to occupy the site? The applicant responded that they would not be occupying the site. The applicant stated that the roof of the building would be around 16-18 feet and the parapet would extend to approximately 22-24 feet. The Commission was concerned about the blank wall on the south side elevation. Mr. Traynor asked if any windows were being proposed? The applicant responded that the proximity to the property line eliminated a few options, but fire rated glass could be a 5 possibility. The Commission responded that faux windows would also suffice. Mr. Wolfe asked if the sidewalks would remain on both streets and who the intended audience was for the building? The applicant stated that the sidewalks would remain, and the building was intended for professional office / flex space. There being no further business, the meeting was adjourned at 8:25. NEW BUSINESS ITEMS Ms. Wiley arrived prior to New Business Item #1 1. Commercial Appearance Review – CEENTA: Assistant Planner Cauthen provided a brief overview of the request, the purpose of which was to review and grant commercial appearance review approval for a proposed medical office building located on the south side of Sutton Road near the intersection of Smythe Road. Assistant Planner Cauthen stated that the proposal included a 30,000 sq. ft., 2 story building with 150 parking spaces. The Planning Department recommended approval of the request with the condition for staff to be able to approve minor adjustments. Mr. Traynor asked if material samples were available for the Commission. The applicant brought samples and explained them in detail, which included masonry block and precast concrete panels. Mr. Wolfe stated that a mix of materials as shown on the elevations was greatly preferred over plain white walls. The applicant asked about flexibility regarding the colors and materials and Mr. Traynor responded that any significant changes would have to come back before the Planning Commission for commercial appearance review. Mr. Traynor asked if the horizontal material shown above the windows was timber, to which the applicant responded that it was precast concrete. Ms. Wiley stated that she thought the colors seemed extremely bright and overwhelming. The applicant stated that the colors were much softer and not exactly as they appeared in the elevations. The sample 2 materials were said to be a much better example of the exact colors. The applicant stated that the intention was for Charlotte Ear Eye Nose and Throat Associates to occupy the second floor and for the first floor to be available for a separate medical group. Mr. Wolfe asked if the panels were inset, to which the applicant responded that the exterior was not entirely flush. The tan panels and the base would be set about 3 inches back. It was also stated that a canopy would stretch the entire width of the front of the building and along a portion of the sides to protect patrons from the weather when entering and exiting the building. Mr. Traynor asked about the difference between the vision glass and the spandrel glass, to which the applicant responded that it was the same glass but there was a solid behind the spandrel glass. Mr. Lettang asked how the white was going to stay clean, to which the applicant stated that pressure-washing and landscaping would help and that they had not had issues with other buildings that had the same white material. The Commission and applicant agreed that appearance and cleanliness would be of the upmost importance considering the use of the building. Mr. Petty stated that the building had nice detail and unique character. Mr. Hudgins followed by saying the presentation of the material samples were very helpful. Mr. Hudgins made a motion to grant commercial appearance review as submitted. Mr. Wolfe seconded the motion. Mr. Wolfe requested that the motion be amended to include the condition allowing staff to be able to approve minor modifications to the site plan and elevations if needed. The county’s RD-II district allows single-family residences (10,000 sf per dwelling), townhomes (2,000 sf per unit), apartments and condominiums. The district also allows child/adult care centers, religious uses, manufactured home subdivisions, parks, nursing facilities and schools. The RD-II District also requires a minimum open space of 20%. The property is currently vacant. The property was previously annexed into the Town as MXU Mixed Use by Ordinance No. 2016-21. The annexation and MXU approval were conditioned upon the property being transferred to a development group, which ultimately did not occur and thus made the annexation and MXU approval null and void. The prior MXU approval allowed for a continuing care retirement facility with up to 200 age-restricted dwelling units and up to 36,000 square feet of office, retail, and municipal uses. Applicant The applicant intends to develop the property as a Goddard School location Proposal (preschool / daycare use). An application has been made to the Town’s Planning Commission for the purpose of Commercial Appearance Review approval for the proposed +/- 10,000 square foot use. Comprehensive The property is located within an area that has been designated as Plan “Commercial” and “High-Density Residential” on the Town of Fort Mill’s Future Land Use Map, last updated in May 2016. High Density is generally defined as six or more dwelling units per acre, and may include a mix of single- and multi-family development. The property is also located in Node 8. The Comprehensive Plan recommends the following types of development within Node 8: “Development in Node 8 will primarily be higher density residential near the center of the node and along the Fort Mill Southern Bypass, with neighborhood commercial near the intersection of Doby’s Bridge Road and the Bypass, and medium density residential near the periphery including townhomes and apartments, transitions to single family detached homes to the east and south near the river.” 6 Traffic Impact Any development of the property would require a review of the proposed traffic impact as well as a review of the proposed access locations. The review of any proposed development would be coordinated with SCDOT and York County and may require the completion of a full traffic impact analysis (TIA) to determine if off-site transportation improvements would be required to mitigate the development’s impact to the transportation network. Any off-site transportation improvements deemed necessary by the Town, York County, and/or SCDOT would be the responsibility of the developer. Fire Impact The property is located approximately 2 miles (4 minutes) ordinary driving distance from the town’s main fire station on Tom Hall Street and 1 mile from the town’s fire station site on Fort Mill Parkway. Utility Impact The property is located in the town’s service area and would be served by the town’s water and sewer system. As with all other projects, any upgrades necessary to serve the project would be borne by the applicant. The applicant would also be responsible for securing any necessary easements to connect to the town’s existing utility system. School Impact The requested zoning designation of HC Highway Commercial would not allow for residential uses. Therefore, there would be no impact on future school enrollment. Discussion The property is contiguous to the town limits and is, therefore, eligible for annexation. As mentioned previously, the property was previously annexed into the Town as MXU Mixed Use, which entitled the property to up to 200 age-restricted dwelling units and up to 36,000 square feet of commercial. The applicant was working towards approval of the proposed Goddard School under the MXU Mixed Use zoning, however it was discovered by Town staff that the prior 7 ordinances adopted by Town Council for the annexation and MXU plan were null and void based on a sunset provision within the approved ordinances. Therefore, the applicant is now requesting annexation of only that portion of the property that will be utilized for the Goddard School and has requested an HC Highway Commercial zoning designation. The HC Highway Commercial designation is consistent with nearby properties along both North Dobys Bridge Road and Fort Mill Parkway and is generally consistent with the development patterns of the area and the recommendations of the Comprehensive Plan. Based upon the information above, staff recommends in favor of approval of the request for annexation with a designation of HC Highway Commercial. Nothing in this report shall be deemed a guarantee that water and/or sewer service/capacity will be available at the time of development. As noted, any future development may also be subject to a TIA prior to the approval of an encroachment permit. Any improvements deemed necessary as a result of the TIA would be the responsibility of the owner/developer. Alternatives 1. Recommend approval of the annexation ordinance with a zoning designation of HC. 2. Recommend approval of the annexation ordinance with an alternate zoning designation. 3. Blanton, (the “Property Owner”), requesting that a portion of the property currently or formerly known as York County Tax Map Number 738-00-00-045 (formerly York County Tax Map Number 020-12-01-279 as it was known following the annexation approval from Ordinance No. 2016-21) be annexed to and included within the corporate limits of the Town of Fort Mill under the provisions of S.C. Code Section 5-3-150(3); and WHEREAS, the Planning Commission of the Town of Fort Mill, in a duly called meeting on November 20, 2018, reviewed the request and forwarded their recommendation to Town Council; and WHEREAS, a public hearing was advertised and held on November 26, 2018, during a duly called regular meeting of the Town Council of the Town of Fort Mill; and WHEREAS, Section 5-3-150(3) of the Code of Laws of the State of South Carolina, as amended, provides that any area or property which is contiguous to a municipality may be annexed to the municipality by filing with the municipal governing body a petition signed by all persons owning real estate in the area requesting annexation. Upon the agreement of the governing body to accept the petition and annex the area, and the enactment of an ordinance declaring the area annexed to the municipality, the annexation is complete; and WHEREAS, using the definition of “contiguous” as outlined in S.C. Code Section 5-3-305, the Town Council has determined that the above referenced property is contiguous to property that was previously annexed into the corporate limits of the Town of Fort Mill; and WHEREAS, the Town Council has determined that annexation would be in the best interest of both the property owners and the Town of Fort Mill; NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Fort Mill in Council assembled: SECTION I. Annexation. It is hereby declared by the Town Council of the Town of Fort Mill, in Council assembled, that the incorporated limits of the Town of Fort Mill shall be extended so as to include, annex and make a part of said Town, the described area of territory above referred to, being more or less 4.1 acres, the same being fully described in Exhibit “A” attached hereto, and contiguous to land already within the Town of Fort Mill. Pursuant to S.C. Code Section 5-3-110, this annexation shall include the whole or any part of any street, roadway, or highway abutting the above referenced 14 property, not exceeding the width thereof, provided such street, roadway or highway has been accepted for and is under permanent public maintenance by the Town of Fort Mill, York County, or the South Carolina Department of Transportation. SECTION II. Zoning Classification of Annexed Property. The above-described property, upon annexation into the corporate limits of the Town of Fort Mill, shall be zoned, as follows: HC Highway Commercial. SECTION III. Voting District. For the purpose of municipal elections, the above-described property, upon annexation into the incorporated limits of the Town of Fort Mill, shall be assigned to and made a part of Ward Four (4). SECTION IV. Notification. Notice of the annexation of the above-described area and the inclusion thereof within the incorporated limits of the Town of Fort Mill shall forthwith be filed with the Secretary of State of South Carolina (SCSOS), the South Carolina Department of Public Safety (SCDPS), and the South Carolina Department of Transportation (SCDOT), pursuant to S.C. Code § 5-3- 90(E). SECTION V. Severability.
