Page 2|2 Fort Mill Town Council Meeting Minutes Monday August 28, 2023 5:30 p.m. Council Chambers 112 Confederate Street Fort Mill, SC 29715 PRESENT: Mayor Savage, Councilwoman Cook, Councilman Helms, Councilman Wolfe, Councilman Moody, Councilman Garrison and Councilman Hudgins were present. CALL TO ORDER Mayor Savage called the meeting to order at 5:30 p.m. She stated that Executive Session is usually held at the end of the meeting but in order to meet the availability of the parties involved with tonight’s Executive Session discussions, it was needed to have it at the beginning of this meeting. PLEDGE OF ALLEGIANCE INVOCATION Councilman Helms provided the invocation. EXCUTIVE SESSION Please Note: Council may take action on Executive Session Items listed on the agenda when they come back into Public Session. Executive Session Item #1 Discussion incident to proposed contractual matter between the Town of Fort Mill and Lennar Carolinas LLC. Executive Session Item #2 Receipt of legal advice relating to potential claims and ongoing legal matters. Executive Session Item #3 Discussions incident to personnel matters. Page 1|4 Councilman Helms made a MOTION to into Executive Session. SECONDED by Councilman Garrison. Passed 7-0. Council went into Executive Session at 5:32 p.m. Councilman Helms made a MOTION to come out of Executive Session. SECONDED by Councilman Wolfe. Passed 7-0. Council came out of Executive Session at 6:55 p.m. Ben Hudgins made a MOTION to direct staff to discontinue further consideration of proposed Municipal Improvement District with Lennar. SECONDED by Councilman Wolfe. Passed 7-0. MINUTES August 8, 2023, Council Workshop August 9, 2023, Council Workshop August 14, 2023, Council Meeting August 17, 2023, Council Budget Workshop Councilman Helms made a MOTION to approve the minutes of the August 8, 2023, August 9, 2023, August 14, 2023, and August 17, 2023, council meetings. SECONDED by Councilman Garrison. Passed 7-0. PRESENTATIONS Presentation #1 Mobility Study Grant Fort Mill Economic Partners gave a presentation on a Mobility Study Grant: Reconnecting Communities Grant Program Page 2|4 ● Department of Transportation grant program with funds to support planning, technical assistance, and capital construction that helps to restore community connectivity. ● This would be submitted with the help of a grant writer on behalf of Town of Fort Mill ● Grant is due on September 28, 2023 Downtown Mobility Master Plan ● Purpose of the plan: ○ Evaluate the current and future multimodal needs of Downtown ○ Evaluate pedestrian and bicycle infrastructure and how it is connected to parking areas, downtown destinations and surrounding neighborhoods ○ Evaluate the current parking capacity and an analysis of current and future parking needs ○ Provide design solutions and recommendations ○ Project prioritization and cost estimating Estimated Cost ● Estimated cost for professional planning and engineering firm to complete the study will be $200,000. Town of Fort Mill Responsibility ● If awarded the grant, The Town would be required to provide a 20% match, (estimated $40,000) with the remaining 80% ($160,000) being reimbursed under federal grant program Partnership Opportunity ● FMEP has offered to partner with the Town ○ FMEP will provide $5,000 to cover the cost of the professional grant writer ○ FMEP will provide the Town with the 20% match required, not to exceed $40,000 ● If Town is awarded grant and agrees to FMEP partnership, there would be no monetary impact Requesting: ● Town Approval: ○ to move forward with Downtown Mobility Planning ○ to partner with FMEP for funding. ○ to proceed with Grant Application through the Grant Writer secured by FMEP. Chris Pettit stated that this resolution is for Council’s approval for the Town’s portion toward the Mobility Study Grant with Fort Mill Economic Partners as presented earlier in the meeting. Councilwoman Cook made a MOTION to approve this resolution. SECONDED by Councilman Helms. Passed 7-0. INFORMATION/DISCUSSION Information/Discussion Item #1 Discussion of proposed 2023/2024 FY budget. Chris Pettit went over information and asked questions to aid with the finalization of the 2023-2024 FY budget. ADJOURN Councilman Garrison made a MOTION to adjourn. SECONDED by Councilman Helms. Passed 7-0. White Street, on Saturday, September 23, 2023, 6 P.M. until 9:45 P.M. as the site of a public event in which alcoholic beverages may be sold, possessed, and consumed, and to authorize a special event permit for live music and sound amplifying equipment on Saturday, September 23, 2023, 6 P.M. until 9:45 P.M. at Walter Elisha Park, 345 N. White Street. Pursuant to Sec. 24-30(b)(2) of the Code of Ordinances for the Town of Fort Mill, the council is asked to consider a request from Jacona Hester, Events Coordinator, at Walter Elisha Park, 345 N. White Street, on Saturday, September 23, 2023, 6 P.M. until 9:45 P.M. as the site of a public event in which alcoholic beverages may be sold, possessed, and consumed. This request would allow for an exception from the public consumption ordinance on Saturday, September 23, 2023. With Council’s approval, alcohol sales, possession and consumption would be permitted between 6 P.M. until 9:45 P.M. on Saturday, September 23, 2023. Alcohol Sales will be managed by Amor Artis, Hobo’s and Illumination Wines of Fort Mill. Fort Mill History Museum volunteers staff the ID Tent for ID checks, wristbands and sales for the event. Alcohol sales will be cut off 30 minutes before event concludes. The process of selling would be: ID checks, wrist bands, beer/wine tickets, and zero-tolerance enforcement. Pursuant to Sec. 24-34(c)(2)(l) of the Code of Ordinances for the Town of Fort Mill, the council is also asked to consider a request to authorize a special event permit for live music and sound amplifying equipment on Saturday, September 23, 2023, 6 P.M. until 9:45 P.M. The town’s noise ordinance allows council to grant permits to “responsible organizations to broadcast programs of music, speeches or general entertainment as a part and in recognition of a community celebration of national, state or town events, public festivals, or outstanding events of a noncommercial character, provided that traffic on the streets is not obstructed by reason thereof and adequate provisions will be made to minimize the disturbance to neighboring residential areas.” Staff will be available during the meeting to answer any questions that council may have regarding either of these items. Recommendation It is recommended that council approve the request. STATE OF SOUTH CAROLINA TOWN OF FORT MILL A RESOLUTION DESIGNATING WALTER ELISHA PARK, 345 N. AS THE SITE OF A PUBLIC EVENT IN WHICH ALCOHOLIC BEVERAGES MAY BE SOLD, POSSESSED, AND CONSUMED, AND TO AUTHORIZE A SPECIAL EVENT PERMIT FOR LIVE MUSIC AND SOUND AMPLIFYING EQUIPMENT FOR SATURDAY, SEPTEMBER 23, 2023, 6 P.M. UNTIL 9:45 P.M. AT WALTER ELISHA PARK, 345 N. WHITE STREET. WHEREAS, Sec. 24-30 of the Code of Ordinances of the Town of Fort Mill Sec. 24-30. Display, consumption of beer, wine or other alcoholic beverages in public. It shall be unlawful to openly display or consume any beer or wine or other alcoholic beverage in or from any container on any public street or sidewalk, in any public parking areas, parks, recreation areas, or at any public gathering place excluding the following: i.Private businesses; ii.Any areas as designated and approved in a Special Event Permit issued by the Town of Fort Mill. a. This section is not intended to be in conflict with and will not be in conflict with any state laws regulating the consumption of sealed, licensed liquors. b. The application of this section shall in no way affect the enforcement or prosecution of violations of Section 24-26. - Breach of peace; disorderly conduct; obscenity; drunkenness; indecent or dangerous conduct, or any other Town Ordinances or State Law. c. Any person found to be guilty of violating the terms of this section shall, upon conviction be punished in accordance with Section 1-6. WHEREAS, Sec. 24-34(c)(2)(l) of the Code of Ordinances for the Town of Fort Mill generally prohibits loud, disturbing and unnecessary noise from sound amplifying devices; however, the council may grant a special event permit to responsible organizations to broadcast programs of music, speeches or general entertainment as a part and in recognition of a community celebration of national, state or town events, public festivals, or outstanding events of a noncommercial character, provided that traffic on the streets is not obstructed by reason thereof and adequate provisions will be made to minimize the disturbance to neighboring residential areas; and WHEREAS, the 2023 Decades Night (Music & Movie) scheduled to take place on Saturday, September 23, 2023, 6 P.M. until 9:45 P.M. in Walter Elisha Park, 345 N. White Street WHEREAS, the Town Council has determined that the applicant has proposed and will take the necessary precautions to protect public safety and minimize the impact of unreasonable noise to surrounding residences; NOW THEREFORE BE IT RESOLVED, that the Mayor and Town Council for the Town of Fort Mill does hereby designate Walter Elisha Park, 345 N. White Street, on Saturday, September 23, 2023, 6 P.M. until 9:45 P.M. as the site of a public event in which alcoholic beverages may be sold, possessed and consumed. Pursuant to Sec. 24-30(b)(2) of the Code of Ordinances for the Town of Fort Mill, the Council is asked to consider a request from Events Coordinator, Jacona Hester, to designate Main Street (Tom Hall Street to Academy Street-Barricade Zone), as the site of a public event at which alcoholic beverages may be sold, possessed, and consumed. This request would allow for an exception from the public consumption ordinance on these weekends only on Fridays at 3 p.m. through Sundays at 10 p.m., October 6-8 and October 20-22, 2023. With council’s approval, alcohol sales, possession and consumption would be permitted between 3 p.m. on Fridays until 10 p.m. on Sundays, during normal business hours, these weekends only, October 6-8 and October 20-22, 2023. Main Street Merchants will be responsible for alcohol sales under their current alcohol licenses and permits. Pursuant to Sec. 24-34(c)(2)(l) of the Code of Ordinances for the Town of Fort Mill, the Council is also asked to consider a request to authorize a special event permit for live music and sound amplifying on these weekends only on Fridays at 3 p.m. through Sundays at 10 p.m., October 6-8 and October 20-22, 2023. The town’s noise ordinance allows council to grant permits to “responsible organizations to broadcast programs of music, speeches or general entertainment as a part and in recognition of a community celebration of national, state or town events, public festivals, or outstanding events of a noncommercial character, provided that traffic on the streets is not obstructed by reason thereof and adequate provisions will be made to minimize the disturbance to neighboring residential areas.” Weekends on Main proposes to offer musical selections on Main Street. Staff will be available during the meeting to answer any questions that council may have regarding this item. Recommendation It is recommended that council approve the request. The proposed budget, with proposed estimated revenue for payment thereof, as prepared and as contained in and shown by an archived copy on file in the office of the Town Clerk, and available for public inspection, which copy is incorporated herein by reference, is hereby adopted and made a part hereof. The budget as shown therein is balanced as to receipts and disbursements in the total sum of $73,638,060. The same shall constitute the official annual budget of the Town of Fort Mill for Fiscal Year 2023-24. SECTION II. To facilitate operations, there shall be established and maintained a General Fund, a Gross Revenue Fund, a Stormwater Utility Fund, a Capital Projects Fund, and other appropriate funds, in such amounts as are provided for in the budget aforesaid, as hereby adopted or as hereafter modified pursuant to law. SECTION III. To achieve the goals of the budget, the Town Manager is hereby authorized to transfer any sum from one budget line item to another, or from one department or division to another department or division; provided, however, that no such transfer shall (a) be made from one fund to another fund established pursuant to Section II above, (b) conflict with any existing Bond Ordinance, or (c) conflict with any previously adopted policy of the Town Council. Any change in the budget which would increase or decrease the total of all authorized expenditures must be approved by the Town Council. SECTION IV. Funds obtained from any sources may be used for any of the appropriations named in said budget; however, this provision shall not apply to funds that are specifically restricted by this ordinance, the Code of Ordinances for the Town of Fort Mill, or the South Carolina Code of Laws. Funds appropriated or created by the budget in excess of estimated amounts may be administered by Council by resolution. SECTION V. The Fiscal Year 2023-24 budget includes a transfer in the amount of $150,000.00 from the Hospitality Tax Fund to the General Fund. The expenditure of these funds within the General Fund budget shall be restricted to “tourism related expenditures” as defined by Section 6-1-730 of the South Carolina Code of Laws. SECTION VI. The Town of Fort Mill’s annual “Millage Rate Increase Limitation” for Fiscal Year 2023-24, as calculated by the South Carolina Office of Revenue and Fiscal Affairs, shall be 18.68% (14.79 Mills). Pursuant to Section 6-1-320(A)(2) of the South Carolina Code of Laws, to this amount may be added any unused millage increase from Fiscal Years 2020-21 (10.87 Mills), 2021-22 (9.68 Mills) and 2022-23 (8.30 Mills), for a maximum allowable millage increase of 43.65 Mills in Fiscal Year 2023-24. Of this amount, the Town Council has elected to use 6.5 Mills in Fiscal Year 2023-24. In accordance with state law, the unused increase from Fiscal Year 2023-24, combined with any remaining unused (or “banked”) increases from Fiscal Years 2021-22 and 2022-23, shall be reserved and made available for use in Fiscal Year 2024-25, at the discretion of the Town Council. STATE OF SOUTH CAROLINA TOWN COUNCIL FOR THE TOWN OF FORT MILL ORDINANCE NO. 2023-__ AN ORDINANCE TO RAISE REVENUE BY SETTING THE TAX MILLAGE FOR THE TOWN OF FORT MILL, SOUTH CAROLINA FOR THE TAX YEAR ENDING DECEMBER 31, 2023, AND FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2024. WHEREAS, Section 5-7-260(3) of the South Carolina Code of Laws requires that a municipal council shall act by ordinance to levy taxes pursuant to public notice; NOW THEREFORE, BE IT ORDAINED by the Governing Body of the Town of Fort Mill, in Council duly assembled and by the authority of the same that: SECTION I. A tax in the amount of 85.7 mills or ($.0857 per $1,000) upon every dollar of assessed value of taxable real estate and personal property of every description owned and used in the Town of Fort Mill, South Carolina, except such as is exempt from taxation under the Constitution and Laws of the State of South Carolina, is and shall be levied and paid into the Town Treasury for the credit of the Town of Fort Mill for its corporate purposes, permanent improvements and for the purpose of paying current expenses of said municipality. The tax levied pursuant to this section shall cover the tax period from the first day of January 2023, to the 31st day of December 2023, both inclusive, and the fiscal year period from October 1, 2023, to September 30, 2024, both inclusive. Such tax is levied on such property as is assessed for taxation by the York County Tax Assessor’s Office. SECTION II. The taxes levied pursuant to Section I shall be collected by the York County Treasurer, on behalf of the Town of Fort Mill, pursuant to Title 12, Chapter 45 of the S.C. Code of Laws. The billing dates, penalty dates and penalty amounts which shall be levied for delinquent taxes shall be as provided in Section 12-45-180 of the S.C. Code of Laws. SECTION III. If the taxes, assessments, and penalties levied in Sections I and II are not paid before the seventeenth day of March, the York County Treasurer shall issue his tax execution to the officer authorized and directed to collect delinquent taxes, assessments, penalties, and costs for their collection as provided in Title 12, Chapter 51 of the S.C. Code of Laws, and any unpaid taxes, assessments, penalties and execution costs shall be collected as required by that chapter. SECTION IV. Severability. If any section, subsection, paragraph, clause, or provision of this ordinance shall be deemed to be unconstitutional, unenforceable, or otherwise invalid by the final decision of a court of competent jurisdiction, the validity of the remaining sections, subsections, paragraphs, clauses, or provisions shall not be affected thereby. SECTION V. Conflicting Ordinances. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
