Fort Mill Town Council Meeting Minutes Monday November 27, 2023 6:00 p.m. Council Chambers 112 Confederate Street Fort Mill, SC 29715 PRESENT: Mayor Savage, Councilman Helms, Councilman Wolfe, Councilman Moody, Councilman Garrison, Councilman Hudgins, and Councilwoman Cook were present. CALL TO ORDER PLEDGE OF ALLEGIANCE INVOCATION Councilman Helms provided the invocation. MINUTES November 13, 2023, Council Meeting Councilman Helms made the MOTION to approve the minutes. SECONDED by Councilman Wolfe. Passed 7-0. PUBLIC COMMENT Pursuant to Section 2-46 of the Code of Ordinances for the Town of Fort Mill, any citizen of the Town may appear before council for the purpose of providing public comments on any municipal matter (except personnel matters). Those who wish to speak must sign in outside of Council Chambers prior to the start of the meeting. Citizens will be given 3 minutes each to speak. There were no speakers signed up for public comment. PRESENTATIONS Presentation #1 Swearing in ceremony of Tylee Tracer-Anderson as Associate Judge – Judge Okoye Page 1|4  Judge Okoye swore in Tylee Tracer-Anderson as Associate Judge for the Town of Fort Mill. Presentation #2 Christmas Events – Jacona Hester • Fort Mill Christmas Village & Lighting of the Tree • Fort Mill Christmas Parade • Main Street Closures Events Coordinator Jacona Hester provided an overview of the upcoming events. EXECUTIVE SESSION Councilman Wolfe made a MOTION to go into executive session. SECONDED by Councilman Garrison. Passed 7-0. Executive Session Item #1 Discussion incident to proposed contractual matters with Crossroads Development Partners, LLC Councilman Wolfe made a MOTION to return from executive session. SECONDED by Councilman Garrison. Passed 7-0. Mayor Savage noted that no vote was taken in executive session. OLD BUSINESS Old Business Item #1 Second Reading of an ordinance further amending ordinance no. 2021-22 so as to change the effective date for the rezoning of York County tax map numbers 020-17-01- 064 and 020-17-01-065 from PND, Planned Neighborhood Development to MXU, Mixed-Use Development. – Penelope Karagounis Councilman Wolfe made a MOTION to deny seconded reading. SECONDED by Councilman Moody. Passed 5-2, Councilman Garrison and Councilwoman Cook opposed. Old Business Item #2 Second Reading of an ordinance further amending Ordinance No. 2021-24 so as to change the effective date of the ordinance authorizing the entry by the Town of Fort Mill into a development agreement with Crossroads Development Partners, LLC, a North Carolina limited liability company, J. Max Hinson, LLC; Max Hinson, Jr; J. Max Hinson, III; Marshall Odell Hinson; J. Max Hinson, Jr., as custodian for Adam Jason Hinson; Raynold Lee Saar and Christy Lee Saar; Lynnell Simmons Bailey, Judith Alesia Kimbrell, James Wayne Lancaster, Ronald Allen Vogel, John W. Maye, Sr., Brenda B. Tyson and Ronald H. Bailey; Christopher Robert Blanton, Vonnie James Blanton and Kenneth Dwayne Page 2|4  Blanton and Thomas G. Haire for properties located at York County tax map numbers 020- 17-01-064, 020-17-01-065, 738-00-00-059, portion of 738-00-00-094, 738-00-00-077, and 738-00-00-046; and authorizing execution and delivery of an amended agreement. – Penelope Karagounis Councilman Wolfe made a MOTION to deny seconded reading. SECONDED by Councilman Moody. Passed 6-1, Councilman Garrison opposed. Old Business Item #3 Second Reading of an ordinance further amending Ordinance No. 2021-25 so as to change the effective date for the annexation of York County tax map numbers 738-00-00-059, portion of 738-00-00-094, 738-00-00-077, and 738-00-00-046 containing approximately 36.71 +/- acres located on Fort Mill Parkway and off of Haire Road. – Penelope Karagounis Councilman Hudgins made a MOTION to deny seconded reading. SECONDED by Councilman Wolfe. Passed 6-1, Councilman Garrison opposed. Old Business Item #4 First Reading of an ordinance annexing York County Tax Map Numbers 738-00-00-063 and a portion of 738-00-00-062 containing approximately 5.25 +/- acres located at the intersection of Fort Mill Parkway and Holbrook Road – Ward 4: Chris Moody – Penelope Karagounis Councilwoman Cook made a MOTION to defer first reading to the January 8, 2024 Council meeting. SECONDED by Councilman Wolfe. Passed 7-0. NEW BUSINESS New Business Item #1 A resolution to designate Main Street (Tom Hall Street to Academy Street-Barricade Zone) as the site of a public event in which alcoholic beverages may be sold, possessed, and consumed and to authorize a special event permit for live music and sound amplifying equipment on Thursday, November 30, 2023, from 3 p.m. until 9 p.m. and Saturday, December 2, 2023, from 1 p.m. until 10 p.m. – Jacona Hester Councilman Hudgins made a MOTION to approve. SECONDED by Councilman Garrison. Passed 7-0. New Business Item #2 Consideration of 2024 events and an update to the Town’s Event Policy – Chris Pettit Interim Town Manager Chris Pettit discussed with Council a plan to pause private special events (those not having any partnership with the Town) for 2024 to allow staff time to update all policies relating to special events in order to maintain the Page 3|4  safety and quality of events within the Town. Councilman Wolfe made a MOTION to pause all private special events using staff for logistical and/or safety support until new policies were developed. SECONDED by Councilman Garrison. Passed 7-0. COMMITTEE REPORTS Committee Report #1 Report from the November 14, 2023 Finance Committee meeting and review and consideration of adoption of financial policy updates – Eric Davis Assistant Town Manager Eric Davis discussed a number of financial policy updates that were recently reviewed and recommended for approval by the Council’s Finance Committee. Councilwoman Cook made a MOTION to approve the policies as presented. SECONDED by Councilman Helms. Passed 7-0. INFORMATION/DISCUSSION There are no Information/Discussion Items. EXECUTIVE SESSION Councilman Helms made a MOTION to go into executive session. SECONDED by Councilman Garrison. Passed 7-0. Executive Session Item #2 Receipt of legal advice relating to potential claims and ongoing legal matters Councilman Garrison made a MOTION to return from executive session. SECONDED by Councilman Helms. Passed 7-0. Mayor Savage noted that no vote was taken in executive session. ADJOURN Councilman Wolfe made a MOTION to adjourn. SECONDED by Councilman Moody. Passed 7-0.
