FRYE, JR., WARD FOUR Fredericksburg, Virginia 22401 April 10, 2018 The Council of the City of Fredericksburg, Virginia, held a public hearing on Tuesday, April 10, 2018, beginning at 7:31 p.m. in the Council Chambers of City Hall. City Council Present. Mayor Mary Katherine Greenlaw, Vice-Mayor William C. Withers, Jr. and Council members Kerry P. Devine, Dr. Timothy P. Duffy, Bradford C. Ellis, Charlie L. Frye, Jr. and Matthew J. Kelly. Also Present. City Manager Timothy J. Baroody, Assistant City Manager Mark Whitley, Assistant City Manager Doug Fawcett, City Attorney Kathleen Dooley, Economic Development Director Bill Freehling, Visitor Center Manager Danelle Rose and Clerk of Council Tonya B. Lacey. Notice of Public Hearings (D18-122). The Clerk read the notice of the public hearings as they appeared in the local newspaper, the purpose being to solicit citizen input. Ordinance 18-06, First Read Approved, Approving a Non- Exclusive Franchise to Olde Skool Tours, LLC, to Provide Pedal Cycle Tours of Fredericksburg (D18-122). no speakers. After staff presentation Council had a few questions for the applicant. Vice-Mayor Withers asked if there were plans to stop at historic sites within the City and Ms. Tanya Ison said they were planning to make stops 19919 Public Hearing 04/10/18 and allow the guest to go inside and visit. She said she was currently working with the James Monroe Museum to have President Monroe ride with them. Councilor Devine asked if they planned on adding additional places on the tour and Ms. Ison said she was planning to do that but she wanted to get a good foundation first before she added more stops. Councilor Devine also asked for clarification on a previous franchise that was approved but never came to fruition and City Attorney Dooley said that franchise was no longer valid. Councilor Duffy asked how they planned to handle patrons that may act inappropriately and Ms. Ison said they have safety precautions in place such as limiting the drinks to one per location. Councilor Devine also expressed her concern for disruption of church services and Ms. Ison assured her they would be respectful of those services. Vice-Mayor Withers made a motion to approve Ordinance 18-06, on first read, approving a non-exclusive franchise to Olde Skool Tours, LLC, to provide Pedal Cycle Tours of Fredericksburg; motion was seconded by Councilor Devine and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays (0). Adjournment. City Council Present. Mayor Mary Katherine Greenlaw, Vice-Mayor William C. Withers, Jr. and Council members Kerry P. Devine, Dr. Timothy P. Duffy, Bradford C. Ellis, Charlie L. Frye, Jr. and Matthew J. Kelly. Also Present. City Manager Timothy J. Baroody, Assistant City Manager Mark Whitley, Assistant City Manager Doug Fawcett, City Attorney Kathleen Dooley, Economic Development Director Bill Freehling, Visitor Center Manager Danelle Rose and Clerk of Council Tonya B. Lacey. Opening Prayer and Pledge of Allegiance. Council was led in prayer by Councilor Matthew J. Kelly followed by the Pledge of Allegiance led by Mayor Mary Katherine Greenlaw. Officer Recognized. Mayor Greenlaw recognized the presence of Officer Melanie Schwartz at this evening’s meeting. Public Hearings (D18-122). The regular session was recessed in order to conduct the scheduled public hearings and immediately reconvened upon their conclusion. Citizen Comment. The following speaker participated in the citizen comment portion of this evening’s meeting. 19921 Regular Session 04/10/18 Aileen Heim – 1600 Franklin Street, spoke in regards to three sewer back-ups that had occurred within the past year. She stated that it was a neighborhood problem and it has been caused by several problems. Ms. Heim asked the City not to take the passive action of waiting, she asked that the City take more affirmative actions. Julie Kay – 1616 Franklin Street, also spoke in regards to the sewer back-ups. She said she had lost a lot of furniture and it took three, 12 hour days to clean up the mess. She asked the City to figure out what was causing the issue. Council Agenda Presented. The following items were presented to Council for discussion. 7A. Report from Public Works on Sewer Back-ups – Vice-Mayor Withers 7B. Budget Items – Councilor Kelly Report from Public Works on Sewer Back-ups – Vice-Mayor Withers asked Public Works Director King to explain what the City has done and was continuing to do to mitigate the back up. Mr. King explained that he was also a resident of the City and he took ownership in the sewer system. He said the three back-ups were caused by bricks that had fallen into the system and he said they realigned the line to prevent this from happening again. The next back-up was caused by a significant rainstorm which surcharged the system and caused a spike in the runoff water that came from the College Heights area. Since this rainstorm Mr. King said they moved the monitors in the system to the College Heights area to investigate that area of the system to determine where the flow was coming from. Mr. King explained that the last back-up was caused from a chunk of grease that had gotten into the system in the same area. Staff went to a few restaurants to inspect their grease traps and all were working properly. He said staff would continue checking restaurants to determine where the grease 19922 Regular Session 04/10/18 could be coming from. Mr. King said after the grease blockage they cleaned the entire line and they would check the line weekly and would assign quarterly cleanings of the line. He said they were doing everything possible to determine the cause of the back-ups. Council asked how long the flooding had been going on in the area and Assistant City Manager Fawcett said there were some issued several years ago but it had not happened three times in several years. He said there had been some issues from time to time in the last 15 years but nothing like the current problems. Budget Items – Councilor Kelly asked staff to present options for fully funding the City schools and a third EMS position. He said he would like to see the costs five years out to fully fund Fire, EMS, and Police. He said he would also like to show the public what it means to fully fund some of these items. Councilor Kelly also requested the cost for the Gateway Boulevard extension. City Manager’s Consent Agenda Accepted for Transmittal as Recommended (D18-123 thru D18-124). Councilor Kelly moved approval of the City Manager’s consent agenda items; motion was seconded by Councilor Devine and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays (0). • Virginia Municipal League Policy Committee Nominations (D18-123). • Transmittal of Board and Commission Minutes o Fredericksburg Clean and Green Commission – March 5, 2018 (D18-124). Adoption of Minutes (D18-125 thru D18-126). Councilor Frye moved approval of the February 13, 2018 and February 20, 2018 Work Session minutes and March 27, 2018 Public Hearing and Regular Session minutes; motion was seconded by Councilor 19923 Regular Session 04/10/18 Devine and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays (0). Resolution 18-36, Approved, Setting the Personal Property Tax Relief Percentage for the 2018 Billing in Accordance with the Changes to the Personal Property Tax Relief Act of 1998 (D18-127). Staff gave a brief summary and Councilor Kelly made a motion to approve Resolution 18-36, setting the Personal Property Tax Relief Percentage for the 2018 billing in accordance with the changes to the Personal Property Tax Relief Act of 1998; motion was seconded by Vice-Mayor Withers and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays (0). City Manager’s Report and Council Calendar (D18-128 thru D18- 129). City Manager Baroody reviewed the Manager’s report and Council Calendar. Activities highlighted on the report were as follows: Temporary Road Closure, Focus Group Discussion, Revised Pathways Plan Public Comment Period, Facebook Followers Drawing, Fiscal Year 2019 Budget Work Sessions and New Recycling Containers Installed.
