City Council Present. Mayor Kerry P. Devine. Vice-Mayor Charlie L. Frye, Jr., Council members Dr. Timothy P. Duffy, Jonathan A. Gerlach, Jason N. Graham, Jannan W. Holmes and Dr. Will B. Mackintosh. Others Present. City Manager Timothy J. Baroody, Assistant City Manager Mark Whitley, City Attorney Kathleen Dooley, Assistant Tourism Director Margaret Morris, Planning and Building Services Director Charles Johnston, Public Information Officer Sonja Cantu, Budget Analyst Donna Leahy, and Clerk of Council Tonya B. Lacey. Opening Prayer and Pledge of Allegiance. Council was led in prayer by Vice-Mayor Charlie L. Frye, Jr. followed by the Pledge of Allegiance led by Councilor Jason N. Graham. Officer Recognized. Mayor Devine recognized the presence of Officer Paul Dooley at this evening’s meeting. Proclamation for Brightening the Holidays at Hurkamp (D24-06). Mayor Devine applauded Bill Monteleone, Greenchip, Inc., Anita Crossfield, and all 22029 Regular Session 01/09/24 those who helped brighten Hurkamp Park over the holidays. She expressed gratitude for the initiative on behalf of all those who enjoyed the beautiful holiday experience in Fredericksburg. Proclamation for Huntley Day (D24-07). Mayor Devine proclaimed January 21, 2024 as “Huntley Day” in Fredericksburg. She honored his impressive perseverance and dedication to his profession, she congratulated his national recognition on the Voice as an important achievement, she wished him much future success in his musical career, and she honored his place among Fredericksburg’s musicians, singers and contributors to the music industry. Councilor Duffy moved approval of the City Manager’s consent agenda; motion was seconded by Councilor Gerlach and passed by the following recorded votes. Ayes (7). Citizen Comment. There were no comments given and/or submitted to be read during the citizen comment portion of this evening’s meeting. Council Agenda Presented. The following items were presented to Council for discussion. 8A. Redevelopment – Councilor Graham Redevelopment. Councilor Graham stated that he had been thinking about redevelopment of strip malls along Route 1 and Route 3. He noted that the redevelopment would be expensive for developers because of the many steps to be taken. He said if the City was serious about this type of development it was incumbent of Council and staff to look at what the redevelopment should look like. He wanted to know how this redevelopment could occur without the developers having to go through the Special Use Permit process. Councilor Graham requested with Council’s approval that staff look into developing an administrative process for redeveloping existing shopping centers with a vast surface level parking lots. He noted that Carmel, Indiana had done a lot of work in this regard, and they have used Tax Increment Financing (TIF). The TIF was used to finance the underground parking and the rest of the property was left economically viable to drive tax revenues. Councilor Duffy noted that this was needed in the City and he agreed it should be made easy to make this happen. 22031 Regular Session 01/09/24 Councilor Gerlach was also interested in seeing this but he asked if staff had the time to put towards this project. Mr. Baroody said they would make time and it was the kind of work that needed to be done, but he asked that staff be given time to work on it. Mayor Devine said these corridors have been looked at as redevelopment opportunities and challenges and she would like to see some solutions. Councilor Mackintosh said it was a great idea and the better job the City does with articulating its vision and setting up processes, the easier it will be to execute the vision. Councilor Frye was in support of having staff look into this and he noted that if the vision is shared it would take the strain off of everyone. Adoption of Minutes. Councilor Duffy moved approval of the December 12, 2023 Public Hearing and Regular Session minutes and the January 2, 2024 Special Session Minutes; motion was seconded by Councilor Frye and passed by the following recorded votes. Ayes (7). Councilors Devine, Frye, Duffy, Gerlach, Graham, Holmes and Mackintosh. Nays (0). Appointments of City Council to Various Boards and Commissions (D24-15). The following appointments were made: • Board of Social Services – Upon a motion, Councilor Holmes moved to appoint Councilor Duffy to the Board of Social Services; the motion was seconded by Vice-Mayor Frye and passed by the following unanimously recorded votes. Nays (0). 22032 Regular Session 01/09/24 • Central Rappahannock Regional Library Board of Trustees – Upon a motion, Councilor Gerlach moved to appoint Councilor Devine to the Central Rappahannock Regional Library Board of Trustees; the motion was seconded by Councilor Duffy and passed by the following unanimously recorded votes. Nays (0). • Community Policy & Management Team for Youth & Family Services – Upon a motion Councilor Duffy moved to appoint Councilor Holmes to the Community Policy & Management Team for Youth & Family Services and Mr. Mark Whitley as the alternate; the motion was seconded by Vice-Mayor Frye and passed by the following unanimously recorded votes. Nays (0). • Fredericksburg Area Museum - Upon a motion, Councilor Frye moved to appoint Councilor Gerlach to the Fredericksburg Area Museum & Cultural Center Board of Directors; the motion was seconded by Councilor Macintosh and passed by the following unanimously recorded votes. Nays (0). • Town and Gown Committee - Upon a motion, Vice-Mayor Frye moved to appoint Councilors Duffy and Gerlach to serve on the Town and Gown Committee; the motion was seconded by Councilor Graham and passed by the following unanimously recorded votes. Nays (0). • Virginia Railway Express Operations Board – Upon a motion, Councilor Graham moved to appoint Councilors Holmes and Mackintosh (alternate) to 22037 Regular Session 01/09/24 the Virginia Railway Express Operations Board; the motion was seconded by Vice-Mayor Frye and passed by the following unanimously recorded votes. Nays (0). • City/School Joint Leadership Group - Upon a motion, Councilor Holmes moved to appoint Councilors Frye and Mackintosh to the City/School Joint Leadership Group; the motion was seconded by Councilor Gerlach and passed by the following unanimously recorded votes. Resolution 24-02, Approved, Appointing Jannan Holmes and Will Macintosh the Potomac and Rappahannock Transportation Commission and the Virginia Railway Express Board. Upon a motion Councilor Graham moved to approve Resolution 24-02, appointing Jannan Holmes and Will Macintosh to the Potomac and Rappahannock Transportation Commission and the Virginia Railway Express Board; motion was seconded by Vice-Mayor Frye and passed by the following unanimously recorded votes. Ayes (7). Councilors Devine, Frye, Duffy, Gerlach, Graham, Holmes and Mackintosh. Nays (0). Planning Commission Appointments (two appointments – Dugan Caswell, Carey Whitehead (D24-16). After the recorded vote was taken, Dugan Caswell was appointed to serve on the Planning Commission with a vote resulting between applicants Dugan Caswell, Michael Kasey, Jane MacDonald, Christopher 22038 Regular Session 01/09/24 Schmidt, Carey Whitehead, Joseph Winterer. Due to the tie between Ms. Whitehead and Mr. Winterer the Council took another recorded vote between the two candidates and Carey Whitehead was appointed: Whitehead (4) Devine, Duffy, Holmes, Mackintosh; Winterer (3) Frye, Gerlach, Graham. Resolution 24-03, Approved, Amending the Fiscal Year 2024 Budget to Appropriate Funds for the Repair of the Doris E. Buffett Pool (D24-17). After staff presentation Councilor Graham moved to approve Resolution 24-03, amending the Fiscal Year 2024 budget to appropriate funds for the repair of the Doris E. Buffett Pool; motion was seconded by Vice-Mayor Frye and passed by the following recorded votes. Ayes (7). Councilors Devine, Frye, Duffy, Gerlach, Graham, Holmes and Mackintosh. Nays (0).
