MINUTES PLANNING COMMISSION REGULAR MEETING OCTOBER 21, 2013 – 5:00 P.M. CITY COUNCIL CHAMBERS PRESENT: Chairman Sookram, Members Emanuel, Fagan, Fooken, Ridder, Sawyer and Wiese, Planning Director Rian Harkins and Chief Building Inspector Don Simons ABSENT: Members Barton and Winter Chairman Sookram called the meeting to order. Roll Call Vote was taken – 7 present. Chairman Sookram read a statement that this meeting was preceded by publicized notice in the Fremont Tribune and the agenda displayed in the lobby of the Municipal Building and posted online at www.fremontne.gov; and distributed to the Planning Commission, Mayor and City Council on October 16, 2013 and is open to the public. Chairman Sookram also stated a copy of the agenda was kept continually current and available to the public at 400 East Military, 3rd floor and a copy of the open meeting law is posted continually for public inspection located near the Council Chambers entrance door by the agendas. It was moved by Fooken, seconded by Emanuel, to dispense with the reading of the Minutes of the September 16, 2013 Regular Meeting (as amended to show the correct date of September 16, 2013) and the October 7, 2013 Special Meeting and approve as received. Roll Call Vote showed all members present voting aye – 7 ayes. Motion approved. Chairman Sookram stated the general public is invited to address the Planning Commission regarding any item on this agenda at this time or wait until discussion of their request is taking place. No public comments were received.  Consider request of Dale Kampschneider to erect an attached garage as part of a permitted conditional use at 3284 Big Island Road, #27 (Leisure Lake), Fremont, Dodge County, Nebraska. RL – Lake and River Residential District. Planning Director Harkins reviewed the staff report. Moved by Sawyer, seconded by Wiese to recommend approval of the request. Roll Call Vote showed all members present voting aye – 7 ayes. Motion Carried.  Consider request of Hurley D. Francisco to erect an accessory building as part of a permitted conditional use at 1284 South Ridge Road #2 (Grant Lake), Fremont, Dodge County, Nebraska. RL – Lake and River Residential District. Planning Director Harkins reviewed the staff report. Moved by Ridder, seconded by Sawyer to recommend approval of the request. Roll Call Vote showed all members present voting aye – 7 ayes. Motion Carried.  Consider request of Rodney and Doris Kempkes to erect an addition to existing cabin, a detached garage, gazebo, and tool shed as part of a permitted conditional use at 1300 West South Street, Lot #9, Rainbow Lake, Fremont, Dodge County, Nebraska. RL – Lake and River Residential District. 1 Planning Director Harkins reviewed the staff report. Various residents voiced concerns about the approval process for the request as the full Rainbow Lake board had not fully reviewed this item. Moved by Fooken, seconded by Fagan to recommend continuing the request to the next regular meeting to allow for review by the Rainbow Lake board. Roll Call Vote showed all members present voting aye – 7 ayes. Motion Carried.  Consider request of Fremont Family YMCA/City of Fremont to split part of Lot 134 and combine part of Lots 134, 73, 106, 188 and 133 (intersection of Military and Lincoln), Fremont, Dodge County, Nebraska into one lot. R1 – Single Family Residential District. Planning Director Harkins reviewed the staff report. Moved by Fooken, seconded by Emanuel to recommend approval of the request. Roll Call Vote showed all members present voting aye – 7 ayes. Motion Carried.  Consider request of Deer Pointe Corporation/Charles Diers to rezone part of the SE ¼ of the NW ¼ of Section 18, Township 17 North, Range 9 East, Dodge County, Nebraska from AG – Agricultural/Urban Reserve District to R1 – Single Family Residential District. Planning Director Harkins reviewed the staff report. Moved by Wiese, seconded by Sawyer to recommend approval of the request. Roll Call Vote showed all members present voting aye – 7 ayes. Motion Carried.  Consider the Final Plat of Deer Pointe Third Addition, consisting of part of the SE ¼ NW ¼ of Section 18, Township 17 North, Range 9 East, Dodge County, Nebraska. Planning Director Harkins reviewed the staff report. Moved by Emanuel, seconded by Wiese to recommend approval of the request. Roll Call Vote showed all members present voting aye – 7 ayes. Motion Carried.  Consider request of Dillon Real Estate Company, Inc. (Fremont Kwik Shop), owner of Lots 4 through 7 and the West 30 Feet of Lot 8, Block 112, City of Fremont, Dodge County, Nebraska, together with vacated alley adjacent (Military and Broad) to combine into one lot. Planning Director Harkins reviewed the staff report. Moved by Ridder, seconded by Sawyer to recommend approval of the request. Roll Call Vote showed all members present voting aye – 7 ayes.
