MINUTES PLANNING COMMISSION SPECIAL MEETING OCTOBER 7, 2013 – 4:30 P.M. CITY COUNCIL CHAMBERS PRESENT: Vice Chairman Fooken, Members Emanuel, Barton, Sawyer, Fagan, Ridder and Winter, Chief Building Inspector Don Simons and Planning Director Rian Harkins ABSENT: Member Wiese, Chairman Sookram Vice Chairman Fooken called the meeting to order. Roll Call Vote was taken – 7 present. Vice Chairman Fooken read a statement that this meeting was preceded by publicized notice in the Fremont Tribune and the agenda displayed in the lobby of the Municipal Building and posted online at www.fremontne.gov; and distributed to the Planning Commission, Mayor and City Council on October 2, 2013 and is open to the public. Vice Chairman Fooken also stated a copy of the agenda was kept continually current and available to the public at 400 East Military, 3rd floor and a copy of the open meeting law is posted continually for public inspection located near the Council Chambers entrance door by the agendas. Vice Chairman Fooken stated the general public is invited to address the Planning Commission regarding any item on this agenda at this time or wait until discussion of their request is taking place. No public comments were received. Consider request to approve rezoning Ritz Lake, NW ¼ of Section 7, township 17 North, Range 9 East, Dodge County, Nebraska from AG Agricultural/Urban Reserve to MU Mixed Use. Planning Director Harkins reviewed the staff report, and noted the reasoning behind asking for the lake to be included in the rezoning. He also noted while it was desirable staff could live without it. Planning Director Harkins also reviewed how the MU district works and gave an overview of the development plan that was previously approved for this MU district. Todd Lorenz of Olsson Associates, agent for the applicant, shared they are leaving the lake out of the rezoning request since it is not a buildable area. Motion by Emanuel, seconded by Sawyer to approve the rezoning request. Roll Call Vote showed all members present voting aye – 7 ayes. Meeting adjourned at 4:43 p.m. 1
