PRESENTED ID19-1252 Proclamation of “Teen Dating Violence Awareness and Prevention Month” PRESENTED COUNCILMEMBER REPORTS AND COMMENTS Councilmember Caprioglio spoke regarding his town hall meeting at Oraze Elementary School where the residents brought to his attention illegal dumping and non-working street lights. He asked Director Mozier to follow up with his office regarding 2695 N. Fowler Avenue. He attended Valley Business Luncheon where Matty Matoian was awarded the Leon S. Peters Award. He attended the Fresno State ribbon cutting for the new shelter for the Poverello House. He participated in Support the Blue Run event, Saturday, February 23, 2019 at Woodward Park and attended Officer Phia Vang's Funeral, Sunday, February 24, 2019. Councilmember Caprioglio went to Sacramento with Airports Director Meikle to advocate for IBank on Wednesday, February 27, 2019. They were able to get $35 million dollars towards the airports $15 million dollar renovation. He mentioned Fresno State men’s and women’s basketball game and stated Kids Day will be Tuesday, March 5, 2019. He thanked the Northeast Police Department and Homeless Taskforce for assisting in District 4 and said March 6, 2019 is Coffee with Cops day at Cedar and Dakota. He gave a shout out to Noemi Schwartz and City Attorney's staff for all their hard work and requested the meeting be adjourned in memory of Officer Phia Vang. Councilmember Soria thanked PARCs and Administration for working on the Quigley Parks Master Plan. District 1 held their first Community Outreach meeting, and the next Community meeting will be Saturday, April City of Fresno ***Subject to Mayoral Veto Page 3 City Council Meeting Minutes - Final February 28, 2019 13, 2019 at Quigley Park. Councilmember Soria thanked the Police and Fire Department for the Young Councilmember Public Safety session. Saturday, March 2, 2019 will be the Chinese New Year's Parade and Sunday March, 3, 2019 will be the Mardi Gras Parade in the Tower District. She expressed her concerns with the firewall limitations when researching and requested council staff have the ability and same access as Directors and other higher positions. Councilmember Esparza mentioned he presented a proclamation to Coach Joel Munoz who is retiring on Friday, February 22, 2019 at Roosevelt High School; he also attended Officer Phia Vang's funeral. He gave a shout out to the parents of Leavenworth Elementary School for putting together the alley cleanup. He mentioned the Fresno Police Department Hispanic Residence Academy that was was held at Kings Canyon Middle School. He attended the inaugural Hmong Leadership Cohort at Fresno City Hall. Councilmember Esparza spoke about Mega Texas barbecue located at Fresno and McKinley. He mentioned the Fresno State wrestling game against Oklahoma. He will be having his first District 7 town hall meeting, Monday, March 4, 2019 at 6:00 P.M at Manchester Gate Elementary School. Councilmember Bredefeld mentioned his District 6 town hall meeting February 26, 2019 and thanked City staff for attending and he thanked Administration for the private security firm patrolling the parks. Council President Brandau spoke regarding the Hmong Leadership Cohort, he thanked Administration and staff for attending the event. He will be participating in the Reading across America program where he will be reading to the kindergarten class at Forkner Elementary and he donated books to at Fig Garden Elementary. Council President Brandau honored Officer Phia Vang and his family. 1. (Subject to Mayor’s veto) The above item was introduced to Council by Director Mozier, Public Works Department. Councilmember Bredefeld asked staff if this was setting a policy for contracts with the City of Fresno for street repair to guarantee they follow through and meet their timelines and if they did not will they be fined $1,000 a day. He asked if staff felt comfortable that the $1,000 a day was enough to ensure the projects will meet the deadline. Director Mozier responded. Councilmember Bredefeld motioned to approve the item as presented and Councilmember Chavez seconded the motion. Upon call, there was no public comment. Council Vice President Arias asked staff to explain what is it that the City of Fresno will require as a result of the policy, why we are doing it, if it can be concrete and how it is going to be executed? He asked if it requires a pre-construction meeting to go over a detailed planned, if anyone is exempt from this policy and if the Rail Road was included. He expressed his concerns regarding the policy and felt it can be done through internal planning. He does not support the policy at this time. Director Mozier responded. Councilmember Soria addressed her concerns regarding staff and contractors accountability on the projects. City Manager Quan and Director City of Fresno ***Subject to Mayoral Veto Page 7 City Council Meeting Minutes - Final February 28, 2019 Mozier responded. Councilmember Bredefeld asked if previous projects had a penalty if the project was not completed and asked who would be penalized. Director Mozier responded. Councilmember Chavez spoke regarding street closures and work not being done and asked when does the $1,000 per day go in effect. He asked how would the policy have helped with the High Speed Rail project. Director Mozier replied. Council President Brandau spoke regarding the residences concerns with the street closure and no work being done and supports the policy. He asked that going forward the Department heads look at their projects that impact their departments and be proactive before bringing the projects to Council. Council President Brandau requested a friendly amendment to the motion that when a road is closed for three months of more, he would like there to be a meeting in that district with the contractor and administration so the Councilmember would be fully informed. Councilmember Bredefeld and Councilmember Chavez agreed to the amendment. Councilmember Bredefeld asked for a representative from High Speed Rail be present and informs the Council regarding the road closures. City Manager Quan responded and suggested a workshop be presented to the Council. Council Vice President Arias asked the staff to bring back information regarding how many contracts will be fined, how many road closures a year and how big is the problem. Councilmember Chavez asked if this was time sensitive. Upon consensus of the Council the item was continued to March 7, 2019, to give staff the opportunity to meet with the Councilmembers individually. 2. Upon call, there was no public comment. Councilmember Soria asked staff how much are they paying for water and stated she will approve the lease agreement for the remainder of 2019. She directed staff and specified that before an extension to the agreement is executed, staff will analyze the value of the lease to make sure it is the best value for the City of Fresno. She requested staff use some of the funds to conduct a study to better monetize all the waste water resources and continue partnership with the Ag industry and include the small farmers who are interested or impacted. She requested the study and extension of the agreement return to Council before the end of 2019 for discussion and approval. Director Carbajal responded. Council President Brandau and Councilmember Bredefeld spoke regarding the affordability and the quality of the golf course. Councilmember Esparza asked if the money has been taken from the General Fund and asked about the ten year lease agreement and if they will be coming back and asking for money to pay the subsidy. Senior Operations Manager Pohll and Assistant City Manager Schaad responded. Councilmember Soria asked if the City has the ability to arrange golf tournaments in the agreement and spoke regarding the financial benefit to the City of Fresno. She also asked what the dollar amount of the base rent was on an annual basis. Senior Operations Manager Adam Pohll responded. Council Vice President Arias asked how the operation has been keeping itself up, asked about the audit, what rates they pay for water and requested they do not impact the river access. She asked what is the time frame, if they are being prioritize and she stated she would like the neighborhoods to be top priority. Director Mozier responded. Councilmember Soria asked if these dollars are in the same category as the Community Development Block Grant (CDBG) dollars and asked staff what can be done in the future to avoid missed deadlines. Assistant Director Furtado and Assistant City Manager Schaad responded. Council Vice President Arias stated the Housing Committee is not qualified to select projects for CDBG funds. Assistant Director Furtado responded. Councilmember Esparza asked how many units are affordable housing. Developer Sal Gonzales replied. Councilmember Esparza asked when was the reallocation of the Community Development Block Grant (CDBG) funds made public and asked if this was the will of the community. Assistant Director Furtado responded. Councilmember Esparza asked staff what the infrastructure amount was and asked if the projects are ready to go to meet the deadline. Director Mozier responded. Council Vice President Arias asked staff about the process of receiving CDBG funds and what is the risk if Housing and Urban Development (HUD) says it is not eligible and does not meet the timelines. Director Clark responded. He asked staff to explain the money that has been set aside to repay the CDBG dollars and expressed his concerns with CDBG and the project priority. Council Vice President Arias suggested that the committee be restructured to include individuals who are trained to know what CDBG funds are, who are familiar with the neighborhoods and come from the districts in which CDBG is represented and that Council take the approach in identifying CDBG priorities. Director Clark replied. Councilmember Soria asked staff if the timeliness test will be met for the parks projects. Assistant Director Furtado responded. Councilmember Soria expressed her concerns regarding home funds in a Section 108 loan which was not applied for. She asked staff what will be done moving forward so that Council will not be in the same situation in the future. She asked if the staffing issue has been addressed. Assistant Director Furtado and Assistant City Manager Schaad replied. Councilmember Soria expressed her frustration with staff regarding her neighborhoods being looked over with basic infrastructure and wants staff to make Highway City their priority. RESOLUTION 2019-042 ADOPTED AS AMENDED On motion of Councilmember Chavez, seconded by President Brandau, that the above Action Item be adopted as amended to include Council establishing a Community Development Block Grant (CDBG) subcommittee to work with staff on developing the next five years CDBG plan and include residents from the north and south side of the City. Council Vice President Arias requested to be the Chairperson of the subcommittee. The motion carried by the following vote: Aye: 7 - Brandau, Arias, Soria, Caprioglio, Chavez, Bredefeld and Esparza 3-B ID19-1255 Approve City participation in a Joint Exercise of Powers Agreement to become a member of the Temperance Flat Reservoir Authority and authorize up to $250,000 in proportionate costs for three years. Council President Brandau asked if the County of Fresno would be participating in the Temperance Flat project and if the map showing the San Joaquin Valley Water Infrastructure Authority was going to morph into Temperance Flat Authority. Director Carbajal responded that they are separate entities. Council Vice President Arias asked staff several questions then asked staff to bring a workshop in the future before an item for approval and he would like staff to work with the County of Fresno in the future. Councilmember Soria proposed staff spend some time with the State and discuss if this is something that is feasible in the next ten years.
