Roll Call Present 4 - Chairperson Michael McDonald, Vice Chair Jack Tracy, Board Member Maryann Rogozinski, and Board Member Lynda Snauffer 2. Hearing on Disciplinary Appeal The hearing was declared closed at 9:05am. A. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] The Appointing Authority's representative, Bud Tickel, Water System Manager, was present and was represented by Felicia Espinosa, Deputy City Attorney. The Appellant was present and was represented by Marina Magdaleno, Business Representative, Local 39. Witnesses were sequestered and the reading of the Order was waived by the parties. Witness testimony was heard and breaks were taken as needed. The parties presented exhibits of evidence during the testimony, and they were filed and moved into the record. At 2:31pm, following summaries and closing remarks from the parties, the Board convened into executive session to deliberate the matter. City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes July 11, 2016 At 3:01pm, the Board reconvened into closed session and voted on the charges as read by Stephanie Martinez, Acting Secretary Designee. The charge of violation of Fresno Municipal Code Section 3-286(a) was sustained on a 4-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(3) was sustained on a 4-0 vote. The charge of violation of Department of Public Utilities Policy 21-1, Section IV(B)(1) was sustained on a 4-0 vote. A motion was then made by Vice Chair Tracy and seconded by Board Member Snauffer to modify the Appointing Authority's decision and reduce the Appellant's suspension from 80 hours to 60 hours. The motion was carried out by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Rogozinski and Board Member Snauffer At 3:02pm, the Board convened into open session and the decisions of the Board was announced in accordance with the Brown Act. 3.
