2. Approval of Minutes
A. July 6, 2016
A motion was made by Vice Chair Tracy, seconded by Board Member
Rogozinski, that the July 6, 2016 Minutes be approved. The motion was
carried by the following vote:
Aye: 3 - Chairperson McDonald, Vice Chair Tracy and Board
Member Rogozinski
Absent: 1 - Board Member Snauffer
B. July 11, 2016
A motion was made by Board Member Rogozinski, seconded by Vice
Chair Tracy, that the July 11, 2016 Minutes be approved with a minor
clerical correction. The motion was carried by the following vote:

3. Old Business
A. Closed Session - Continued Public Employee
Discipline/Dismissal/Release [Pursuant to Government Code
Section 54954]
Deputy Chief Robert Nevarez was present on behalf of the Appointing
Authority, and was represented by Joseph Rubin, Esq. Felicia Espinosa,
Deputy City Attorney, was also present. The Appellant was present and was
represented by Roger Wilson, Esq.
A motion was made by Vice Chair Tracy, seconded by Board Member
Rogozinski, to direct the Chair to sign the Findings with minor
corrections to pages 3 and 6. The motion carried by the following vote:
Aye: 3 - Chairperson McDonald, Vice Chair Tracy and Board
Member Rogozinski
Absent: 1 - Board Member Snauffer
4. Hearing on Disciplinary Appeal
The Hearing was declared closed at 1:10pm.

Discipline/Dismissal/Release [Pursuant to Government Code
Section 54954]
Deputy Chief Robert Nevarez was present on behalf of the Appointing
Authority and was represented by Felicia Espinosa, Deputy City Attorney.
The Appellant was present and was unrepresented.
Witnesses were sequestered and the reading of the Order was waived by
the parties.
Witness testimony was heard and breaks were taken as needed.
Exhibits of evidence were presented during the testimony, and they were
filed and moved into the record.
At 3:37pm, following summaries and closing remarks from the parties, the
Board convened into executive session to deliberate the matter.
At 3:51pm, the Board reconvened into closed session and voted on the

charges as read by Stephanie Martinez, Acting Secretary Designee.
The charge of violation of Fresno Municipal Code Section 3-286(a) was
sustained on a 3-0 vote.
The charge of violation of Fresno Municipal Code Section 3-286(b)(3) was
sustained on a 3-0 vote.
The charge of violation of Police Department Policy 341.2.1(a) was
sustained on a 3-0 vote.
The charge of violation of Police Department Policy 341.2.1(b) was
sustained on a 3-0 vote.
The charge of violation of Police Department Policy 1036.1.2 was sustained
on a 3-0 vote.
A motion was made by Vice Chair Tracy, seconded by Board Member
Rogozinski, to uphold the decision of the Appointing Authority. The
motion carried by the following vote:
Aye: 3 - Chairperson McDonald, Vice Chair Tracy and Board
Member Rogozinski
Absent: 1 - Board Member Snauffer
At 3:53pm, the Board convened into open session and the decision of the Board was
announced in accordance with the Brown Act.
5. Unscheduled Public Communications
Ms. Espinosa advised that she has been reassigned and will no longer be handling
personnel matters, and that the City Attorney's Office is actively recruiting for a
replacement.
6. Adjournment
There being no further business to come before the Board, the meeting was adjourned
at 3:56pm.
