Roll Call Present 3 - Chairperson Michael McDonald, Board Member Maryann Rogozinski, and Board Member Lynda Snauffer Absent 1 - Vice Chair Jack Tracy 2. Approval of Minutes A. July 27, 2016 A motion was made by Member Rogozinski, seconded by Member Snauffer, that the July 27, 2016 minutes be approved. The motion was carried by the following vote: Aye: 3 - Chairperson McDonald, Board Member Rogozinski and Board Member Snauffer Absent: 1 - Vice Chair Tracy The Board convened into closed session at 1:33pm. 3. Old Business A. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] The Appointing Authority was not present, but was represented by Tina Griffin, Assistant City Attorney. Neither the Appellant nor his representative were present. A motion was made by Member Snauffer, seconded by Member Rogozinski, to direct the Chair to sign the Findings. The motion was carried by the following vote: Aye: 3 - Chairperson McDonald, Board Member Rogozinski and Board Member Snauffer Absent: 1 - Vice Chair Tracy B. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] Assistant City Attorney, Tina Griffin, represented the Appointing Authority, who was not present. Deputy City Attorney, Jennifer DeRuosi, was also present. The Appellant was not present and was not represented. A motion was made by Member Rogozinski, seconded by Chair McDonald, to direct the Chair to sign the findings. Aye: 2 - Chairperson McDonald and Board Member Rogozinski Absent: 1 - Vice Chair Tracy Abstain: 1 - Board Member Snauffer C. Closed Session - Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54957]) The Appointing Authority was not present, but was represented by Joseph Rubin, Esq. Neither the Appellant nor his representative were present. The Board convened into executive session at 1:38pm to discuss the matter and reconvened into closed session at 2:04pm. A motion was made by Member Rogozinski and seconded by Member Snauffer to approve the Hearing Officer's recommendation to uphold the decision of the Appointing Authority. Schedule Meeting(s) to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] Assistant City Attorney, Tina Griffin, represented the Appointing Authority, who was not present. Deputy City Attorney, Jennifer DeRuosi, was also present. The Appellant was not present and was not represented. A recommendation was made to dismiss the appeal pursuant to Fresno Municipal Code Section 3-284(b). A motion was made by Member Snauffer and seconded by Member Rogozinski, to dismiss the Appeal to the Civil Service Board. The motion carried by the following vote: Aye: 3 - Chairperson McDonald, Board Member Rogozinski and Board Member Snauffer Absent: 1 - Vice Chair Tracy B. Schedule Meeting(s) to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] The Appointing Authority was not present, but was represented by Assistant City Attorney, Tina Griffin. Jennifer DeRuosi, Deputy City Attorney, was also present. The Appellant was not present and was not represented. A recommendation was made to dismiss the appeal pursuant to Fresno Municipal Code Section 3-284(b). A motion was made by Member Snauffer and seconded by Member Rogozinski, to dismiss the Appeal to the Civil Service Board. A hearing was scheduled for October 4, 2016 beginning at 9:00am. D. Schedule Meeting(s) to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] Assistant City Attorney, Tina Griffin, represented the Appointing Authority, who was not present. Jennifer DeRuosi, Deputy City Attorney was also present. The Appellant was present and was represented by Business Representative, Scott Boghosian. A hearing was scheduled for November 29 and 30, 2016 beginning at 9:00am. 5. Unscheduled Public Communications There was a discussion regarding the status of appointing a fifth Board member as well as the upcoming Mayoral election. 6.
