Roll Call Present 4 - Chairperson Michael McDonald, Vice Chair Jack Tracy, Board Member Maryann Rogozinski, and Board Member Lynda Snauffer Board Counsel, Dan McCloskey, was present and represented the Board. Acting Secretary Designee, Stephanie Martinez, was also present. 2. Approval of Minutes A. September 8, 2016 A motion was made by Board Member Rogozinski, seconded by Board Member Snauffer, to approve the September 8, 2016 minutes. The motion was carried by the following vote, with Vice Chair Tracy abstaining: Aye: 3 - Chairperson McDonald, Board Member Rogozinski and Board Member Snauffer Abstain: 1 - Vice Chair Tracy 3. New Business A. Schedule Meeting(s) to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes October 12, 2016 Deputy City Attorney, Jennifer DeRuosi, represented the Appointing Authority, who was not present. Assistant City Attorney, Tina Griffin, was also present. Neither the Appellant nor his representative were present. A recommendation was made to dismiss the appeal pursuant to Fresno Municipal Code Section 3-284(b). A motion was made by Vice Chair Tracy and seconded by Member Snauffer to dismiss the Appeal to the Civil Service Board. The motion was carried by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Rogozinski and Board Member Snauffer The Board convened into closed session at 9:44am. B. Closed Session - Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] Joseph Rubin, Esq., was present on behalf of the Appointing Authority, and advised the Board that the Appellant had withdrawn his appeal. No further action was taken. C. Closed Session - Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] The appointing was not present, but was represented by Joseph Rubin, Esq. The Appellant was not present. Mr. Rubin presented a Notice of Application for Order to Dismiss Appellant's Appeal due to the Appellant failing to respond to requests for contact. A motion was made by Vice Chair Tracy, seconded by Member Snauffer, to approve the Notice of Application for Order to Dismiss Appellant's Appeal. The motion was carried by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Rogozinski and Board Member Snauffer The Board reconvened into open session at 9:48am. The decisions of the Board were announced in accordance with the Brown Act. 4. Unscheduled Public Communications None.
