Roll Call Present 3 - Chairperson Michael McDonald, Board Member Maryann Rogozinski, and Board Member Lynda Snauffer Absent 1 - Vice Chair Jack Tracy Board Counsel, Dan McCloskey, was present and represented the Board. Acting Secretary Designee, Stephanie Martinez, was also present. 2. Approval of Minutes A. October 4, 2016 A motion was made by Member Snauffer, seconded by Member Rogozinski, to approve the October 4, 2016 minutes. The motion was carried by the following vote: Aye: 3 - Chairperson McDonald, Board Member Rogozinski and Board Member Snauffer Absent: 1 - Vice Chair Tracy B. October 12, 2016 A motion was made by Member Snauffer, seconded by Member Rogozinski, to approve the October 12, 2016 minutes. Hearing on Disciplinary Appeal A. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] Lieutenant Mindy Casto was present on behalf of the Appointing Authority and was represented by Deputy City Attorney Jennifer DeRuosi. Assistant City Attorney, Tina Griffin, was also present. The Appellant was present and was represented by Heather Phillips, Esq. Witnesses were sequestered and the reading of the Order was waived by the parties. Witness testimony was heard and breaks were taken as needed. Exhibits of evidence were presented during testimony, and they were filed and moved into the record. At 5:02pm, following summaries and closing remarks from the parties, the Board convened into executive session to deliberate the matter. At 5:38pm, the Board convened into closed session and voted on the charges as ready by Stephanie Martinez, Acting Secretary Designee. The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained on a 3-0 vote with Vice Chair Tracy absent. The charge of violation of Fresno Municipal Code Section 3-286(b)(4) as set forth in the Order was sustained on a 3-0 vote with Vice Chair Tracy absent. The charge of violation of Fresno Police Department Procedure 1040 as set forth in the Order was sustained on a 3-0 vote with Vice Chair Tracy absent. The charge of violation of Fresno Police Department Policy 106.8 as set forth in the Order was sustained on a 3-0 vote with Vice Chair Tracy absent. A motion was made by Member Snauffer, seconded by Member Rogozinski, to uphold the decision of the Appointing Authority.
