Roll Call Present 4 - Chairperson Michael McDonald, Vice Chair Jack Tracy, Board Member Lynda Snauffer, and Board Member Dean Eller Absent 1 - Board Member Al Smith Board Counsel, Dan McCloskey, was present and represented the Board. Acting Secretary Designee, Karnell Grijalva, was also present. 2. Approval of Minutes A. February 27, 2018 On motion of Vice Chair Tracy, seconded by Board Member Snauffer, that the February 27, 2018 minutes be approved. The motion carried by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Snauffer and Board Member Eller Absent: 1 - Board Member Smith 3. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Board Member Eller, seconded by Vice Chair Tracy, that the above Action Item be Approved and Returned Signed. The motion carried by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Snauffer and Board Member Eller Absent: 1 - Board Member Smith Deputy City Attorney II, Jennifer DeRuosi, was present on behalf of the Appointing Authority. Neither the Appellant nor a representative were present. At 9:15am the meeting convened to Executive Session. At 9:40am the meeting reconvened to Closed Session. B. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Snauffer, that the Hearing Officer's Report and Recommendation be approved. The motion carried by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Snauffer and Board Member Eller Absent: 1 - Board Member Smith Attorney at Law, Joseph Rubin, was present on behalf of the Appointing Authority. Neither the Appellant or Representative were present. C. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Snauffer, that the Hearing Officer's Report and Recommendation be approved as amended. The Appellant's benefits to be subject to City records and further mitigation. New Business A. Schedule Meeting(s) to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] Deputy City Attorney II, Jennifer DeRuosi, was present on behalf of the Appointing Authority. Tony Silva, Labor Representative, was present on behalf of the Appellant. The Hearing on Appeal was scheduled for July 12-13, 2018. Due to calendar conflicts of the Board, it was requested to move the meeting scheduled for May 16, 2018 to May 23, 2018. Acting Secretary Designee, Karnell Grijalva, to contact scheduled parties with the proposed date change. At 9:43am the Board reconvened to Open Session and the decisions of the Board were announced in accordance with the Brown Act. 5. Unscheduled Public Communications None 6.
