Roll Call Present 3 - Chairperson Michael McDonald, Vice Chair Jack Tracy, and Board Member Dean Eller Absent 2 - Board Member Lynda Snauffer, and Board Member Al Smith Board Counsel, Dan McCloskey, was present and represented the Board. Acting Secretary Designee, Karnell Grijalva, was also present. 2. Approval of Minutes A. April 24, 2018 On motion of Board Member Eller, seconded by Vice Chair Tracy, that the April 24, 2018 minutes be approved. The motion carried by the following vote: Aye: 3 - Chairperson McDonald, Vice Chair Tracy and Board Member Eller Absent: 2 - Board Member Snauffer and Board Member Smith At 9:20am the Board convened into Closed Session 3. Old Business A. Reschedule Civil Service Board Administrative Meeting City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes May 18, 2018 Rescheduling of the next Civil Service Board Administrative Meeting was Tabled by the Board. 4. Hearing on Appeal A. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Board Member Eller, seconded by Chairperson McDonald, that the decision of the Appointing Authority be upheld. The motion carried by the following vote: Aye: 2 - Chairperson McDonald and Board Member Eller No: 1 - Vice Chair Tracy Absent: 2 - Board Member Snauffer and Board Member Smith Jennifer DeRuosi, Deputy City Attorney III, and Scott Mozier, Director of Public Works, were present on behalf of the Appointing Authority. The Appellant and Local 39 Business Representative, Marina Magdaleno, were also present. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 1:28pm, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 2:02pm, the Board reconvened into Closed Session and voted on the charges as read by Karnell Grijalva, Acting Secretary Designee. The charge of violation of Fresno Municipal Code Section 3-286(b)(3) as set forth in the Order was sustained with a 2-1 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(4) as set forth in the Order was sustained with a 2-1 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(8) as set forth in the Order was sustained with a 2-1 vote. The charge of violation of Street Maintenance Division Policies and Procedures and Work Place Conduct: Section 1.(7) as set forth in the Order was sustained with a 2-1 vote. At 2:06pm, the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 5. Unscheduled Public Communications None 6.
