The meeting was called to order at 9:00am.
1. Roll Call
Present 4 - Vice Chair Jack Tracy, Board Member Lynda Snauffer, Chair
Michael McDonald, and Board Member Elba Gomez
Absent 1 - Board Member Dean Eller
Board Counsel, Dan McCloskey, was present and represented the Board. Acting
Secretary Designee, Karnell Grijalva, was also present.
At 9:02am the meeting convenend to Closed Session.
2. Old Business
A. Reschedule Meeting(s) to Conduct a Public Employee Discipline
Appeal Hearing [Pursuant to Fresno Municipal Code Section
3-284]
Deputy City Attorney III, Jennifer DeRuosi, and Deputy Chief of Police, Lydia
Carrasco, was present on behalf of the Appointing Authority and presented to the
Board Joint Stipulation and Order to Continue Hearing Dates approved and signed
by the City and Appellant's Representative, Attorney at Law, Heather Phillips.
The Joint Stipulation and Order was approved and signed by Civil Service Board
Chair Michael McDonald.

A. Schedule Meeting(s) to Conduct a Public Employee Discipline
Appeal Hearing [Pursuant to Fresno Municipal Code Section
3-284]
Deputy City Attorney III, Stephanie Snyder, and Deputy Chief of Police, Lydia
Carrasco, was present on behalf of the Appointing Authority. Attorney at Law,
Roger Wilson was present on behalf of the Appellant.
The Hearing on Appeal was scheduled for January 16, 2019 and January 17, 2019.
B. Schedule Meeting(s) to Conduct a Public Employee Discipline
Appeal Hearing [Pursuant to Fresno Municipal Code Section
3-284]
Deputy City Attorney III, Stephanie Snyder, was present on behalf of the Appointing
Authority. Labor Representative, Tony Silva, was present on behalf of the Appellant.
Hearing on Appeal was scheduled for November 20, 2018.
4. Hearing on Appeal
A. Closed Session - Public Employee Discipline/Dismissal/Release
[Pursuant to Government Code Section 54954]
On motion of Vice Chair Tracy, seconded by Chair McDonald, that the
decision of the Appointing Authority be upheld. The motion carried by
the following vote:
Aye: 4 - Vice Chair Tracy, Board Member Snauffer, Chair McDonald
and Board Member Gomez
Absent: 1 - Board Member Eller

Deputy City Attorney III, Jennifer DeRuosi, and Public Works Director, Scott Mozier,
were present on behalf of the Appointing Authority. The Appellant and Local 39
Labor Representative, Marina Magdaleno, were also present.
Witnesses were sequestered and the reading of the Order was waived by the
parties.
Exhibits of evidence were presented during testimony and they were filed and moved
into the record.
At 1:59pm, following summaries and closing remarks from the parties, the Board
convened into Executive Session to deliberate the matter.
At 2:40pm, the Board reconvened into Closed Session and voted on the charges as
read by Acting Secretary Designee, Karnell Grijalva.
The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the
Order was sustained with a 4-0 vote.
The charge of violation of Fresno Municipal Code Section 3-286(b)(4) as set forth in
the Order was sustained with a 4-0 vote.
The charge of violation of Fresno Municipal Code Section 3-286(b)(5) as set forth in
the Order was sustained by a 4-0 vote.
The charge of violation of Fresno Municipal Code Section 3-286(b)(7) as set forth in
the Order was sustained by a 4-0 vote.
The charge of violation of Administrative Order 2-16(C) as set forth in the Order was
sustained by a 4-0 vote.
The charge of violation of Administrative Order 2-16(D) as set forth in the Order was
sustained by a 3-1 vote.
The charge of violation of Street Maintenance Division Policies and Procedures and
Work Place Conduct: Section 1.(8, 10, 17) as set forth in the Order was sustained by
a 4-0 vote.
The charge of violation of Street Maintenance Division Policies and Procedures and
Work Place Conduct: Section 2. as set forth in the Order was sustained by a 4-0
vote.
At 2:43pm, the Board reconvened into Open Session and the decisions of the Board

were announced in accordance with the Brown Act.
5. Unscheduled Public Communications
None
6. Adjournment
There being no further business to come before the Board, the meeting was
adjourned at 2:46pm.
