Roll Call Present 3 - Board Member Dean Eller, Chair Michael McDonald, and Board Member Elba Gomez Excused 2 - Vice Chair Jack Tracy, and Board Member Lynda Snauffer Dan McCloskey, Board Counsel, was present and represented the Board. Karnell Grijalva, Acting Secretary Designee, was also present. Also in attendance were: Jeffrey Cardell, Director of Personnel Services, and Jennifer DeRuosi, Deputy City Attorney III. At 1:00pm, the Board convened into Closed Session. 2. Old Business A. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Board Member Eller, seconded by Chair McDonald, that the decision of the Appointing Authority be upheld. The motion carried by the following vote: Aye: 2 - Board Member Eller and Chair McDonald No: 1 - Board Member Gomez City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes February 12, 2019 Excused: 2 - Vice Chair Tracy and Board Member Snauffer Stephanie Snyder, Deputy City Attorney III, and Deputy Police Chief Lydia Carrasco, were present on behalf of the Appointing Authority. Attorney at Law, Roger Wilson, and the Appellant were also present. At 1:03pm, following closing remarks to the Board regarding submitted Bench Briefs by the parties, the Board convened into Executive Session to deliberate the matter. At 1:48pm, the Board reconvened into Closed Session and voted on the charges as read by Karnell Grijalva, Acting Secretary Designee. The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained with a 2-1 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(4) as set forth in the Order was sustained with a 2-1 vote. The charge of violation of Fresno Police Department Policy 341.2.5 Performance (f) as set forth in the Order was sustained with a 2-1 vote. The charge of violation of Fresno Police Department Policy 341.2.5 Performance (d) as set forth in the Order was sustained with a 2-1 vote. At 1:50pm, the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 3. Unscheduled Public Communications None 4.
