Also present were Acting Secretary Designee, Karnell Grijalva, Attorney at Law, Joseph Rubin, and Deputy City Attorney III, Jennifer DeRuosi. 2. Approval of Minutes A. April 3, 2019 On motion of Vice Chair Tracy, seconded by Board Member Eller, that the April 3, 2019 minutes be approved. The motion carried by the following vote: Aye: 4 - Vice Chair Tracy, Board Member Snauffer, Board Member Eller and Chair McDonald Absent: 1 - Board Member Gomez At 9:03am the Board convenend into Closed Session. 3. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Board Member Eller, seconded by Vice Chair Tracy, that the above Action Item be approved as amended, replacing "Hearing Officer" with "Arbitrator" within the Decision, Findings and Order Dismissing Appeal. The motion carried by the following vote: Aye: 4 - Vice Chair Tracy, Board Member Snauffer, Board Member Eller and Chair McDonald Absent: 1 - Board Member Gomez B. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Snauffer, that the above Action Item be Approved and Returned Signed. The motion carried by the following vote: Aye: 4 - Vice Chair Tracy, Board Member Snauffer, Board Member Eller and Chair McDonald Absent: 1 - Board Member Gomez City of Fresno ***Subject to Mayoral Veto Page 2 Civil Service Board Meeting Minutes April 24, 2019 Stephanie Snyder, Deputy City Attorney III, and Gregory Barfield, Director of Transportation, were present on behalf of the Appointing Authority. The Appellant was present without representation. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 10:43am, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 11:08am, the Board reconvened into Closed Session and voted on the charges as read by Karnell Grijalva, Acting Secretary Designee. The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Transportation Department General Rules for Bus Operators Section 1(B)(1) Responsibilities and Service as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Transportation Department General Rules for Bus Operators Section 1(C) Responsibilities and Duties as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Transportation Department General Rules for Bus Operators Section 2(A) Passengers as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Transportation Department General Rules for Bus Operators Section 2(H) Abusive/Unruly Passengers as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Transportation Department General Rules for Bus Operators Section 2(I) Ejecting Passengers as set forth in the Order was sustained with a 3-1 vote. At 11:02am, the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 5.
