Roll Call Present 3 - Vice Chair Jack Tracy, Chair Michael McDonald, and Board Member Elba Gomez Board Counsel, Dan McCloskey, was present and represented the Board. Also present were Acting Secretary Designee, Karnell Grijalva, Assistant Personnel Services Director, Marissa Gonzales, and Assistant City Attorney, Tina Griffin. 2. Approval of Minutes A. August 9, 2019 On motion of Board Member Gomez, seconded by Vice Chair Tracy, that the minutes for August 9, 2019 be approved. The motion carried by the following vote: Aye: 3 - Vice Chair Tracy, Chair McDonald and Board Member Gomez B. November 12, 2019 On motion of Board Member Gomez, seconded by Vice Chair Tracy, that the minutes for November 12, 2019 be approved. Old Business A. Closed Session - Findings of Director Decision Review of Applicant Disqualification Appeal [Pursuant to Fresno Municipal Code Section 3-249] On motion of Vice Chair Tracy, seconded by Board Member Gomez, that the above Action Item be Approved and Returned Signed. The motion carried by the following vote: Aye: 3 - Vice Chair Tracy, Chair McDonald and Board Member Gomez B. Closed Session - Findings of Review of Director’s Action Removal From Eligibility List [Pursuant to Fresno Municipal Code Section 3-249] On motion of Vice Chair Tracy, seconded by Board Member Gomez, that the above Action Item be Approved and Returned Signed. The motion carried by the following vote: Aye: 3 - Vice Chair Tracy, Chair McDonald and Board Member Gomez 4. Hearing on Appeal A. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Board Member Gomez, seconded by Vice Chair Tracy, that the Board uphold the decision of the Appointing Authority. The motion carried by the following vote: Aye: 3 - Vice Chair Tracy, Chair McDonald and Board Member Gomez City of Fresno ***Subject to Mayoral Veto Page 2 Civil Service Board Meeting Minutes December 9, 2019 Deputy City Attorney III, Jennifer DeRuosi, and Director of Transportation, Gregory Barfield, were present on behalf of the Appointing Authority. The Appellant was present without representation. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 12:25pm, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 12:45pm, the Board reconvened into Closed Session and voted on the charges as read by the Acting Secretary Designee, Karnell Grijalva. The charge of violation of the Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained by a 3-0 vote. The charge of violation of the Vehicle Code Section 22100(b) as set forth in the Order was sustained 3-0 vote. The charge of violation of the Transportation Department General Rules for Bus Operators Section 1.(B)(1) as set forth in the order was sustained by a 3-0 vote. The charge of violation of the Transportation Department General Rules for Bus Operators Section 1.(C) as set forth in the order was sustained by a 3-0 vote. The charge of violation of the Transportation Department General Rules for Bus Operators Section 1.(G) as set forth in the order was sustained by a 3-0 vote. The charge of violation of the Transportation Department General Rules for Bus Operators Section 2.(A) 1. as set forth in the order was sustained by a 3-0 vote. The charge of violation of the Transportation Department General Rules for Bus Operators Section 2.(C) as set forth in the order was sustained by a 3-0 vote. At 12:50pm, the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 5. Unscheduled Public Communications None 6.
