MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road May 1, 2012 NAMING MOTHER OF THE YEAR While the City Council members were assembled, at 7:00 PM Mayor Todd Stevenson named Lois Frandsen as 2012 Fruit Heights Mother of the Year. Lois Frandsen resides at 1270 East 700 North and has lived in Fruit Heights 45 years. She has six children, 19 grandchildren, 9 great-grandchildren and is expecting two more great-grandchildren. Mrs. Frandsen was presented with a gift certificate and a bouquet of flowers by Mayor Stevenson. Following the announcement refreshments were served to family and friends in the audience. REGULAR MEETING The regular meeting of the Fruit Heights City Council was called to order by Mayor Todd Stevenson at 7:30 PM. The Pledge of Allegiance was recited and Bette Hubrich gave a prayer for the opening ceremony. The members of the Youth City Council were introduced and City Manager Brandon Green administered the Oath of Office to the members. The YCC members are Elise Anderson, Katie Boyle, Nate Burnett, Alyssa Miller, Reese Rasmussen, Reagan Rich, Nicholas Davis, Matthew Cooley, Carson Hunt and Kendall 1 Fruit Heights City Council Meeting May 1, 2012 Treadwell. Kendall Treadwell serves as the YCC Mayor and Katelyn Meiners serves as Mayor Pro Tem and Recorder. 2. APPROVAL OF MINUTES OF MEETING – April 17, 2012 Council Member Craig Hill made a motion to approve the minutes of April 17, 2012, with changes. Council Member Don Carroll seconded the motion and it passed unanimously. 3. SPECIAL PRESENTATIONS A. Items from the Public Resident Richard Hepner stated he has a detention basin on his lot on Abrams Way and he requested he be allowed to eliminate the monthly storm water fee from his utility bill. He stated he pays taxes, liability insurance and upkeep of the basin. He stated his Warranty Deed and the minutes of city council meetings when the subdivision was approved do not mention that he will be paying a storm drain fee. The fee recently went from $4.10 a month to $10.10 a month. Mayor Todd Stevenson stated the city has established a storm water utility fee to pay for the costs of maintaining the storm water system. A year ago the city council reviewed the associated expenses in the storm water system and the rates were raised because the system must be self-sufficient. Mr. Hepner asked the city council to take his request under advisement and send him a letter responding to his request. Council Member Bette Hubrich reminded Mr. Hepner that every resident pays a storm drain fee and received the same increase in their utility bill. Stephen Oda of Kaysville stated his home backs up to the proposed trail on Baer Creek Hollow. He represents the Kaysville homeowners on his street and wants to make the City Council aware of their concerns about the proposed trail in Fruit Heights and the problems that it may bring. The residents spoke to the City Council a couple of years ago and they were informed the trail would be towards the southern portion of the hollow, closer to Nicholls Road. They now hear it will be going in closer to the creek at the bottom of the trail. They feel that location is fraught with problems. Mr. Oda stated that many years ago the area had a serious criminal problem. He is concerned that the trail will be in a secluded location if located near the creek. The trail will be in close proximity to their homes. He requested his neighborhood have representation on the Fruit Heights Trails Committee to give input as to the location and type of trail that is built in the hollow. 2 Fruit Heights City Council Meeting May 1, 2012 Mayor Todd Stevenson said he will talk to the Trails Committee and figure out what would be the appropriate representation. He explained that the land on the west side of the hollow is being deeded to the city of Fruit Heights and the location of the trail has not been determined yet. Many entities will be involved in the location of the trail. Council Member Bette Hubrich stated she chairs the Trails Committee and took the contact information from Mr. Oda. Mayor Stevenson stated public hearings will be held regarding the trail and input is welcomed from the community. B. Mother of the Year Recognition The Fruit Heights Mother of the Year, Lois Frandsen, was honored prior to the beginning of tonight’s City Council meeting. 4. NEW BUSINESS A. Discuss/Approve/Deny Animal Control Contract 0:58:15 City Manager Brandon Green stated he has received the 2012 contract addendum for animal care and control from Davis County. The fees for Fruit Heights have decreased based on the number of calls received in 2011. Council Member Bette Hubrich made a motion to approve the Animal Care and Control Contract as presented. Council Member Diane Anderson seconded the motion. Council Member Don Carroll questioned if the city could pick up the dead animals to save costs. Because staff was unsure of what could be properly disposed of and if it would save the city money, Mayor Todd Stevenson recommended waiting another year to see what the trend is in dead animal pick up. A vote was taken on the motion and it passed unanimously. B. Discuss/Approve/Deny Ordinance 2012-04 Enacting and Codifying Title 3A – Administration 1:08:19 City Manager Brandon Green stated the changes to the city code presented tonight pertain to appointed offices, departments, boards, committees, personnel, government records and procurement. It repeals Chapter 6, 7, 8 and 9 of the existing Title 1 of the Fruit Heights Municipal Code. There are changes to the verbiage regarding updating the code to conform to Utah State laws and numbering of the code. There are no substantial changes made to the ordinance. 3 Fruit Heights City Council Meeting May 1, 2012 Mayor Todd Stevenson recommended the council not pass this tonight and requested the city manager put the red-lined version in the council’s drop-box so they can read the entire document. Council Member Eileen Moss made a motion to table this item. Council Member Craig Hill seconded the motion and it passed unanimously. Council Member Hill stated he would like the ordinance to set a monetary amount to determine when it is necessary for a contractor to prequalify to demonstrate sufficient experience and capability to perform the work. C. Discuss/Approve/Deny Open Space Ordinance 2012-05 1:14:28 City Planner Jeff Oyler discussed the proposed Open Space Zone Ordinance. The council has discussed this ordinance previously. City Planner Oyler stated the city attorney has reviewed the ordinance and cautioned the council about using the ordinance on privately owned property without the property owner’s permission. If this ordinance passes, staff will come back later with a map proposing which properties to zone as Open Space. The Planning Commission held a public hearing and recommends approval of Ordinance 2012-05. Council Member Craig Hill made a motion to approve Ordinance 2012-05 relating to the open space zoning districts. Council Member Don Carroll seconded the motion and it passed with the following vote: AYES: Hill, Carroll, Anderson, Hubrich, Moss NAYES: None D. Discuss FY 2011-2012 Budget and Amendments E. Discussion of FY 2012-2013 Budget F. Discussion/Pedestrian Safety Sidewalk Program 1:21:18 City Manager Brandon Green stated the tentative budget will be presented at the next council meeting. Tonight he went over the current budget and discussed some items the council will be considering before adopting next year’s budget. He stated the city has some major projects that need to be completed during the upcoming year and the City Council will prioritize those projects. It was decided the next three City Council meetings will begin at 6:00 PM to hold discussions on next year’s budget. City Engineer Brandon Jones stated the city has been awarded another grant for safe sidewalks from UDOT. The city will install a sidewalk on Main Street (State Highway 106) from the Fairway Cove Subdivision north to the Ivory Homes development. First, a water line has to be installed under the sidewalk at the city’s expense. The new sidewalk will complete the sidewalk from Cherry Hill to the Ivory Homes development. 4 Fruit Heights City Council Meeting May 1, 2012 City Engineer Jones stated he continues to work on the realignment of Hidden Valley Road and the driveway exiting the Apple Acres Mobile Home Court onto Main Street. Those two accesses are next to each other and do not align with the new road in the Ivory Homes Subdivision in Kaysville on the other side of Main Street. He is hoping Ivory Homes will contribute to the cost of the project. Mayor Todd Stevenson stated he will talk to Chris Peterson of UDOT regarding the situation. City Engineer Jones stated the sidewalk needs to be built this year to avoid losing the funding received two years ago. 5. DEPARTMENT AND CITY OFFICIAL REPORTS A. City Engineer’s Report No report was made. B. City Planner’s Report No report was made. C. City Manager’s Report City Manager Brandon Green reported there is an issue at the Nicholls Park boweries where some people aren’t leaving when the next party, which has the bowery reserved, arrives. Council Member Eileen Moss suggested installing large signs on the boweries explaining the rules and the fact that the boweries are available by making a reservation. D. City Council Members’ Reports Council Member Diane Anderson requested any suggestions from the council members regarding the Founder’s Day festivities be forwarded to her and she will forward the comments to the committee. Council Member Craig Hill reported the Davis High School Marching Band will participate in the 2013 Rose Parade in Pasadena, California. He and Mayor Steve Hiatt of Kaysville presented the band a key to the cities. The band members are raising $200,000 for the trip. On May 18 and 19 the band is hosting two basketball games with the second string of the Harlem Globetrotters at Davis High School. He, the Mayor of Kaysville, other dignitaries from the cities, personalities from local television stations and the governor will be playing against them as part of the fundraising efforts. Mayor Todd Stevenson recommended the city support their efforts. 5 Fruit Heights City Council Meeting May 1, 2012 Council Member Bette Hubrich reported there is a city clean-up day on Saturday. Volunteers from the Youth City Council are working on service projects. Council Member Craig Hill stated Doug Brunnette would like to be a member of the Trails Committee. Council Member Don Carroll stated he thinks Kaysville residents should be invited to the Trails Committee meetings and participate, but he doesn’t think they should be a member of the committee. City Manager Brandon Green stated the Kaysville residents have a personal interest in the trail but they may not have the best interests of the city in mind. Mayor Stevenson stated they should be invited to the meetings. Council Member Eileen Moss reported the Tri-City Emergency Preparedness Fair was held last weekend in Farmington. About twelve emergency can food kits were donated and will be stored at the city. E. Mayor’s Report No report was made. 6. CLOSED MEETING A closed meeting was not held. 7. ADJOURNMENT Council Member Eileen Moss made a motion to adjourn, seconded by Council Member Bette Hubrich. The meeting adjourned at 9:45 PM.
