MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road July 17, 2012 REGULAR MEETING The regular meeting of the Fruit Heights City Council was called to order by Mayor Todd Stevenson at 7:00 PM. The Pledge of Allegiance was recited and Don Carroll gave a prayer for the opening ceremony. COUNCIL MEMBERS PRESENT: Council Members Diane Anderson, Don Carroll, Craig Hill, Bette Hubrich and Eileen Moss and Mayor Todd Stevenson STAFF PRESENT: City Manager Brandon Green, City Engineer Brandon Jones, City Planner Jeff Oyler and Recording Secretary Susan Cranford VISITORS: Jerry Thompson, Anna Auger, Kelsey Jepperson, Sydney Barker, Carie Thompson, Nancy Hall, Sheri Hamilton, Carrie Dichser, and Sam Haymes Agenda Item: 2. APPROVAL OF MINUTES OF MEETING - July 10, 2012 Council Member Eileen Moss made a motion to approve the minutes of July 10, 2012, with corrections. Council Member Bette Hubrich seconded the motion and it passed unanimously. 3. SPECIAL PRESENTATIONS Items from the Public Resident Richard Hepner stated he spoke to the City Council regarding his detention basin on May 1 and has not received a response from City Manager Brandon Green. He stated he has a detention basin on his property that he maintains and the homes in his neighborhood drain their storm water into the basin. He requested the city remove the monthly $10.40 storm water fee from his city utility bill. Mr. Hepner stated he also has a problem with a neighbor who parks his truck and trailer on the street for months at a time. City Manager Green and the Sheriff’s office have requested the neighbor move his trailer, but he refuses to do so. Mr. Hepner stated the vehicle presents a hazard and he would like the city ordinance enforced. 1 Fruit Heights City Council Meeting July 17, 2012 4. NEW BUSINESS A. Request for Support from Miss Fruit Heights/Kaysville Pageant Committee Carie Thompson, Director of the Miss Kaysville/Fruit Heights Pageant, introduced the newly crowned Miss Kaysville/Fruit Heights, Anna Auger, and her two attendants, Kelsey Jepperson and Sydney Barker. Ms. Thompson thanked the council for their support in the past. Council Member Craig Hill made a motion to contribute $500 to the Miss Kaysville/Fruit Heights Pageant. Council Member Don Carroll seconded the motion and it passed unanimously. B. Presentation from Emma Dugal Requesting Support and Discussion Regarding Summerfest Emma Dugal, Executive Director of the Bountiful/Davis Art Center, stated her appreciation for last year’s support from the Mayor and City Council. She stated that this year’s Summerfest will be held August 8 through 11. The event will be held at the Bountiful City Park and includes an art festival and international performances from five continents. She requested support for this year’s event. She stated they are still looking for host families to house those participating. Mayor Todd Stevenson stated the event will be mentioned on the city’s website. Council Member Bette Hubrich made a motion to approve $500 as a donation to the Bountiful/Davis Art Festival. Council Member Diane Anderson seconded the motion and it passed unanimously. C. Discuss/Approve/Deny Purchase Request for a GPS Mapping System City Engineer Brandon Jones recommended the city purchase a high accuracy GIS system with a map quality GPS system. He stated this would be a worthwhile purchase for the city and greatly benefit the public works staff. The unit can inform staff where underground utilities are located. The current maps the city has are not accurate enough. The system will create a data base for the city showing vertical and horizontal locations of underground utilities. Currently the city uses an auto-cad mapping system which only shows there is a utility line under the road. This will have all the information on one data base. City Manager Brandon Green stated the city will be able to determine the type and diameter of the underground pipe with this system. 2 Fruit Heights City Council Meeting July 17, 2012 City Engineer Jones stated the GIS system will allow different information to be attached to the system. It will be a good investment for the city in the long term. When a water line breaks, staff will quickly be able access information about the line. The GIS system will also be useful for mapping trails, land drains and be beneficial if the city gets a cemetery. City Manager Green stated the purchase price for a GeoXH Handheld device with software and training is $19,280.90. Council Member Don Carroll made a motion to purchase a GeoXH Handheld mapping device including all attachments as outlined in the proposal from Monsen Engineering Inc. dated July 12. Council Member Craig Hill seconded the motion and it passed unanimously. D. Final Approval – Lanes End Farm Phase 1 (Amended) City Planner Jeff Oyler stated Mark Smith is requesting an amendment to lots 109, 110 and 111 in Lanes End Farm Phase 1. Three lots will be combined into two lots, creating lots 128 and 129. The purpose is to allow Mr. Smith to build an addition to his home. The new lots meet all the setback and size requirements for the zone. Staff recommends granting final approval of Lanes End Farm Subdivision Phase 1, First Amendment. Council Member Eileen Moss suggested the two lots have the same setback and landscape restrictions placed on them as did lots 109, 110 and 111. City Planner Oyler agreed that would be a good idea. Council Member Eileen Moss made a motion to approve Lanes End Farm Phase 1, First Amendment, as recommended by staff with the caveat that an “R” (restriction) be placed on lots 128 and 129 showing the same restrictions as on the original subdivision. Council Member Craig Hill seconded the motion and it passed unanimously. E. Discuss/Approve/Deny Extension of the Moratorium on the R-3 Zoning, Ordinance 2012-01 City Planner Jeff Oyler stated on January 3 the City Council placed a six-month moratorium on areas in the city having a zoning designation of R-3 Multi-Family Housing while staff worked on rewriting the zoning requirements. Staff and the Planning Commission have been working on the new ordinance. City Planner Oyler recommended the council extend the moratorium for a few more months. Council Member Craig Hill made a motion to extend the moratorium on the R-3 Zone until October 3, 2012. Council Member Don Carroll seconded the motion and it passed unanimously. 3 Fruit Heights City Council Meeting July 17, 2012 F. Discussion Regarding the Draft of the Proposed R-3 Multi-Family Residential Ordinance City Planner Jeff Oyler presented the City Council the draft of the proposed R-3 Residential Multi-Family ordinance for their review. He stated that the only property in the city that the proposed R-3 zone would affect is the former motel property on Lloyd Road. At a later date other properties in the city may be zoned R-3. It was decided to have the council members review the proposed ordinance during the week and discuss it at the next council meeting. 5. OLD BUSINESS A. Discussion on Implementing a City-Wide Recycling Program City Manager Brandon Green stated some individuals in the city have requested the city start a curbside recycling program. A recycling company has been circulating flyers on Robinson Waste garbage cans saying their company can provide a recycling service at no cost if the homeowner will return their second garbage can to the city. Robinson Waste provides the garbage service for Fruit Heights. Steve Robinson of Robinson Waste said that if many residents return their second garbage can, they will have to raise their rates. Robinson Waste would also like to provide a recycling program in the city and Steve Robinson said he believes he can do it for about $4 a household if enough residents participate. City Manager Green stated he won’t be able to put a survey questionnaire regarding a recycling program on the city’s website until September. Mayor Todd Stevenson suggested a one-question survey be sent with the next utility bill asking if the residents are willing to participate in a recycling program for a cost of $4 or $6 per month. He stated the council would like to have a sense of what the community wants before deciding whether to have a recycling program. Council Member Eileen Moss commented that there are residents who want to know if it will be a mandatory or voluntary program. She stated there are some who don’t want another garbage can. Council Member Bette Hubrich stated some residents already pay a private contractor to pick up their recyclables and they have signed a year-long contract. If that contractor isn’t the one chosen to do the city’s recycling program, it will present a problem for them. Council Member Diane Anderson suggested the survey inform the citizens that the council feels strongly about recycling and wants to know what the community feels. 4 Fruit Heights City Council Meeting July 17, 2012 Council Member Don Carroll stated the council will only get the vocal minority to respond to a survey. He suggested the council members ask their neighbors. City Manager Green stated Farmington City has a successful recycling program. They have 75 percent participation with an opt-out program. Resident Sherry Hamilton stated she currently is paying $10 a month for a recycling pickup. She stated she thinks the city should have a recycling program and suggested the City Council implement a program right away. Mayor Stevenson stated the council would like to have an idea what the residents want before making a final decision. City Manager Brandon Green stated a survey notice will be placed in the RidgeRunner on August 1. B. Discuss/Approve/Deny Electronic Agendas and Packets Mayor Todd Stevenson stated this item was discussed at the last City Council meeting. City Manager Brandon Green stated he spoke to City Attorney Todd Godfrey about the implications of council members having a city-owned electronic device such as an I pad for city business. He recommends the city purchase the devices and reminded the council that, if a legal issue arises, the court will confiscate the devices. City Manager Green stated the electronic devices will save the city staff time and money. Council Member Anderson stated it will also allow council members quicker access to information. Council Member Diane Anderson made a motion to approve the request to use electronic devices for agendas and packets. Council Member Bette Hubrich seconded the motion and it passed unanimously. Mayor Stevenson stated City Manager Green will bring back a recommendation for which device to purchase. 6. DEPARTMENT AND CITY OFFICIAL REPORTS A. City Engineer’s Report No report was made. B. City Planner’s Report 5 No report was made. Fruit Heights City Council Meeting July 17, 2012 C. City Manager’s Report City Manager Brandon Green stated the Davis County Justice Court would like to dissolve because it is not making money. Two years ago the Fruit Heights Justice Court dissolved and the County Justice Court began handling the city’s court cases. Davis County is now requesting the District Court handle the cases. The process will take two years to go through the dissolution process. Council Member Bette Hubrich stated she will keep track of the proposal through the Utah League of Cities and Towns. City Manager Green stated he spoke to resident Jay Burton on North Mountain Road and together they resolved the conflict with his property. He has requested the property management team of Al’s Apple Acres clean up the debris along Hidden Valley Drive. They have agreed to clean up the area. D. City Council Members’ Reports Council Member Bette Hubrich stated the Parks and Trails Committee met Friday morning in the hollow at Nicholls Park. She stated it will be a very large project but she is pleased with the amazing expertise on the committee. Council Member Eileen Moss stated a training session will be held in August and September for CERT members and Area Coordinators. E. Mayor’s Report No report was made. 7. CLOSED MEETING A closed meeting was not held. 8. ADJOURNMENT Council Member Diane Anderson made a motion to adjourn, seconded by Bette Hubrich. The meeting adjourned at 9:20 PM.
