MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road July 10, 2012 REGULAR MEETING The regular meeting of the Fruit Heights City Council was called to order by Mayor Todd Stevenson at 7:00 PM. The Pledge of Allegiance was recited and Craig Hill gave a prayer for the opening ceremony. COUNCIL MEMBERS PRESENT: Council Members Diane Anderson, Craig Hill, Bette Hubrich and Eileen Moss and Mayor Todd Stevenson STAFF PRESENT: City Manager Brandon Green, City Engineer Brandon Jones, City Planner Jeff Oyler and Recording Secretary Susan Cranford VISITORS: Carie Thompson, Jerry Thompson, Laura Hubrich, Ryan Hubrich, Kendall Treadwell, Elise Anderson and Clint Davis Agenda Item: 2. APPROVAL OF MINUTES OF MEETING – June 19, 2012 Council Member Craig Hill made a motion to approve the draft of the minutes of June 19, 2012. Council Member Diane Anderson seconded the motion and it passed unanimously by those in attendance. 3. SPECIAL PRESENTATIONS Items from the Public Carie Thompson, Director of the Miss Kaysville/Fruit Heights Pageant, invited the Mayor and council members to the pageant to be held July 14. She thanked the council for the use of city hall during the year and requested a contribution from Fruit Heights for this year’s pageant. Last year the city contributed $500 to the pageant. City Manager Brandon Green stated money is in the budget for the Miss Kaysville/Fruit Heights Pageant and two other groups. Mayor Todd Stevenson stated the Miss Kaysville/Fruit Heights Pageant is an excellent civic activity that benefits the community. The council will meet next Tuesday and will have this item on the agenda to discuss how much the city would like to contribute. 1 Fruit Heights City Council Meeting July 10, 2012 Kendall Treadwell and Elise Anderson of the Fruit Heights Youth City Council (YCC) presented the City Council with a trophy they received for the float they entered in the July 4 parade for Best Use of Theme. Mayor Todd Stevenson congratulated the YCC for their excellent float and stated the trophy will be on display at city hall. 4. NEW BUSINESS A. Swearing in of Newly Appointed Planning Commission Members 0:12:40 Mayor Todd Stevenson stated new Planning Commission members will not be sworn in tonight, as stated on the agenda, but shall be appointed tonight. Two Planning Commissioner’s terms have expired and both have applied for renewal. No other applications were received. Mayor Todd Stevenson recommended that Susan Hunt and Kristi Bybee be reappointed to the Planning Commission. Council Member Bette Hubrich made a motion to reappoint Susan Hunt and Kristi Bybee to the Planning Commission. Council Member Eileen Moss seconded the motion and it was approved unanimously by those in attendance. Council Member Hubrich requested the next RidgeRunner express the appreciation of the City Council to the Planning Commission members for their service and mention the two reappointments. B. Discuss/Approve/Deny Electronic Meeting Agendas and Council Packets City Manager Brandon Green stated he would like to move away from paper agenda packets and start using electronic devices to disperse information for upcoming City Council meetings. This would save the city time and money. An electronic device will allow the council members to take notes, share information, store information, review documents and calendar events. City Manager Green stated several other cities use an electronic device for city purposes. The council discussed the types of electronic devices available and associated costs. City Manager Green will talk to the city accountant, Steve Davis, regarding tax implications for giving the council an electronic device. He will also speak to the city attorney for advice on placing personal information on such a device. C. Discuss/Approve/Deny Purchase Request for New Parks Mower City Manager Brandon Green stated the city currently has two lawn mowers that are 12 years old. The Public Works Department recommends the purchase of a large diesel mower for the larger parks. The purchase price for a Toro Groundsmaster 4500-D is $51,880.23. This item is in the budget. 2 Fruit Heights City Council Meeting July 10, 2012 Council Member Eileen Moss made a motion to approve the purchase of the 4500-D Toro mower as recommended by the Public Works Department and city staff. Council Member Bette Hubrich seconded the motion and it passed unanimously by those in attendance. D. Discuss/Approve/Deny Title 5A – Revenue and Finance 0:48:05 City Manager Brandon Green stated the City Council has previously directed staff to evaluate, review and revise the Fruit Heights City Municipal Code to provide necessary updates in accordance with State legislative amendments. Title 5A is new to the city ordinances. The section includes revenue and finance including provisions related to accounts and accounting, budgets, expenditures, property tax and sales and use tax. It restates what current state law requires. The council discussed the proposed ordinance. City Manager Green recommends approving Title 5A as written by the City Attorney’s office. Council Member Eileen Moss made a motion to approve Ordinance 2012-07 regarding revenue and finance. Council Member Craig Hill seconded the motion and the motion passed with the following vote: AYES: Moss, Hill, Anderson, Hubrich NAYES: None ABSENT: Carroll E. Discussion Regarding Budgeted City Projects 58:10:00 City Manager Brandon Green stated he would like some direction from the City Council regarding prioritizing capital improvement projects in the city. Projects budgeted this year are:  Safe Sidewalk project on Main Street from Cherry Hill to Hidden Valley Drive  Safe Sidewalk project on Main Street from the Fairway Cove Subdivision to the Orchard Farm Subdivision  Waterline project on Main Street under the sidewalk from the Fairway Cove Subdivision to the Orchard Farm Subdivision  Widening of Nicholls Road from the Orchard Farm subdivision to Dale Green’s subdivision  Land drain project on Country Road City Manager Green stated the land drain on Country Road needs to be done soon because residents continue to get water in their basements. He stated the original land drain was not installed properly and the city doesn’t have a record of the land drain. 3 Fruit Heights City Council Meeting July 10, 2012 Council Member Craig Hill suggested a special improvement district be made for failing land drains. He recommended the property owners participate in the cost of the project. City Engineer Brandon Jones stated the city will install the main land drain and the residents will pick up the costs for the lateral line which could be significant. He suggested the city charge a connection fee for those that want to participate. The sewer district might provide some enforcement on those who continue to drain into the sewer line. He recommended the city hold an informational meeting with the residents to discuss projected costs and inform them the city cannot afford to fund the entire project. Council Member Eileen Moss stated the residents should be informed that they cannot have a sump pump draining into the sewer lines. They will be required to drain into the storm water system. City Manager Green stated Christine Gailey wants to sign an agreement with the city right away securing the transfer of a section of her property north of Nicholls Road to the city. City Manager Green stated he is working with Senator Orrin Hatch’s office regarding acquiring some property on the hillside off of Eastoaks for the land drain project in that area. The city needs an easement for the land drain unless the city can acquire the property. After discussion of the projects, it was decided the do the following projects now: both safe sidewalks and the water line on Main Street, the land drain on Country Road and design the Nicholls Road improvement. The city will set a date for the meeting with the residents on Country Road in August. 5. OLD BUSINESS A. Discuss/Approve/Deny Warranty Period for the Bichler/Taylor (Oxford Downs) Subdivision This item was tabled by the council. B. Discussion on Implementing a City-Wide Recycling Program This item was tabled by the council. 6. CONSENT CALENDAR Check Register – June 4 Council Member Eileen Moss suggested the city consider refinancing the loan with the Hinckleys to get a lower rate on the existing loan. City Manager Brandon Green will look into it. Fruit Heights City Council Meeting July 10, 2012 Council Member Craig Hill made a motion to approve the check register for June. Council Member Eileen Moss seconded the motion and it passed unanimously by those in attendance. 7. DEPARTMENT AND CITY OFFICIAL REPORTS A. City Engineer’s Report No report was made. B. City Planner’s Report City Planner Jeff Oyler stated the City Council will discuss the draft of the proposed R-3 Multi-Family Residential zone at their next meeting. The Council may want to extend the length of the moratorium on the R-3 zone at that time. The Planning Commission will hold a public hearing on the proposed ordinance soon. He will bring in a recommendation for open space areas in the city. C. City Manager’s Report City Manager Brandon Green reported:  He received a letter from resident Jay Burton saying he may file a suit against the city for his property that was used for the North Mountain Road project. City Manager Green will talk to Mr. Burton.  He will find out who the property owner is on the corner of Charlais and the Park and Ride lot because there are weeds on the property that create a fire hazard.  Council Member Diane Anderson requested a note be placed in the next RidgeRunner thanking the residents for protecting the mountainside and not using fireworks east of Mountain Road on July 4. D. City Council Members’ Reports Council Member Eileen Moss suggested City Manager Green look into the feasibility of acquiring property on the east bench for possible use as a city cemetery. Council Member Bette Hubrich reported the trail through Nicholls Park will be marked Friday morning and invited the council to attend. She requested a change to the ordinance recently passed referring to the Trails Committee. It should have been called the Parks and Trails Committee. City Manager Green will put it on the next agenda. Council Member Diane Anderson reported the Founder’s Day Committee has been working hard. They are seeking suggestions for someone to sing the national anthem 5 at the picnic. She stated her appreciation for Katie Naylor for her assistance at the July 4 events. ADJOURNMENT Council Member Bette Hubrich made a motion to adjourn, seconded by Council Member Craig Hill. The meeting adjourned at 9:15 PM.
