CITY COUNCIL MEETING
FRUIT HEIGHTS CITY

November 7, 2023
WELCOME: Mayor John Pohlman called the meeting to order at 7:01 pm.
PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was led by Council Member
Diane Anderson with Mayor John Pohlman conducting the opening ceremony by offering a word
of prayer.
COUNCIL MEMBERS PRESENT: Mayor John Pohlman, Council Members Gary Anderson,
George Ray, Diane Anderson, Florence Sadler, and Eileen Moss.
CITY STAFF PRESENT: Assistant City Manager Darren Frandsen, City Attorney Brad
Christopherson, City Planner Jeff Oyler, Deputy Recorder Hailee Ballingham, and Recording
Secretary Lindsay Golightly.
VISITORS: Criminal Analyst Elizabeth Pinto, Lt. Josh Boucher, Sheriff Jason Gardiner, Mark
Cottrell, Celeste Cottrell, Shon Stevenson, Mason Groberg, and Josh Cox.
CITY COUNCIL TRAINING: Council Member Florence Sadler chose to provide training on
elections. She feels that we are lucky to live in such a progressive County as far as voting goes.
She discussed how Davis County tries hard to make sure that everyone has an opportunity to
vote. She explained that every four years City Council Members are up for re-election. She then
invited people to please come vote.
SPECIAL PRESENTATIONS:
YCC Report
YCC Members Josh Cox and Mason Groberg reported that last month’s activity, the trunk or
treat, was a success. They then explained that next month’s activity will be the debate with
Kaysville YCC on the Federal student loan debt. December's activity will be doing a food and
clothing drive along with the Nativity here at the city building. Mayor John Pohlman
congratulated them on their trunk-or-treat activity. Last night the YCC held a mock election
voting for the Sewer District and the City Council. Council Member Eileen Moss reported that
the Bountiful Food Bank was almost bare and that the YCC should promote their food drive.
Sheriff’s Department Report
Sargent Jason Gardiner and Criminal Analyst Elizabeth Pinto provided a quarterly report for
August 1-October 31, 2023. Sargent Jason Gardiner reported that there was an average of 9.75
hours spent in the city per day, with a total of 716 dispatched calls. In this quarter there were 166
non-criminal calls, 6 person crimes, 7 property crimes, 12 society crimes, 451 traffic calls with
57 citations 5 written warnings, and 32 medical calls. Criminal Analyst Elizabeth Pinto reported
that 7 cases were investigated in the last quarter. Those cases include 2 forgery/fraud cases, 1
case each of theft, harassment/threats, sex offense, weapons offense (gun), and aggravated
assault.
PUBLIC COMMENTS: None.
PUBLIC HEARING:
Vacation of a Portion of Grandison Court
Council Member Eileen Moss made a motion to move into a public hearing to discuss the
vacation of a portion of Grandison with Council Member Gary Anderson seconding the motion.
The motion was unanimously approved by the Council. (13:30)
Assistant City Manager Darren Frandsen provided background information explaining that
Geotech would like to remove street and extend property lots. He explained that the Planning
Commission approved the change on condition the Council approved the vacation of Grandison
Court. The easements previously in place will not be affected by the buildable lots. He also
explained that there was a small triangle of property that was not caught until phase 1A was
already recorded with the county without that triangle. The triangle remained county property
and we need to annex it into the City.
Council Member Diane Anderson made a motion to close the public meeting with Council
Member Florence Sadler seconding the motion. The motion was unanimously approved by the
Council. (20:18)
Council Member Diane Anderson made a motion to approve ordinance 2023-05, vacating a
portion of Grandison Court in the Rock Loft Ridge subdivision with Council Member Florence
Sadler seconding the motion. The motion was unanimously approved by the Council by roll call
vote. (21:07)
Municipal Code Update: Title 7A Health, Safety, and Welfare
Council Member Diane Anderson made a motion to move into a public hearing to discuss the
update to municipal code Title 7A Health, Safety, and Welfare with Council Member Gary
Anderson seconded the motion. The motion was unanimously approved by the Council. (21:32)
City Attorney Brad Christopherson explained that they are in the process of updating city codes
to reflect the changes to state code requirements.
There was some discussion on the suggested changes that Council Member Moss had made as
well as some additional comments.
There was some discussion about a part of the ordinance giving the Mayor discretion to waive
waste management fees for certain at-risk individuals and whether or not that was a good idea. It
was determined that to maintain the privacy of individuals at the Mayor's discretion would be the
most effective way to allow that to happen.
Council Member Gary Anderson makes a motion to move out of the public hearing with Council
Member Diane Anderson seconding the motion. The motion was unanimously approved by the
Council. (36:40)
After some discussion Council Member Eileen Moss made a motion to approve the Municipal
Code update Title 7A health, safety, and welfare with the outlined changes with Council Member
Gary Anderson seconding the motion. The motion was unanimously approved by the Council by
roll call vote. (37:30)

Council Member George Ray reported that he has looked through and discussed any questions
and reported that everything looked good.
REVIEW AND APPROVAL OF MINUTES FROM PREVIOUS MEETINGS:
October 3, 2023, City Council Meeting Minutes
Council Member Eileen Moss made a motion to approve the October 3, 2023, City Council
Meeting Minutes with corrections with Council Member Gary Anderson seconding the motion.
The motion was unanimously approved by the Council. (39:43)
UPCOMING EVENTS:
November 10 – Veterans Day
November 17 – Planning Commission Meeting
November 21 – General Election Day 8 am – 8 pm at the City Hall Council Chambers
November 23 – Thanksgiving Day, the City Office will be closed
CITY COUNCIL & STAFF REPORTS:
Council Member Gary Anderson reported that he feels the meet the candidate’s night went well.
Council Member George Ray reported that at the Wasatch Regional meeting, they worked on
highlighting the maps where they thought trails could go.
Council Member Eileen Moss reported that at the Wasatch Regional Meeting, she was with
Farmington and reported that they still have a trail going up Nichols Road and that there just is
not enough room to add a trail for an active transportation section. There was discussion on what
cities, UDOT or citizens be willing to pay for an active transportation trail alongside a road.
Council Member Eileen Moss also reported that there has previously been a lot of interest in
traffic around the city. While she was and about talking to citizens she received some
suggestions on how to slow traffic and a suggestion to allow a volunteer committee to discuss
how we are going to accomplish some traffic calming strategies.
Mayor John Pohlman reported that they have had continued discussions with a trail builder to
add biking and hiking areas. There are a couple of hiccups, one being funding and the other
being permission from the Forrest Service. Mayor John Pohlman reported that the Kaysville,
Farmington, and Fruit Heights group that we set aside $500 to provide mental health support to
individuals in our cities started last week.
Mayor John Pohlman also reported that he sits on the Wasatch Integrated Waste board and last
week the Garbage district passed a resolution to bundle recycling. Some studies they conducted
found that the most effective way to recycle is to separate it at the curb rather than at the facility.
The system they are currently employing is not working efficiently so they are moving forward
to bundle recycling and providing a recycling can at the curb. The fees and the rates will be
lower because the trucks will no longer have to go to SLC and they will to the Davis Landfill
instead. This decision is coming from the Garbage District and we have to do it or there will be a
fine. We are currently 5th in the county without doing anything due to voluntary green waste cans
but they want cities to be above 20%. They call it a bundled program, but it is mandatory.
Assistant City Manager Darren Frandsen reported that they have tried different methods for
traffic calming by adding striping, bike lanes, and painted speeds. He reported that on Nichols
the average speed was 28 mph.
City Planner Jeff Oyler reported that they are getting close to some of the land use ordinance
work on updating the ordinances.
City Attorney Brad Christopherson reported that there is a 2024 deadline to change the
subdivision process and he will be being paid through a grant from the State on that.
Council Member Eileen Moss made a motion to move into a closed session to discuss the
professional competency of an employee with Council Member Diane Anderson seconding the
motion. The motion was unanimously approved by the Council. (1:08:02)
CLOSED SESSION:
The City Council may vote to discuss matters in a closed session for reasons allowed by law,
including, but not limited to, the provisions of Utah Code § 52-4-205 of the Open and Public
Meetings Act, and for attorney-client matters that are privileged pursuant to Utah Code § 52-4-202.
The meeting was adjourned at 9:09 pm.
