WELCOME:
Mayor pro temp Eileen Moss called the meeting to order at 7:00 pm.
PLEDGE & OPENING CEREMONY:
The Pledge of Allegiance was led by Mayor pro temp Eilleen Moss with Council Member Florence Sadler
conducting the opening ceremony by prayer.
COUNCIL MEMBERS PRESENT:
Mayor pro temp Eileen Moss, Council Members, Mark Cottrell, George Ray and Florence Sadler. Mayor
John Pohlman and Council Member Gary Anderson were excused.

PRESENTATIONS:
YCC Report. London Jacobs, Lauren Clark and Caleb Murdock presented the report. For October activities, the
Fruit Heights City YCC and Kaysville YCC collaborated with a mother and daughter from Fruit Heights to organize
"Fable Forest." The YCC collected over one thousand pounds ions to take to the Bountiful Food Pantry. The YCC
also conducted a mock vote for the elections. For the December activities, they will be writing letters to senior
members of the community and organizing food donations. Food donations can be dropped off at the city
office building and at the Christmas in the Community event on December 15, 2024.
PUBLIC COMMENT:
Charlie Barnes: Our mayor, John Pohlman, was elected to represent the people of Fruit Heights. The mayor
should work with the city council to establish general policies. However, it seems that Mayor Pohlman has been
pursuing his own agenda and not being transparent. He misled both the city council and residents regarding
certain decisions he has made. It is important for elected officials to represent the will of the people, not their
own interests. Mayor Pohlman’s actions have not been acceptable, and he has not been open or honest with
those he represents. The community needs a mayor who prioritizes the city's interests and can be trusted to
make decisions in the best interest of everyone.
Steven Rummler: He wanted to express his gratitude to Mountain Road Church for their kindness and
willingness to consider the Code Blue Shelter program. He also appreciates the mayor and city council for
balancing the interests of residents, even though not everyone may agree with their decisions. It is important to
acknowledge the challenges public servants face in complying with state requirements and programs. Let's
show compassion and understanding towards them.
Heather Everton: She addressed the ongoing controversy surrounding the Code Blue Shelter proposal which
has caused division in the community. The issue is not about helping the homeless, but rather about how
Mayor Pohlman initiated and managed the proposal. Mayor Pohlman has overstepped his authority by making
decisions without input from the City Council, misleading citizens, and lacking transparency. Several instances,
including the Code Blue Shelter, a proposed walking trail, and a law enforcement coverage change, have
highlighted Mayor Pohlman’s disregard for proper procedure and transparency. Heather, along with a team of
neighbors, has gathered evidence supporting the belief that Mayor Pohlman should be removed from his
position due to repeated instances of evasive behavior and poor judgment.
DISCUSSION ITEMS:
5.1 Culinary Water Rates for January 2025 & Consolidated Fee Schedule
The building permits highlight important aspects regarding financial obligations. There is an account that holds
funds for incomplete building projects if no final inspection is done or incomplete work is found or is
ongoing. Requests for increased guaranteed amounts ensure completion of projects by responsible
parties. Overall, these measures aim to maintain accountability in construction projects.
The landscaping fee would apply to the Rock Loft Ridge homes. They will not have secondary water and will be
watering with culinary water. There will be a Plan Review and 3 inspections to verify things are being done
correctly. The city also updates their stormwater permit and violation fees. The State has just passed a new law
that cities cannot fine the developer for violations. There is a lot of push back on this issue. The law may go
into effect January 2025. The city will hold a public hearing to take these fees out of the consolidated fee
schedule. Last year, there were impact and water studies conducted. Zions Bank was hired to establish impact
fees and a water study for the upcoming year was also done. In February, the council approved the current
impact fee schedule. There is a proposed water rate increase of about 10% by Zions Bank, with water rates and
base fees to go up until 2031 to cover increased costs for water purchased from Weber Basin. The proposed
plan includes a $1.40 base rate increase this year and further increases in subsequent years.
Council Member Ray asked about baseball diamond rental fees. The City Manager explained in the past we
would have people rent out baseball diamonds for tournaments. With the Highway 89 project there was a lot of
damage done to the park and took out part of the sprinkler system. It is the same fee we have charged in the
past, but we have not charged that fee due to the fields not being maintained. Public works have been working
all summer to get the sprinklers replaced and everything working in the system so we should see changes and
progress with this park next spring. Council Member Ray also asked about the different business license fees
and why some were more than others. The fee is based on what kind of impact it brings into the city.
The water impact fees were adopted for 2023, recommending a 7-10% increase annually. After analyzing the
data, a 5% increase for this year and a potential 7% increase for subsequent years were proposed. The base
rate covers monthly water costs, with the anticipation of increasing home construction to offset
costs. Concerns include decreased revenue from water conservation and necessitating budget adjustments for
maintenance and upgrades. While the city has been proactive in infrastructure improvements, future funding
sources must be considered for sustainable growth.
5.2 Recycle Program
Members of Wasatch Integrated Waste have voted to have green waste cans and recycling cans in every
community in Davis County. If this is not done, regular rates may increase significantly. The construction of a
recycling plant a few years ago initially aimed to recycle all waste at a single facility. However, due to expensive
machinery breakdowns, the plant now serves as a tipping station where most waste is hauled out of the
county. The facility remains open for individuals to bring their waste, but the majority of garbage truck waste is
being transported at a high cost. It is recommended that every community in Davis County implements a
recycling program to make better use of the recycling facility. This will help cut some costs for the city if we do
so.
Nathan Rich is the CEO and Executive Director of Wasatch Integrated Waste Management District. They are a
special service district owned by two counties, Davis County and Morgan County. He talked about the reason
for this recycling push. The landfill is filling up too fast and they are having to push on the higher cost due to the
hauling process. He talked about cities that have the program and the success they have seen with recycling
and the green waste materials being diverted from going into the landfill and not having to haul them out of
the county.
City Manager talked about the cost of the cans. The recycling cans would be $3.00 each per home. Per month
curbside pickup would be every other week. The first trash can would be $6.57, and the second can would be
$3.80. Green waste would be $4.49 with a three (3) year extension. All rates (not including fuel) will be
guaranteed until July 1, 2026.
5.3 City Council and Planning Commission Schedule of Meeting 2025
The city Council looked over the proposed schedule. City Council Meetings fall on the first and third Tuesday of
the month and Planning Commission is the fourth Tuesday. There are some deviations in April due to spring
break and November due to the election. Council Member asked what month the city caucus would be held in
if we had one. It will be on a Thursday in May, the exact date is not set at this time.

Election Process:
Brief discussion. Council Member Moss wants to keep the caucus system because it’s our city’s history and
moving to a primary would be an added cost. Council Member Cottrell expressed dislike towards the caucus
because there were not enough people in the upstairs meeting, and they had to beg individuals to run so they
could end the meeting. The ones elected didn’t even want to run. He talked about residents assuming that
Pinecone and Sagebrush represented parties like Republican and Democratic when the city is a non-partisan
system. The Council wants the staff to get a survey out to the community to see what the residents think. This
will be out in the next few months.
CITY COUNCIL REPORTS:
Council Member Sadler: The YCC had their mock election, the kids had fun, and it was a great learning
opportunity. She has been talking with the Christmas in the Community committee. They are looking for
youth 7-18 to sing in the choir at the event on December 15, 2024. They will be meeting on Saturday
afternoons to .
Council Member Cottrell: He went with the YCC to the Davis County Election Office to see how the ballot
counting prosses was done and he was very impressed. He thanked Council Members Sadler and Ray for
attending the Veterans Memorial dedication. There was a great turn out and the speaker did a fantastic job.
The total number of names on the rocks is 270 with more on the list to be included next year.
Council Member Moss: The Cemetery Committee is still having meetings. They are gathering numbers and
price points to bring to the Council.

CITY STAFF REPORTS:
Public Works Director Leonard informed us that the pump is out and being rebuilt. Things are on track and
moving smoothly.
City Manager Frandsen is getting ready to start working on the budget. There will be a public hearing in
January for the Culinary Water Rates and the Consolidated Fee Schedule. The public works teams are ready
for snowplowing when the weather starts.

Mayor and City Council,
I wanted to get the pricing for recycling out to the city council for the next meeting. I have been
working with Robinson Waste on pricing for the recycling hauling cost. We talked about the 3 year
extension of the current contract which has that option. I did say that may be a possibility, but I
would also need to have what the increase would be for the service we currently have (regular
garbage, extra cans, and green waste). Below is the pricing I received for Robinson Waste. This will
be a discussion item at the next meeting. If the City Council would like to move forward the staff
will begin the process of getting the information out
Robinson Waste is offering the following rates along with a request for a three (3) year
extension to the current agreement:
Every other week curbside recyclable collection:
Each Can: $3.00 per home per month.
In addition, Robinson Waste will keep the current rates for trash and green waste.
