CITY COUNCIL MEETING
FRUIT HEIGHTS CITY

February 4, 2025
WELCOME:
Mayor Pohlman called the meeting to order at 7:00 pm.
PLEDGE & OPENING CEREMONY:
The Pledge of Allegiance was led by Council Member Sadler with Council Member Moss conducting the
opening ceremony by prayer.
COUNCIL MEMBERS PRESENT:
Mayor John Pohlman, Council Members Gary Anderson, Eileen Moss, Florence Sadler, and R. Shon
Stevenson. Council Member Mark Cottrell was excused.
CITY STAFF PRESENT:
City Manager Darren Frandsen, Public Works Director Layne Leonard, City Planner Jeff Oyler and Deputy
Recorder Hailee Ballingham.
VISITORS:
Jim Crismer, Brandon Hurst, Mary Monson, Lane Monson, Davis County Sheriffs J. Robinson, T. West, J
Boucher and Davis County Commissioner Bob Stevenson.
DECLARATION OF CONFILICT(S) OF INTEREST: None
CITY COUNCIL TRAINING: Mayor Pohlman congratulated Council Member Stevenson and thanked him for his
willingness to serve. The mayor talked about the prosses of the meetings and the responsibility of the council.
PRESENTATIONS: Davis County Commissioner Bob Stevenson wanted to thank the council members and
residents for all their comments, questions and the support they have shown for the Cold Blue shelter. The
shelter had been in Layton and he felt like that was a perfect spot. Unfortunately, the building needed to be
torn down and so the county had to move it to Kaysville until March. The county is going to continue working
on solutions for the future to help the homeless in Davis County. They have learned a lot from this process
and have met a lot of great people who just want a warm place to sleep. They have had three families come in
and the county has put them in a hotel for the night due to safety issues.
4.1 YCC Report: The report was given by Mason, Josh B and Josh C. The YCC had their day on Capitol Hill. They
were able to talk with representatives and learned a lot. They will be doing a tour of the fire station next
Tuesday.
4.2 Davis County Sheriff’s Report: The report was given by Sheriff J. Boucher. He presented the 4th Quarter
2024 activity in Fruit Heights. (The full report can be found

DISCUSSION ITEMS:
5.1 Ordinance No. 2023-01 Title 10 Chapter 11 Sections 13 Swimming Pools Updated Setbacks
This ordinance has gone back and forth. The planning commission met again last week and made a
recommendation to move the setbacks from 8 feet to 6 feet. Over the last few years, the ordinance has been
changed from 6 feet then to 10 feet. Currently, it is 8 feet. With the recommendation it will move to 6 feet.
The request came from a resident who wanted it to be set to 3 feet. The council sent it to the planning
commission, and they did not agree with the 3 feet. They came back to the council to see if they would be
willing to change this setback. The Council said they would look at it. Then it went back to the planning
commission. A public hearing was held in October. In discussions, the setback went between 3 feet to 8 feet
and landed on 6 feet. The council talked about how this could affect the neighbors. The ordinance is not just
for those who want a pool. It is to protect neighbor’s rights and the relationship between property owners.
City Manager Frandsen suggested putting a 3–5-year moratorium on this ordinance.
5.2 Approval of 2025 Polling Locations and Voting Centers for Municipal Primary and General Elections
This is an approval from the council for city hall to be used as a voting center and to have the drop-off box.
Voters can drop off their ballots at any location in Davis County. The city contracts with the county to run our
city elections and all the ballots go there to be counted.
5.3 Resolution 2025-03 Accepting 6F Property from Utah Department of Transportation following the
expansion and reconstruction of HWY 89.
The property changes are related to Highway 89, which affected part of Nicholls Park, due to federal funding.
Any property taken from the park had to be replaced. The properties involved are 1322 East Green Road and
432 North Mountain Road. Together these properties will replace the part of the park that was taken to build
the highway. A resolution is needed for the city to agree to keep the property description intact so a deed can
be signed. The city must show progress regarding the park property as part of the resolution. This could be a
parking lot or a cul-de-sac for turning around for access to the park. The mayor remembers past discussions
about possibly adding dirt and sodding to be able to use it as a sledding hill in the winter. The property will
stay as public use.
5.4 Emergency Services with both Davis County Sheriff’s and Farmington Fire Department
Davis County Sheriff’s and the Farmington Fire Department discussed budget increases. Council Member
Cottrell and City Manager Frandsen met with Sheriff Sparks and Curtis Clark Koch to review the county's
budget and service costs. The sheriff's department will have a 3 to 3.5% increase this year, much lower than
the previous year’s estimate. They also met with the City Manager of Farmington regarding the fire
department's contract, which will most likely be a 5% increase. Farmington plans to build a new fire station
without increasing costs for Fruit Heights.
5.5 Budget for New Pavilions at Nicholls Park
City Manager Frandsen wants the council’s blessing to start researching options to replace the pavilions at
Nicholls Park. They have been there since the park was built and are falling apart and becoming unsafe. The
public works team has been looking at Ideas. They thought a barndominium structure with a kitchen and a
bathroom inside that people could rent for weddings and or other events might be a more viable option. The
council gave the go ahead to spend time gathering information and pricing to bring back to the council. They
want the parks to be brought back to life and to look better. If the pricing is right, they would not want to
start the project until October when the water is off and the city has wi-fi and cameras installed.
ACTION ITEMS:
6.1 Ordinance No. 2025-01 Tilt 10 Chapter 11 Sections 13 Swimming Pools Update to Setbacks
Council Member Shon Stevenson made a motion to Approve Ordinance 2025-01 with the setback to 6 feet.
The Council discussed putting a moratorium on this ordinance so there can’t be any changes for 5 years. They
do not want to keep wasting time and money on looking at this ordinance.
Council Member Stevenson made a motion to approve Ordinance 2025-01 with the setback to 6 feet and to
have a moratorium for 5 years. Council Member Gary Anderson seconded the motion. It was unanimously
approved by the council. (1:02).
6.2 Approve/Deny Approval of 2025 Polling Location and Vote Centers for Municipal Primary and General
Elections
Council Member Moss made a motion to approve the 2025 Polling Location and Vote Centers for both
Municipal Primary and General Elections. Council Member Anderson seconded the motion. It was unanimously
approved by the council. (1:03).
6.3 Approve/Deny Resolution 03-2025 Quit Claim Deed for 6F Highway 89 project
Council Member Anderson made a motion to Approve Resolution 03-2025 for a Quit Claim Deed for 6F
Highway 89 Project. Council Member Florence Sadler seconded the motion. It was unanimously approved by
the council. (1:04)
6.4 Approve January 7, 2025, City Council Minutes
Council Member Sadler made a motion to approve January 7, 2025, City Council Minutes with the
recommendation changes. Council Member Moss seconded the motion. It was unanimously approved by the
council. (0:05)
6.5 Approve January 29, 2025, Special Meeting to Fill Vacancy
Council Member Eileen Moss made a motion to approve January 29, 2025, Special Meeting to fill Vacancy with
the recommendation changes. Council Member Florence Sadler seconded the motion. It was unanimously
approved by the council. (0:06)

CITY COUNCIL REPORTS:
Council Member Sadler: CTC (Communities That Care) is looking for more volunteers.
Council Member Moss. The Cemetery Committee is continuing to meet to look over pricing to make the
cemetery a viable option. She has been looking at building the road to use for both the cemetery and for
wildfire access. The CCC is going to work with the YCC to hand out flyers to get information to prevent fires
from spreading from house to house.
Council Member Stevenson looks forward to the opportunity to serve this community.
MAYOR REPORT:
The mayor told the council Nathan Rich is retiring from Wasatch Integrated Waste in June and they are
starting the hiring process to fill the position. The mayor thanked the public works team for staying busy with
not having to plow, and thanked City Manager Frandsen for managing all the staff.
CITY STAFF REPORTS:
Planner Oyler: Modern income housing report was extended by the state. There is nothing more we can do
with our city being built out.
Public Works Director Leonard: The new loader was delivered, and they are still waiting for the new
snowplow truck. They should have it in a few weeks. The public works team is working on a few small
projects they can do with the warm weather.
City Manager Frandsen: Connext finished its last connection on Friday with laying the dark fiber. They have
a few places to splice and then we can get IT to connect then go live with faber at the city building and
Nicholls Park.

Council Member Moss made a motion to adjourn the meeting with Council Member Sadler seconding the
motion. It was unanimously approved by the Council. (8:20)

In accordance with 20A-5-403 the following has been designated a polling place for the 2025
Municipal Primary and General Elections for Fruit Heights City and is established as a common
polling place for all voting precincts within this city in accordance with 20A-5-303.

10-11-13: PRIVATE SWIMMING POOLS: No such pool shall be allowed in any zone except as an
accessory use and unless it complies with the following conditions and requirements:
A. It is an accessory use to a main building and is located within the side or rear yard thereof.
B. It may not be closer than six (6') feet to any interior property line of the property on which it is
located.
C. It shall not be less than twenty feet (20') from any neighbor's dwelling.
D. It shall be no closer than seven (7’) feet from the top of a slope, unless designed to support
the water in the pool without soil support.
E. The swimming pool, or the entire property on which it is located, shall be walled, or fenced
to a minimum height of six feet (6'). Where a swimming pool is located less than thirty feet (30') from
any property line, the pool shall be enclosed with a wall or fence not less than six feet (6') in height.
All gates on said fences shall be fitted with a self-closing and latching device located on the
interior side of the gate.
F. If the pool is equipped with a Pool Safety Cover as specified in ASTM standard F 1346-91
and when installed and maintained properly and in accordance with the installation instructions, a
6’ high fence may be eliminated on the side(s) and rear yards
G. Landscaping in the yard where the pool is constructed shall be designed and maintained in
such a manner as to ensure that all drainage shall be collected and conveyed to the public way
without draining onto adjacent neighbors.
H. Where a swimming pool is completely enclosed in a building, the location requirements for
accessory and main buildings shall apply. Where a swimming pool is to be located in the near
vicinity of any septic tank or sewage disposal drain field, the location must be approvedbeforehand
in writing by the Davis County health department.
I. Any pool lighting shall be installed and directed in such a manner as to not cause
disturbance to neighboring residents
