MINUTES FRUIT HEIGHTS CITY PLANNING COMMISSION MEETING 910 South Mountain Road October 9, 2012 REGULAR MEETING The regular meeting of the Fruit Heights City Planning Commission was called to order at 7:00 PM by Chairman Tom Williams. The Pledge of Allegiance was recited. PLANNING COMMISSIONERS PRESENT: Commissioners Susan Hunt, Curtis Tanner and Chairman Tom Williams. Commissioner Kristi Bybee entered the meeting at 7:10 PM. STAFF PRESENT: City Manager Brandon Green, City Planner Jeff Oyler and Recording Secretary Susan Cranford VISITORS: John B. Wilcox and Nick Mingo Agenda Item: 1. APPROVAL OF MINUTES: August 28, 2012 Commissioner Susan Hunt made a motion to approve the minutes of August 28, 2012, with corrections. Commissioner Curtis Tanner seconded the motion and it was approved unanimously by those in attendance. 2. ITEMS FROM THE PUBLIC: There were no items from the public presented. 3. PUBLIC HEARING Amendment to Title 10, Zoning Regulations Concerning Accessory Buildings Planning Commissioner Curtis Tanner made a motion to move into public hearing to receive comments on the Amendment to Title 10 of the Zoning Ordinance regarding regulations concerning accessory buildings. Commissioner Susan Hunt seconded the motion and it was approved unanimously by those present. City Planner Jeff Oyler stated the Planning Commission discussed this amendment at a previous meeting. The current Zoning Ordinance allows detached accessory buildings to be constructed six feet to the rear of the main structure. 1 Fruit Heights Planning Commission Meeting October 9, 2012 Staff recommends approving a change to the ordinance that allows an accessory building to be built adjacent to a home on a large lot, providing the lot is at least 150 feet wide and is over one acre in size. Commissioner Curtis Tanner suggested the proposed ordinance clarify that the accessory building shall match that of the main building with the height of the accessory building being equal to or less than that of the main building. The Planning Commissioners and staff agreed. Commissioner Kristi Bybee entered the meeting at this point. There were no comments from the public. Commissioner Susan Hunt made a motion to close the public hearing. Commissioner Kristi Bybee seconded the motion and it passed unanimously by those in attendance. 4. NEW BUSINESS A. Discuss/Approve/Deny Amendment to Title 10, Zoning Regulations Concerning Accessory Buildings 11:10 Commissioner Susan Hunt made a motion to change the language in the proposed ordinance as suggested by Commissioner Curtis Tanner, that the word “roofline” in the second sentence be changed to “height” and the Planning Commission approve the ord inance and recommend approval to the City Council. Commissioner Kristi Bybee seconded the motion and it passed unanimously by those in attendance. B. Discuss/Approve/Deny Orchard Farms PRUD – Phase 3 (Amended) 12:32 City Planner Jeff Oyler stated Ivory Homes is requesting a change to Phase 3 of the Orchard Farms Development. Phase 3 was approved by the city of Fruit Heights but it was never recorded. The proposal is to convert 16 townhome lots that back onto Nicholls Road into eight single family lots. The challenge for the city is to allow the change and still maintain the nice streetscape design that was expected with the townhomes on Nicholls Road. Nick Mingo of Ivory Homes showed the Planning Commission what is proposed on the lots on Snap Dragon Lane. The rear yards of the proposed homes will be on Nicholls Road. The new lot numbers are 301 through 308. Mr. Mingo discussed enhanced architecture and landscaping for the single family lots. They were shown plans for the Chesapeake, Monaco and Avignon style floor plans. Other designs are also available for purchase. 2 Fruit Heights Planning Commission Meeting October 9, 2012 The Planning Commission reviewed the First Supplement to the Declaration of Covenants, Conditions and Restrictions, and Reservation of Easements for Orchard Farms PRUD Phase 3 (CCR). Mr. Mingo stated the back yards will be completely landscaped by Ivory Homes and any changes the homeowner wants to make will have to be approved by the Management Committee of the PRUD. Mr. Mingo stated the following improvements and activities shall be prohibited in the back yard: accessory buildings, above ground pools, trampolines, dog runs, batting cages, and athletic courts. Fencing between the homes may be installed by the homeowners, but only transparent fences will be allowed. Chain link fences will not be allowed. Mr. Mingo stated decks and patios are permitted subject to review of the Architectural Committee. He stated he will add the following to the CCR: Decks and patios are allowed subject to the review of the Management Committee/Architectural Review Committee. Mr. Mingo stated he will also add to the CCR that sheds, gazebos and other accessory buildings are prohibited in the back yard. He also will add that yard equipment must be stored in the garage and play toys are prohibited. Commissioner Curtis Tanner suggested some changes to the trees and landscape plants. He suggested more shade tolerant plants be planted in the areas that don’t get full sun. He recommended two or three variety of trees be planted in the back yards and not all crabapple trees. Commissioner Susan Hunt made a motion to:  Reapprove the Orchard Farms PRUD – Phase 3 to allow the single family homes as proposed by Ivory Homes instead of the originally proposed townhomes;  Approve any elevation of homes, other than the three presented tonight (Monaco, Chesapeake and Avignon) that will be placed on lots 301 through 308, be approved by staff;  Amend the First Supplement to the Declaration of Covenants, Conditions and Restrictions (CCRs) and Reservation of Easements for Orchard Farms PRUD Phase 3 to include language regarding the fences; that any fences the homeowners chose for those lots will be consistent with the colors and materials of the wrought iron fence on Nicholls Road;  State that prohibited uses will include, in addition to what is already in the supplement, garbage cans, lawn mowers or other yard equipment, and play structures;  Include a provision that patios or decks that the homeowners add or change would be subject to approval of the architectural committee;  Make changes to the landscaping as identified by Curtis Tanner so that plantings be more consistent with the north facing buildings and have more variety; 3  Fruit Heights Planning Commission Meeting October 9, 2012  Include as part of the plat the enhanced landscape plan as presented to the Planning Commission tonight;  Include the statement in 5A of the CCR: Any and all weeds or diseased or dead lawn, trees, bushes, shrubs, or ground cover shall be removed and replaced with like. Commissioner Bybee seconded the motion. A vote was taken on the motion and it passed unanimously by those in attendance. Commissioner Susan Hunt thanked Nick Mango of Ivory Homes for the well thought out plan and the work they are doing on this project in the city. 4. REPORTS A. City Planner – Jeff Oyler 1:15:35 City Planner Jeff Oyler stated a developer may have a proposal ready for the next regularly scheduled Planning Commission meeting on October 23, which is in two weeks. The Planning Commissioners stated they will be available for a meeting that date. City Planner Oyler stated he will let them know if a meeting will be held as scheduled. B. City Council Representative – Craig Hill City Council Member Craig Hill stated Ivory Homes placed a monument at the corner of Main Street and Nicholls Road welcoming people to Fruit Heights that the City Council finds attractive. The council is looking into the cost of placing three or four more monuments in various entrances to the city. 5. ADJOURNMENT Commissioner Curtis Tanner made a motion to adjourn, seconded by Commissioner Kristi Bybee. The meeting adjourned at 8:25 PM.
