PLANNING COMMISSION MEETING

REGULAR MEETING
The regular meeting of the Fruit Heights City Planning Commission was called to order
at 7:00 PM by Vice-Chairman Kristi Bybee. The Pledge of Allegiance was recited and
Curtis Tanner gave a prayer for the opening ceremony.
PLANNING COMMISSIONERS PRESENT: Commissioners Kristi Bybee, Curtis
Tanner and Paul Wood. Commissioner Sam Brady and Chairman Susan Hunt were
excused.
STAFF PRESENT: City Planner Jeff Oyler and Recording Secretary Susan Cranford.
City Manager Brandon Green was excused.
VISITORS: Kristi Stringham, Gary Stringham, Jeff Jackson, Don Butcher, John Wilcox,
Dan Neville, Scott Nielson and Tom Williams
Agenda Item:
1. APPROVAL OF MINUTES OF MEETING: September 24, 2013
Because all pages of the minutes were not included in the Planning Commission
agenda packet and were not available for review, this item was tabled.
2. ITEMS FROM THE PUBLIC
There were no items from the public presented.
3. PUBLIC HEARINGS:
A. Rezone Application for 7.4 acres from A-1 to R-1-12 – Butcher Property
West of Highway 89 at approximately 101 South Country Lane
B. Rezone Application for 2.5 acres from A-1 to R-1-12 – Neville/Fisher
Property at approximately 961 East Fence Post Road
Commissioner Curtis Tanner made a motion to open the public hearing on the two
rezone applications: the Butcher property at approximately 101 South Country Lane
from A-1 to R-1-12 and the Neville/Fisher property at approximately 961 East Fence
Post Road from A-1 to R-1-12. Commissioner Paul Wood seconded the motion and it
passed unanimously by those in attendance.

City Planner Jeff Oyler stated that the Butcher family wants to rezone 7.4 acres on
South Country Lane from A-1 to R-1-12 to develop 11 single family lots. Country Road
will be connected to the frontage road on the west side of Highway 89 with this
development. The current property owner will keep two acres for himself until a later
date. Each lot will have a minimum of 12,000 square feet.
Jeff Jackson of Henry Walker Homes stated they are the developer of the property.
They currently have two other developments in progress in Fruit Heights and want to
continue to have a nice development in the city.
There were no further comments from the public on either rezoning application.
Commissioner Curtis Tanner made a motion to close the public hearings.
Commissioner Paul Wood seconded the motion and it passed unanimously by those in
attendance.
4. NEW BUSINESS
A. Approve/Deny Rezone Application for 7.4 acres from A-1 to R-1-12
City Planner Jeff Oyler explained that the City Engineer is working on squaring up the
new intersection on the west end of this development.
Commissioner Curtis Tanner made a motion to approve the rezone application for the
Butcher property on 7.4 acres from A-1 to R-1-12. Commissioner Paul Wood seconded
the motion and it passed unanimously by those in attendance.
B. Approve/Deny Rezone Application for 2.543 acres from A-1 to R-1-12 0:19:20
City Planner Jeff Oyler explained the applicant wants to develop three single family lots
on 2.543 acres and rezone the property from A-1 to R-1-12. Two of the lots will be
accessed from Fence Post Road and one lot from Laurelwood Drive.
City Planner Oyler stated he received two emails from neighbors stating they believe
the property will be too dense if rezoned. The proposed zoning is for the largest
residential lots available in our city’s residential zone. These will be the largest lots in
the neighborhood. City Planner Oyler recommended approval of the rezoning
application.
Commissioner Curtis Tanner made a motion to approve the rezone application on 1.543
acres from A-1 to R-1-12 on the Neville/Fisher property. Commissioner Paul Wood
seconded the motion and it passed unanimously by those in attendance.

C. Discuss/Approve/Deny Final Plat for Green Haven Subdivision 0:24:35
City Planner Jeff Oyler stated this is for preliminary and final approval of two flag lots at
approximately 71 South Mountain Road. The existing home, owned by Gene Raymond,
will be torn down to make room for the new lots. Both lots are at least one acre in size,
thus no rezone is required on the property. Both lots meet the requirements for a flag
lot development.
City Planner Oyler stated there is an earthquake fault line setback on the property. No
building will be allowed east of that setback line. There is also a landslide setback
located on Lot 2. There will be no building allowed inside that setback area. Great
Basin Earth Science was requested to review the existing geotechnical analysis done
on the property in 2008. They sent a letter stating that the recommendations for
setbacks and non-buildable areas accurately reflect the current recommendations in the
existing geotechnical report.
Commissioner Kristie Bybee made a motion to grant preliminary and final plat approval
for the property located at approximately 71 South Mountain Road. Commissioner
Curtis Tanner seconded the motion and it passed unanimously by those in attendance.
City Planner Oyler stated this item will go the City Council for final approval on January
7, 2014.
4. REPORTS
A. City Planner – Jeff Oyler
City Planner Jeff Oyler reported that subdivision approval and preliminary plat approval
will probably be at the next Planning Commission meeting in January.
B. City Council Representative – Craig Hill
Council Member Craig Hill stated the City Council thanks the Planning Commissioners
for their work this year. He reminded those in attendance of the Fruit Heights/Kaysville
First Night on December 31 and invited them to volunteer at the event.
5. ADJOURNMENT
Commissioner Curtis Tanner made a motion to adjourn, seconded by Commissioner
Paul Wood. The meeting adjourned at 7:50 PM.
